ANNEX 1 - MANDATORY CONDITIONS
The following conditions in Annex 1 are mandatory under the provisions of the Licensing Act 2003:
1. Alcohol shall not be sold or supplied:
(a) At any time when there is no designated premises supervisor in respect of the
premises licence, or
(b) At any time when the designated premises supervisor does not hold a personal licence or his/her personal licence is suspended
2. Every sale or supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.
3. The admission of children to the exhibition of any film shall be restricted in accordance with the film classification awarded by the British Board of Film Classification (BBFC), or any successor person or persons designated as the authority under section 4 of the Video Recordings Act 1984.
4. Where one or more individuals are being used at the licensed premises to carry out a security activity, each such individual must be licensed by the Security Industry Authority (unless where the individual is exempt from obtaining an SIA registration under the Private Security Industry Act 2001).
5. The responsible person shall take all reasonable steps to ensure that staff on relevant premises do not carry out, arrange or participate in any irresponsible promotions in relation to the premises.
In this paragraph, an irresponsible promotion means any one or more of the following activities, or substantially similar activities, carried on for the purpose of encouraging the sale or supply of alcohol for consumption on the premises in a manner which carries a significant risk of leading or contributing to crime and disorder, prejudice to public safety, public nuisance, or harm to children -
(a) games or other activities which require or encourage, or are designed to require or
encourage, individuals to -
(i) drink a quantity of alcohol within a time limit (other than to drink alcohol sold or
supplied on the premises before the cessation of the period in which the responsible
person is authorised to sell or supply alcohol), or
(ii) drink as much alcohol as possible (whether within a time limit or otherwise);
(b) provision of unlimited or unspecified quantities of alcohol free or for a fixed or
discounted fee to the public or to a group defined by a particular characteristic (other than
any promotion or discount available to an individual in respect of alcohol for
consumption at a table meal, as defined in section 159 of the Act);
(c) provision of free or discounted alcohol or any other thing as a prize to encourage or
reward the purchase and consumption of alcohol over a period of 24 hours or less;
(d) provision of free or discounted alcohol in relation to the viewing on the premises of a
sporting event, where that provision is dependent on -
(i) the outcome of a race, competition or other event or process, or
(ii) the likelihood of anything occurring or not occurring;
(e) selling or supplying alcohol in association with promotional posters or flyers on, or in the
vicinity of, the premises which can reasonably be considered to condone, encourage or
glamorise anti-social behaviour or to refer to the effects of drunkenness in any favourable
manner.
6. The responsible person shall ensure that no alcohol is dispensed directly by one person into the mouth of another (other than where that other person is unable to drink without assistance by reason of a disability).
7. The responsible person shall ensure that free tap water is provided on request to customers where it is reasonably available.
8. (a) The premises licence holder or club premises certificate holder shall ensure that an age verification policy applies to the premises in relation to the sale or supply of alcohol.
(b) The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and a holographic mark.
9. The responsible person shall ensure that -
(a) where any of the following alcoholic drinks is sold or supplied for consumption on the
premises (other than alcoholic drinks sold or supplied having been made up in advance
ready for sale or supply in a securely closed container) it is available to customers in the
following measures -
(i) beer or cider: ½ pint;
(ii) gin, rum, vodka or whisky: 25 ml or 35 ml; and
(iii) still wine in a glass: 125 ml; and
(b) customers are made aware of the availability of these measures.
ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
The following conditions in Annex 2 are conditions consistent with the operating schedule submitted by the applicant within the application:
1. Licensed activities shall be restricted to the areas as identified within the plans attached as Annex 4 to premises licence BPL0107/007465. The drawing references are as below:

2. Plays: Plays to which the public may attend shall be limited to no more than 4 (four) occasions per calendar annum. Performances of plays shall be restricted to the Assembly Hall, Jellicoe Room or Music Hall indoors and Terrace or St.Vincent Green outdoors. The premises licence holder shall ensure that any noise emanating from this activity shall remain at a reasonable level so as to not cause a public nuisance.
