ANNEX 1 - MANDATORY CONDITIONS
The following conditions in Annex 1 are mandatory under the provisions of the Licensing Act 2003:
1.1 Alcohol shall not be sold or supplied:
(a) At any time when there is no designated premises supervisor in respect of the premises licence, or
(b) At any time when the designated premises supervisor does not hold a personal licence or his/her personal licence is suspended.
1.2 Every sale or supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.
1.3 (a) The premises licence holder or club premises certificate holder shall ensure that an age verification policy applies to the premises in relation to the sale or supply of alcohol.
(b) The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and a holographic mark.
ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
The following conditions in Annex 2 are conditions consistent with the operating schedule submitted by the applicant within the application. These will include, where required, existing expressed conditions and embedded restrictions contained within existing authorisations and enactments as specified by the Secretary of State, in accordance with Schedule 8 of the Licensing Act 2003:
1. Alcohol shall not be sold or supplied except during permitted hours. In this condition, permitted hours means:
On weekdays other than Christmas Day, 8.00am to 11.00pm
On Sundays, other than Christmas Day, 10.00am to 10.30pm
On Christmas Day, 12 noon to 3.00pm and 7.00pm to 10.30pm
On Good Friday, 8.00am to 10.30pm.
2. The above restrictions do not prohibit:
a. During the first 20 minutes after the above hours, the taking of the alcohol from the premises, unless the alcohol is supplied or taken in an open vessel;
b. The ordering of alcohol to be consumed off the premises or the despatch by the vendor of the alcohol so ordered;
c. The sale of alcohol to a trader or club for the purposes of the trade or club;
d. The sale or supply of alcohol to any canteen or mess, being a canteen in which the sale or supply of alcohol is carried out under the authority of the Secretary of State or an authorised mess of Her Majesty’s naval, military or air forces.
3. Alcohol shall not be sold in an open container or be consumed on the licensed premises.
4. The premises licence holder shall operate a ‘Challenge 25’ proof of age scheme at the licensed premises and prominently display and maintain the appropriate posters.
5. The premises licence holder shall maintain a refusals log and the DPS/manager shall check this regularly to ensure compliance. This is to be made available upon request to authorised officers under the Licensing Act 2003.
6. All staff employed on the till/checkout shall be given quarterly refresher training in respect of preventing the sale of alcohol to persons under 18 years of age, and written training records shall be kept and maintained.
7. Records of training undertaken must be to be made available upon request to authorised officers under the Licensing Act 2003.
ANNEX 3 - CONDITIONS ATTACHED AFTER A HEARING BY THE LICENSING AUTHORITY
