ANNEX 1 - MANDATORY CONDITIONS:
The following conditions in Annex 1 are mandatory under the provisions of the Licensing Act 2003:
1. Alcohol shall not be sold or supplied:
(a) At any time when there is no designated premises supervisor in respect of the
premises licence, or
(b) At any time when the designated premises supervisor does not hold a personal licence or his/her personal licence is suspended
2. Every sale or supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.
3. Where one or more individuals are being used at the licensed premises to carry out a security activity, each such individual must be licensed by the Security Industry Authority (unless where the individual is exempt from obtaining an SIA registration under the Private Security Industry Act 2001).
4. The admission of children to the exhibition of any film shall be restricted in accordance with the film classification awarded by the British Board of Film Classification (BBFC), or any successor person or persons designated as the authority under section 4 of the Video Recordings Act 1984.
5. The responsible person shall take all reasonable steps to ensure that staff on relevant premises do not carry out, arrange or participate in any irresponsible promotions in relation to the premises.
In this paragraph, an irresponsible promotion means any one or more of the following activities, or substantially similar activities, carried on for the purpose of encouraging the sale or supply of alcohol for consumption on the premises in a manner which carries a significant risk of leading or contributing to crime and disorder, prejudice to public safety, public nuisance, or harm to children -
(a) games or other activities which require or encourage, or are designed to require or
encourage, individuals to -
(i) drink a quantity of alcohol within a time limit (other than to drink alcohol sold or
supplied on the premises before the cessation of the period in which the responsible
person is authorised to sell or supply alcohol), or
(ii) drink as much alcohol as possible (whether within a time limit or otherwise);
(b) provision of unlimited or unspecified quantities of alcohol free or for a fixed or
discounted fee to the public or to a group defined by a particular characteristic (other than
any promotion or discount available to an individual in respect of alcohol for
consumption at a table meal, as defined in section 159 of the Act);
(c) provision of free or discounted alcohol or any other thing as a prize to encourage or
reward the purchase and consumption of alcohol over a period of 24 hours or less;
(d) provision of free or discounted alcohol in relation to the viewing on the premises of a
sporting event, where that provision is dependent on -
(i) the outcome of a race, competition or other event or process, or
(ii) the likelihood of anything occurring or not occurring;
(e) selling or supplying alcohol in association with promotional posters or flyers on, or in the
vicinity of, the premises which can reasonably be considered to condone, encourage or
glamorise anti-social behaviour or to refer to the effects of drunkenness in any favourable
manner.
6. The responsible person shall ensure that no alcohol is dispensed directly by one person into the mouth of another (other than where that other person is unable to drink without assistance by reason of a disability).
7. The responsible person shall ensure that free tap water is provided on request to customers where it is reasonably available.
MANDATORY CONDITIONS 8 and 9 BELOW APPLY FROM 01 OCTOBER 2010:
8. (a) The premises licence holder or club premises certificate holder shall ensure that an age verification policy applies to the premises in relation to the sale or supply of alcohol.
(b) The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and a holographic mark.
9. The responsible person shall ensure that -
(a) where any of the following alcoholic drinks is sold or supplied for consumption on the
premises (other than alcoholic drinks sold or supplied having been made up in advance
ready for sale or supply in a securely closed container) it is available to customers in the
following measures -
(i) beer or cider: ½ pint;
(ii) gin, rum, vodka or whisky: 25 ml or 35 ml; and
(iii) still wine in a glass: 125 ml; and
(b) customers are made aware of the availability of these measures.
ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE:
The following conditions in Annex 2 are conditions consistent with the operating schedule submitted by the applicant within the application:
1. There shall be no more than 4 (four) outdoor events per calendar annum at the licensed premises involving licensed regulated entertainment activities.
2. There shall be no more than 4 (four) events per calendar annum at the licensed premises involving nudity, semi-nudity or similar activities which may give rise to concern in respect of children.
3. Persons under the age of 18 shall not be permitted on the premises during any adult entertainment or services, activities, other entertainment or matters ancillary to the use of the premises that may give rise to concern in respect of children or young persons. At least two supervisors shall be on duty during any such activities.
4. Outdoor licensed regulated entertainment activities shall cease by 23:00hrs on all occasions.
5. Consumption of alcohol shall be restricted to the area within the curtilage/perimeter of the licensed premises. There shall be no sales of alcohol for consumption off the site.
6. On match days the consumption of alcohol outdoors shall be restricted to the area immediately in front of the clubhouse.
7. At all times whilst music events are in progress, the volume of music shall be controlled so as to meet the following target noise criteria: LAeq (EN) should not exceed LA90 (WEN) and L10 (EN) should not exceed L90 (WEN) in any 1/3 octave band between 40 and 160Hz.
EN = Entertainment noise level; WEN = Representative background noise level without the entertainment noise; both measured 1m from the façade of the nearest residential property.
8. There shall be at least 30 minutes drinking-up/dispersal time to ensure a gradual dispersal of clients from the site following functions/events.
9. Telephone numbers of local taxi and private hire service providers shall be made available at the licensed premises to assist with the safe and managed dispersal of patrons from the licensed premises.
10. Plastic or toughened drinks containers shall be used for the consumption of alcohol in outdoor areas of the licensed premises, and customers shall not be permitted to take glasses or bottles outdoors. Any bottles or glasses used inside the premises shall be cleared away regularly and as promptly as possible.
11. Where considered appropriate by the premises licence holders, for example for a particular licensed event or activity, door staff shall be employed (see also mandatory condition 3 of Annex 1).
12. Wherever reasonably practicable, the premises licence holder shall have a member of the Club management or staff on site during any hirings. Anyone hiring the premises shall be advised of the terms and conditions of licence BPL0369. It is also recommended that such instruction should include offences under the Licensing Act 2003.
13. All bar staff shall receive adequate training relevant to promotion of the licensing objectives.
14. A ‘Challenge 21’ or similar proof of age scheme shall be operated at the licensed premises to assist with the prevention of underage sales. Any person who appears to be under the age of 21 shall be requested to provide a bona fide form of photographic identity proof of age.
15. External lighting shall be provided to the car park during the hours of darkness and whilst the premises are being used for licensable activities.
16. Access routes for emergency services vehicles shall be kept clear and unobstructed.
17. There shall be no late night refreshment for takeaway beyond the curtilage/perimeter of the licensed premises.
18. Provision of late night refreshment in outdoor areas of the licensed premises shall only take place between 01 May and 30 September.
ANNEX 3 - CONDITIONS ATTACHED AFTER A HEARING BY THE LICENSING AUTHORITY:
