1 - MANDATORY CONDITIONS\ulnone\b0\f2\par \pard\ltrpar\keepn\s1\li-1276\i\f1\fs20 The following conditions in Annex 1 are mandatory under the provisions of the Licensing Act 2003:\par \pard\ltrpar\i0\fs22\par \pard\ltrpar\fi-567\li-709\ri-766\tx360\tx1080 1.1 \tab The responsible person must ensure that staff on relevant premises do not carry out, arrange or participate in any irresponsible promotions in relation to the premises. In this paragraph, an irresponsible promotion means any one or more of the following activities, or substantially similar activities, carried on for the purpose of encouraging the sale or supply of alcohol for consumption on the premises -\par \par \pard\ltrpar\li360\ri-766\tx360\tx1080 (a) games or other activities which require or encourage, or are designed to require or encourage, individuals to -\par \pard\ltrpar\li1080\ri-766\tx360\tx1080 (i) drink a quantity of alcohol within a time limit (other than to drink alcohol sold or supplied on the premises before the cessation of the period in which the responsible person is authorised to sell or supply alcohol), or\par \pard\ltrpar\li-1276\ri-766\tx360\tx1080\tab\tab (ii) drink as much alcohol as possible (whether within a time limit or otherwise);\par \pard\ltrpar\li360\ri-766\tx360\tx1080 (b) provision of unlimited or unspecified quantities of alcohol free or for a fixed or discounted fee to the public or to a group defined by a particular characteristic in a manner which carries a significant risk of undermining a licensing objective;\par (c) provision of free or discounted alcohol or any other thing as a prize to encourage or reward the purchase and consumption of alcohol over a period of 24 hours or less in a manner which carries a significant risk of undermining a licensing objective;\par (d) selling or supplying alcohol in association with promotional posters or flyers on, or in the vicinity of, the premises which can reasonably be considered to condone, encourage or glamorise anti-social behaviour or to refer to the effects of drunkenness in any favourable manner;\par (e) dispensing alcohol directly by one person into the mouth of another (other than where that other person is unable to drink without assistance by reason of disability).\par \par \pard\ltrpar\fi-567\li-709\ri-766\tx360\tx1080 1.2 \tab The responsible person must ensure that free potable water is provided on request to customers where it is reasonably available.\par \par \pard\ltrpar\fi-567\li-709\ri-766\tx1080 1.3 \tab (a) The premises licence holder or club premises certificate holder must ensure that an age verification policy is adopted in respect of the premises in relation to the sale or supply of alcohol.\par \pard\ltrpar\li-709\ri-766\tx1080 (b) The designated premises supervisor in relation to the premises licence must ensure that the supply of alcohol at the premises is carried on in accordance with the age verification policy.\par (c) The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and either -\par \pard\ltrpar\li-1276\ri-766\tx360\tx1080\tab (i) a holographic mark, or\par \tab (ii) an ultraviolet feature.\par \pard\ltrpar\li-1276\ri-766\tx1080 1.4 \tab The responsible person must ensure that -\par \pard\ltrpar\li-709\ri-766\tx360 (a) where any of the following alcoholic drinks is sold or supplied for consumption on the premises (other than alcoholic drinks sold or supplied having been made up in advance ready for sale or supply in a securely closed container) it is available to customers in the following measures -\par \pard\ltrpar\li-1276\ri-766\tx360\tx1080\tab (i) beer or cider: \'bd pint;\par \tab (ii) gin, rum, vodka or whisky: 25 ml or 35 ml; and\par \tab (iii) still wine in a glass: 125 ml;\par \pard\ltrpar\li-709\ri-766\tx360\tx1080 (b) these measures are displayed in a menu, price list or other printed material which is available to customers on the premises; and\par \pard\ltrpar\fi-567\li-709\ri-766\tx1080\tab (c) where a customer does not in relation to a sale of alcohol specify the quantity of alcohol to be sold, the customer is made aware that these measures are available.\par \par \pard\ltrpar\fi-567\li-709\ri-766\tx360\tx1080 1.5 \tab The relevant person (the holder of the premises licence, the designated premises supervisor (if any) in respect of such a licence, the personal licence holder who makes or authorises a supply of alcohol under such a licence, or any member or officer of a club present on the premises in a capacity which enables the member or officer to prevent the supply in question) shall ensure that no alcohol is sold or supplied for consumption on or off the premises for a price which is less than the permitted price.\par \par \pard\ltrpar\li-709\ri-766\tx1080 For the purposes of this condition \ldblquote duty\rdblquote is to be construed in accordance with the Alcoholic Liquor Duties Act 1979, \ldblquote permitted price\rdblquote is the price found by applying the formula -\par \par \pard\ltrpar\li-1276\ri-766\tx360\tx1080\tab\tab\tab\tab\tab\b P = D + (D x V)\par \par \pard\ltrpar\li-709\ri-766\tx360\tx1080\b0 where - (i) \b P\b0 is the permitted price, (ii) \b D\b0 is the rate of duty chargeable in relation to the alcohol as if the duty were charged on the date of the sale or supply of the alcohol, and (iii)\b V\b0 is the rate of value added tax chargeable in relation to the alcohol as if the value added tax were charged on the date of the sale or supply of the alcohol;\par [\ldblquote value added tax\rdblquote means value added tax charged in accordance with the Value Added Tax Act 1994]\par \pard\ltrpar\tx360\tx1080\fs20\par \pard\ltrpar\li-1276\ul\b\fs22 ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE\ulnone\b0\f2\par \pard\ltrpar\keepn\s1\li-1276\qj\i\f1\fs20 The following conditions in Annex 2 are conditions consistent with the operating schedule submitted by the applicant within the application:\par \pard\ltrpar\qj\i0\fs24\par \pard\ltrpar\fi-567\li-709\ri-766\qj\fs22 2.1\tab At least one member of bar staff shall be aged 21 years or over. No bar staff shall be under the age of 18.