ANNEX 1 - MANDATORY CONDITIONS
The following conditions in Annex 1 are mandatory under the provisions of the Licensing Act 2003:
1. Alcohol shall not be sold or supplied:
(a) At any time when there is no designated premises supervisor in respect of the
premises licence, or
(b) At any time when the designated premises supervisor does not hold a personal licence or his/her personal licence is suspended
2. Every sale or supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.
3. The responsible person shall take all reasonable steps to ensure that staff on relevant premises do not carry out, arrange or participate in any irresponsible promotions in relation to the premises.
In this paragraph, an irresponsible promotion means any one or more of the following activities, or substantially similar activities, carried on for the purpose of encouraging the sale or supply of alcohol for consumption on the premises in a manner which carries a significant risk of leading or contributing to crime and disorder, prejudice to public safety, public nuisance, or harm to children -
(a) games or other activities which require or encourage, or are designed to require or
encourage, individuals to -
(i) drink a quantity of alcohol within a time limit (other than to drink alcohol sold or
supplied on the premises before the cessation of the period in which the responsible
person is authorised to sell or supply alcohol), or
(ii) drink as much alcohol as possible (whether within a time limit or otherwise);
(b) provision of unlimited or unspecified quantities of alcohol free or for a fixed or
discounted fee to the public or to a group defined by a particular characteristic (other than
any promotion or discount available to an individual in respect of alcohol for
consumption at a table meal, as defined in section 159 of the Act);
(c) provision of free or discounted alcohol or any other thing as a prize to encourage or
reward the purchase and consumption of alcohol over a period of 24 hours or less;
(d) provision of free or discounted alcohol in relation to the viewing on the premises of a
sporting event, where that provision is dependent on -
(i) the outcome of a race, competition or other event or process, or
(ii) the likelihood of anything occurring or not occurring;
(e) selling or supplying alcohol in association with promotional posters or flyers on, or in the
vicinity of, the premises which can reasonably be considered to condone, encourage or
glamorise anti-social behaviour or to refer to the effects of drunkenness in any favourable
manner.
4. The responsible person shall ensure that no alcohol is dispensed directly by one person into the mouth of another (other than where that other person is unable to drink without assistance by reason of a disability).
5. The responsible person shall ensure that free tap water is provided on request to customers where it is reasonably available.
6. (a) The premises licence holder or club premises certificate holder shall ensure that an age verification policy applies to the premises in relation to the sale or supply of alcohol.
(b) The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and a holographic mark.
7. The responsible person shall ensure that -
(a) where any of the following alcoholic drinks is sold or supplied for consumption on the
premises (other than alcoholic drinks sold or supplied having been made up in advance
ready for sale or supply in a securely closed container) it is available to customers in the
following measures -
(i) beer or cider: ½ pint;
(ii) gin, rum, vodka or whisky: 25 ml or 35 ml; and
(iii) still wine in a glass: 125 ml; and
(b) customers are made aware of the availability of these measures.
8. Where -
(a) the film classification body is not specified in the licence, or
(b) the relevant licensing authority has notified the holder of the licence that this subsection applies to the film in question,
admission of children must be restricted in accordance with any recommendation made by that licensing authority.
In this section-
“children” means persons aged under 18; and
“film classification body” means the person or persons designated as the authority under section 4 of the Video Recordings Act 1984 (c. 39) (authority to determine suitability of video works for classification).
ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
The following conditions in Annex 2 are conditions consistent with the operating schedule submitted by the applicant within the application. These will include, where required, existing expressed conditions and embedded restrictions contained within existing authorisations and enactments as specified by the Secretary of State, in accordance with Schedule 8(6) of the Licensing Act 2003:
1. Alcohol shall not be sold or supplied except during the hours authorised by and identified on premises licence BPL0198.
2. Alcohol may be sold or supplied for one hour following the terminal hour shown for the supply of alcohol and on Christmas Day between 15:00hrs and 19:00hrs to persons taking table meals in the premises in a part of the premises usually set apart for the service of such persons and for consumption by such a person in that part of the premises as an ancillary to his meal. For other purposes or in other parts of the premises the terminal hour set out under standard timings shall continue to apply.
3. The premises shall be structurally adapted and bona fide used (intended to be used) for the purpose of habitually providing, for the accommodation of persons frequenting the premises, substantial refreshment to which the sale and supply of alcohol is ancillary.
4. No person under 14 shall be in the bar of the licensed premises during the permitted hours unless one of the following applies:
He/she is the child of the holder of the premises licence.
He/she resides in the premises, but is not employed there.
He/she is in the bar solely for the purpose of passing to or from some part of the premises which is not a bar and to or from which there is no other convenient means of access or egress.
The bar is in railway refreshment rooms or other premises constructed, fitted and intended to be used bona fide for any purpose to which the holding of the licence is ancillary.
In this condition “bar” includes any place exclusively or mainly used for the consumption of alcohol. But an area is not a bar when it is usual for it to be, and it is, set apart for the service of table meals and alcohol is only sold or supplied to persons as an ancillary to their table meals.