3. Films: Films to which the public may attend shall be shown in the function rooms such as the Assembly Hall or Jellicoe Room. Any films shown outdoors shall be during the summer term and break only. See also Annex 1 mandatory condition 3 (above).
4. Live music: The maximum capacity of the Music Hall for live music performances shall be limited to an audience of 200 persons (seated) unless the provisions of the Fire Safety Reform Order 2005 (or any successor regulation) require an alternative maximum safe capacity to be set.
5. Live music: The ceremonial marching band and drum band rehearsal and performance outdoors shall be restricted to the Parade Ground and only during the summer term. Performances shall be limited to 1200 persons (including staff and performers) unless the provisions of the Fire Safety Reform Order 2005 (or any successor regulation) require an alternative maximum safe capacity to be set.
6. Live music: Any amplification being used as part of a live music performance shall be kept to a reasonable level consistent with the nature of the event/activity and so as not to cause a public nuisance.
7. Live music: Any concerts or recitals organised by the Holbrook Music Society shall be limited to no more than 3 (three) occasions per term and shall be held in the Music School, Chapel or one of the function rooms. The maximum capacity for such events shall be limited to 300 persons unless the provisions of the Fire Safety Reform Order 2005 (or any successor regulation) require an alternative maximum safe capacity to be set for the area being used.
8. Recorded music: Recorded music shall normally only be played in outdoor areas during the summer term and as an accompaniment to a firework display, the performance of a play or as background music to a summer fete or sporting event.
9. Recorded music: Any amplification being used as part of an event including recorded music shall be kept to a reasonable level consistent with the nature of the event/activity and so as not to cause a public nuisance.
10. Performances of dance: Performances of dance to which the public may attend indoors shall take place in one of the function rooms, usually the Assembly Hall, Jellicoe Room, Dining Hall or Music School. Performances of dance outdoors will normally be as part of an end-of-term variety concert, summer fair or pupil/staff performance. Any outdoor dance activities shall only take place during the summer term.
11. Provision of facilities for dancing: The main dance floor facilities shall be in the Assembly Hall, Jellicoe Room and Dining Hall which may extend to disco or dinner-dance functions. Smaller dance floor facilities may be made available in the Recital Hall. Any specific provision made for facilities for dancing outdoors shall be on St.Vincent Green and only during the summer term.
12. Provision of facilities for entertainment similar to making music or dancing: The provision of facilities for such activities indoors shall be located within the Music Hall, Chapel, Assembly Hall, Jellicoe Room, Dining Hall and reception areas. Outdoor facilities shall only be available during the summer term on St.Vincent Green.
13. Late night refreshment: Late night refreshment shall be limited to hot beverages and shall only be available on nights during which there is an authorised evening activity such as dinner-dance or school play. Hot beverages may be provided/consumed in outdoor areas (for example on the terrace) as well as indoors.
14. Supply of alcohol: Alcohol may be sold and supplied in the Music Room, Assembly Hall, Jellicoe Room, Dining Room, Conference Room, Library, or reception halls. Supply of alcohol shall only be as part of another regulated activity or at the Headmaster’s and Governors’ Reception. Alcohol may also be sold and supplied in Nelson House providing it is in accordance with the school’s alcohol policy. The bar facilities in Nelson House shall be available for staff and pupils over the age of 18 only, and not for the public.
15. Supply of alcohol: Consumption of alcohol may take place in outdoor areas of the premises (for example on the terrace) having been sold or supplied indoors to participants in, or audience of a regulated activity such as dinner-dance, music recital or the performance of a play.
16. There shall be no adult entertainment or services, activities, other entertainment or matters ancillary to the use of the premises that may give rise to concern in respect of children.
17. All regulated licensable activity conducted at the premises shall be undertaken in accordance with the school’s code of conduct (as may be revised from time to time) and duties/responsibilities under child protection legislation including (but not limited to) the National Minimum Standards set by the Department for Education and inspected by the Independent Schools Inspectorate.