\par \pard\ltrpar\li-1276\ri-766\qj\par \pard\ltrpar\fi-567\li-709\ri-766\qj 2.2\tab A club committee member or someone authorised to act on behalf of the club committee shall be present at all times whilst the club is open for licensable activities. For the avoidance of doubt this shall also apply to temporary events.\par \par 2.3\tab Any hirer of the club facilities shall be at least 25 years old and it shall be a condition of the hire that they are present throughout the function. The club committee shall not permit any sixth form or 18th birthday party functions. \par \par 2.4\tab Functions involving licensable activities shall be limited to not more than 40 (forty) per calendar annum. The club committee shall maintain a legible written record of all hiring\rquote s of the club premises (whether it be members hiring\rquote s or TENS hiring\rquote s) and this shall be produced for inspection upon request of an authorised officer of the Local Authority or Police. \par \par 2.5\tab Any member of the club contravening any of the hiring conditions shall be subject to the club disciplinary proceedings.\par \par 2.6\tab For all hiring\rquote s the nature of the function shall be considered\f2 \f1 by the club committee or person authorised by the committee to undertake this role, prior to any booking being accepted.\par \par 2.7\tab All sales of alcohol shall be made and payment taken directly over the bar.\par \par 2.8\tab A CCTV system shall be installed and maintained in good working order on the premises.\par \par 2.9\tab The club committee shall operate a \lquote Challenge 21\rquote proof of age scheme at the club premises requiring bar staff to request photographic identity proof of age where an individual appears to be under 21 years of age.\par \par 2.10\tab The club committee shall take all reasonable steps to ensure that consumption of alcohol supplied by the club is not permitted outside of the areas identified on the plan attached as Annex 4. Alcohol shall only be available for consumption on the hard standing overlooking the cricket pitch on football match days or whilst cricket matches are taking place. Alcohol may only be consumed around the perimeter of the pitch or main stand during football matches, or during any of the four (maximum) outdoor music events.\par \par 2.11\tab During match days any beverages supplied for consumption around the perimeter of the football pitch or main stand shall be supplied in plastic glasses or cans. No bottles or glasses shall be permitted beyond the hard standing in front of the clubhouse.\par \par 2.12\tab The pathway leading from the carpark to the clubhouse shall be suitably and sufficiently lit when the clubhouse is open during the hours of darkness, particularly during evening functions. The use of floodlights to illuminate the access to the clubhouse from the car park during hiring\rquote s or functions shall be prohibited. For avoidance of doubt, the floodlights shall be used only during football matches/training. All other lighting installed and used for illumination of the access route to the clubhouse shall be designed and operated so as not to cause loss of amenity or nuisance to nearby residential properties. \par \par 2.13\tab The volume control of any amplification equipment being used on the licensed premises shall be kept under the direct control of a committee member, or someone authorised to act on behalf of the committee. At the direct request of an authorised officer of the Local Authority or Police, the volume level shall be decreased.\par \par 2.14\tab Access to the clubhouse whilst any noisy licensable activities are taking place shall be through the access door in the centre of the south west elevation, overlooking the main pitch.\par \par 2.15\tab During functions all external doors and windows at the licensed premises shall be kept closed (save for access or egress) in order to minimise any noise escape. Consideration shall be given by the club committee to the fitting of self-closing devices to external doors. \par \par 2.16\tab Outdoor music events (whether live or recorded music or a combination of the two) shall be restricted to not more than four occasions per calendar year, and, of these events, where music is to continue beyond 19:00hrs, and/or will have a duration of greater than two hours, the Licensing Authority shall be consulted not later than 21 days before the event.\par \par 2.17\tab Any ventilation systems in use on the licensed premises shall have suitable sound attenuation.\par \par 2.18\tab Empty drinking vessels shall be regularly collected so as to ensure no accumulation in areas to which members and guests have access. Any activities such as the taking out of refuse, including glass bottles, shall not be carried out between the hours of 23:00hrs and 07:00hrs.\par \par 2.19\tab A club committee member, or other competent person authorised to act on behalf of the club committee, shall regularly survey noise breakout from the club premises whilst regulated entertainment is being provided. Where the noise or vibration level is such that it is likely to cause a disturbance to residential properties, he/she shall decrease the volume level accordingly.\par \par 2.20\tab Notices shall be prominently displayed and maintained on the club premises advising patrons to leave the area quietly and with consideration to the rights of local residents and also advising on any relevant prevention of crime and disorder information that may be reasonably required by the Local Authority or Police.\par \par 2.21\tab It will be a condition of hire that if any hirer intends to include any form of \lquote adult\rquote entertainment they shall make that clear and the acceptance of the hiring will be considered by the club committee.\par \par 2.22\tab It will be a condition of hire that if any function is to include any form of \lquote adult\rquote entertainment no person under the age of 18 is to be permitted at the function. \par \pard\ltrpar\qj\i\par \pard\ltrpar\li-1276\ul\b\i0 ANNEX 3 - CONDITIONS ATTACHED AFTER A HEARING BY THE LICENSING AUTHORITY\ulnone\b0\f2\par \pard\ltrpar\ri-766\qj\f1\par \pard\ltrpar\fi-567\li-709\ri-908\qj Not applicable\par \pard\ltrpar\li-1276\par \pard\ltrpar\par \f0\fs16\par } "