5. Late night refreshment and the supply of alcohol within the new accommodation block shall not be made to any person other than to a residential guest staying within the accommodation block or a bona fide visitor of such a guest.
6. Persons under the age of 18 years shall not have access to the mini-bar facilities, which shall be adequately secured by means of a combination or key locking system. The combination or key to access mini-bar facilities shall only to be issued to a person over the age of 18 years.
7. A video/CCTV system displaying the correct time and date of the recording shall be in operation with sufficient cameras to monitor all internal and external areas where licensable activities take place and be capable of producing immediate copies on site either recorded digitally on to CD/DVD or other equivalent medium. A person competent in producing visual recordings to the police or an authorised officer on demand to be present on the premises at all times.
All recording to be retained and stored in a suitable and secure manner for a minimum of 28 days and be made available, subject to compliance with Data Protection legislation, to the police for inspection on request.
CCTV monitoring and recording equipment (including any mobile units in use at the premises) to be maintained at all times in a working condition.
8. All staff/individuals engaged or to be engaged in the sale of alcohol on the premises shall receive the following training in age restricted sales with training records available for inspection by the police or other authorised officer on request.

refresher/reinforcement training at intervals of no more than 6 months.
The designated premises supervisor shall authorise in writing the names of the staff members/individuals suitably trained to be responsible for the sale of alcohol at the premises in his/her absence.
9. A zero tolerance drug policy to be implemented at the premises and appropriate drug awareness staff training shall take place with training records maintained and made available on request to the Police or an Authorised Officer
10. Where glass bottles are used, they will be retained or disposed or on the premises.
11. We will ensure that all fire equipment is serviced regularly, and that fire exits are well maintained and never locked.
12. We will make sure that escape routes and exists, including external exists, are maintained to ensure that they are not obstructed, are in good working order and free of trip hazards.
13. Make sure that all fire doors are maintained and effectively self closing and not held open other than by approved devices.
14. We will ensure that hangings, curtains and temporary decorations are maintained in a flame retardant condition and that any upholstered seating meets the smouldering ignition standard.
15. We will ensure that access for emergency vehicles is kept clear and free from obstruction.
16. We will make sure that adequate arrangements exist to enable disabled persons to evacuate the premises safely in the event of an emergency and that the staff are made aware of these arrangements.
17. We will make sure that adequate and appropriate supplies of first aid equipment and materials are available on the premises and that at least one member of staff is a trained first aider.
18. We will make sure that we have valid public liability insurance in force.
19. When events involving regulated entertainment are to occur the event details and a contact number to be advertised at least seven days before the event either outside the venue and/or on the website, where concerns and suggestions can be raised before, during or after the proposed event. A written record of such calls and actions taken to be maintained.
20. Noise or vibration from licensable activities must not emanate from the premises so as to cause a nuisance at nearby properties.
21. Except for ingress to and egress from the premises, all doors and windows to remain closed from 22:00 hours during events involving regulated entertainment.
22. The placing of refuse and empty bottles into outside receptacles shall not take place during the night-time hours between 21:00 and 07:00 to minimise disturbance to nearby properties.
23. Clear and legible notices to be prominently displayed at all premises exits to request patrons to respect the needs of local residents and to leave the premises and surrounding area quietly.
24. Clear and legible notices to be prominently displayed in the external smoking area to request patrons to respect the needs of local residents and to use the smoking facility in a quiet and responsible manner.
25. The premises licence holder shall ensure that an age verification policy will apply to the premises whereby all bar staff will be trained to ask any customer attempting to purchase alcohol, who appears to be under the age of 25 years (or older if the licence holder so elects) to produce, before being sold alcohol, identification being a passport or photocard driving licence bearing a holographic mark or other form of identification that complies with any mandatory condition that may apply to this licence.
26. Where the sale of alcohol takes place at events in an area of the premises other than the main bar, no persons under 18 years of age to be permitted entry to the area where the event is taking place unless accompanied by a responsible adult.
27. An incident book to record the refusal of alcohol sales and/or ejections from the premises to be maintained on the premises and this book to be made available on request to the police or an authorised officer.
28. There will be no gaming on the premises.
29. The premises holder shall ensure that noise levels are monitored both inside and outside the premises at regular intervals during the times licensable activities are authorised and particularly where events involving regulated entertainment and/or the showing of a film are taking place. Where the level of noise or vibration is deemed likely to cause a disturbance to local residents, they shall cause that noise or vibration to be reduced as soon as is reasonably practicable. Where a reduction of noise or vibration is deemed as being necessary the premises licence holder shall record details - including time and date - and maintain a copy of that record for a period of 2yrs
30. On all occasions noise levels shall remain under the direct control of staff and management, which shall be adjusted where advised by a police officer or authorised officer of the local authority.
31. Notices shall be prominently displayed at all exits and in the outside area requesting patrons to respect the needs of neighbouring residents by keeping noise to a minimum, which shall be supervised by staff and management.
32. The showing of films shall be limited to not more than 20 occasions per calendar year with an occasion being the showing of one film. A record of these occasions will be maintained and made available upon reasonable and lawful request by any authorised officer of the Licensing Authority or the police.