18. Whilst the school is not open to the public generally, it may be hired by organisations or individuals for specific purposes (for example swimming club or wedding receptions). The premises licence holder shall ensure that such activities are conducted in accordance with the licence terms and conditions of premises licence BPL0107/007465. The premises licence holder shall ensure that relevant licensing information is passed on to the hirer as part of any hiring agreement.
19. The Designated Premises Supervisor (DPS) and any additional personal licence holders shall be suitably and sufficiently trained and qualified to perform their duties in respect of promoting the licensing objectives.
20. In addition to the DPS and any additional personal licence holders on duty/on-call during any organised event or activity involving licensable activities for the public, there shall also be security porters/on-call staff either on duty or on call for the duration of the event or activity and also for a suitable period after the event to ensure the premises are cleared, closed down and sufficiently secured.
21. A suitable CCTV system shall be installed and maintained on the licensed premises to cover access and egress points at the premises.
22. The premises licence holder shall maintain suitable and sufficient public liability insurance. A copy of the relevant certificate of insurance shall be held by the Bursar and be made available for inspection upon request of an authorised officer of the Local Authority or Responsible Authority.
23. The premises licence holder shall take all reasonable steps to ensure the safety of the public, performers or employees whilst they are on the licensed premises.
24. The premises licence holder shall take all reasonable steps to maintain order and decent standards of behaviour of persons whilst they are on the licensed premises.
25. All parts of the licensed premises, including the fixtures and fittings (whether fixed or otherwise), shall be kept clean and maintained in good working order.
26. The premises licence holder’s Fire Safety Policy (in compliance with Regulatory Reform (Fire Safety) Order 2005) shall outline the checks and procedures designed to ensure the safety of pupils, staff and visitors to the licensed premises.
27. Records of fire safety equipment checks shall be maintained by the Estate Manager and made available upon request for inspection by the Suffolk Fire and Rescue Service.
28. The premises licence holder shall ensure that functions/events involving licensable activities for a combination of staff, pupils and public shall have a high level of staff supervision on all occasions, with such staff to be suitably and sufficiently trained in matters to include:
(a) The action to be taken upon discovering a fire
(b) The position of exits
(c) The operation of emergency lighting and fire fighting equipment
(d) Raising the alarm and the correct method of calling the Fire Service
(e) Evacuation of the public in the event of an emergency
29. For hirings of the licensed premises by the public (for functions such as wedding receptions), the premises licence holder shall identify the person in charge of the event. That person shall then be provided with both a verbal and written brief on the action to be taken in the event of an emergency and the nomination of suitable stewards. Additionally, that person shall be provided with the contact number of the School’s duty security person, who will be on stand-by throughout the event.
30. The premises licence holder shall ensure that all external routes from exit points are maintained so they remain clear and unobstructed whilst members of the public are present on the licensed premises. All parts of the licensed premises that shall be used as means of escape in the event of fire or other emergency shall be kept entirely free from obstruction, whether permanent or temporary, so as not to impede the safe evacuation of persons from the premises buildings and on to the Parade Ground.
31. The premises licence holder shall ensure that risk assessments are regularly reviewed in relation to licensable activities and to ensure that the risk of crime and disorder are minimised.
32. (a) The entitlements of premises licence BPL0107/007465 shall only authorise licensable regulated entertainment activities involving the playing of amplified music outdoors within the designated areas, if they are directly related to the educational or promotional activities of the School, and if the performances are made only by members of the School or by third parties performing expressly for the purposes of educational and/or promotional activities.
(b) For the avoidance of doubt, any such licensable activity which is not directly related to the School’s academic events, functions or curriculum, for example a commercial music concert or festival organised by external operators, shall not be authorised by Premises Licence BPL0107/007465, and for such occasions, a separate, time-limited licence application would normally need to be made so as to ensure promotion of the licensing objectives.
33. The premises licence holder shall ensure that all members of staff, volunteers and regular and frequent visitors involved with licensable activities for children and vulnerable adults shall have been adequately vetted for suitability, where provision has been made for them to lawfully do so, for example via access to the enhanced CRB disclosure service and vetting and barring records. The school has designated the Deputy Headmaster as its senior Child Protection and Welfare Officer.
