ANNEX 1 - MANDATORY CONDITIONS
The following conditions in Annex 1 are mandatory under the provisions of the Licensing Act 2003:
1.1 Alcohol shall not be sold or supplied:
(a) At any time when there is no designated premises supervisor in respect of the premises licence, or
(b) At any time when the designated premises supervisor does not hold a personal licence or his/her personal licence is suspended.
1.2 Every sale or supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.
1.3 (a) The premises licence holder or club premises certificate holder shall ensure that an age verification policy applies to the premises in relation to the sale or supply of alcohol.
(b) The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and a holographic mark.
ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
The following conditions in Annex 2 are conditions consistent with the operating schedule submitted by the licence holder within the application:
2.1 The premises licence holder shall monitor, review and update their policies and procedures to ensure that the licensing objectives are met.
2.2 The premises licence holder shall install and maintain a recordable CCTV system encompassing all ingress and egress from the premises including fire exits and the licensed area of the premises. Images shall be recorded from the CCTV system on all occasions whilst the premises are open for licensed activity and recordings shall be retained for a minimum period of 28 (twenty-eight) days. Recordings in a viewable format shall be provided to an authorised officer of the Police or Local Authority within 36 hours upon request. It should be noted that any retention, use or disclosure of personal information captured on CCTV must be carried out in line with data protection principles.
2.3 The premises licence holder shall appoint a Manager who will have full responsibility for the premises whilst it is open, with a wider Management Team to support and deputise in their absence.
2.4 The premises licence holder shall ensure that the site Management Team develops bespoke policies, processes, procedures and risk assessments which are enforced to ensure and maintain the health, safety, welfare and security of employees and members of the public at the premises.
2.5 The premises licence holder shall ensure there is no public nuisance on and in the immediate vicinity of the premises, caused by the operation of the premises, during opening hours when alcohol and other age related products will be sold to the public.
2.6 A ‘Challenge 25’ (or equivalent) proof of age scheme shall be operated at the licensed premises, to ensure that persons appearing to be under the age of 25 years shall be asked to produce a valid form of photographic identity - such as passport, driving licence or PASS accredited proof of age card - when attempting to purchase alcohol. Notices relating to the ‘Challenge 25’ (or equivalent) scheme shall be prominently displayed and maintained at the licensed premises.
2.7
A refusals register shall be used and maintained at the licensed premises.
2.8 All staff shall be trained on the Challenge 25 policy prior to being permitted to sell alcohol. Management shall be trained to the minimum of the Level 2 award for personal licence holders. Training records shall be maintained at the head office of the society and made available upon request to an authorised officer of the Local Authority or Police. Staff shall receive refresher training not less than every six months to ensure that they are up to date with relevant legislation and policies.
2.9 In order to promote the Prevention of Crime and Disorder and Prevention of Public Nuisance, the premises licence holder shall not sell super strength beer, lager or cider with an alcohol content of 6.5% ABV (alcohol by volume) or greater. This restriction shall not apply in respect of specialist branded, premium priced, products - for example craft ales, local or micro brewery specialist products, boxed gifts or national celebratory/commemorative beer, lager or cider with an alcohol content of 6.5% ABV or greater.
