ANNEX 1 - MANDATORY CONDITIONS:
The following conditions in Annex 1 are mandatory under the provisions of the Licensing Act 2003:
1. The responsible person shall take all reasonable steps to ensure that staff on relevant premises do not carry out, arrange or participate in any irresponsible promotions in relation to the premises.
In this paragraph, an irresponsible promotion means any one or more of the following activities, or substantially similar activities, carried on for the purpose of encouraging the sale or supply of alcohol for consumption on the premises in a manner which carries a significant risk of leading or contributing to crime and disorder, prejudice to public safety, public nuisance, or harm to children -
(a) games or other activities which require or encourage, or are designed to require or
encourage, individuals to -
(i) drink a quantity of alcohol within a time limit (other than to drink alcohol sold or
supplied on the premises before the cessation of the period in which the responsible
person is authorised to sell or supply alcohol), or
(ii) drink as much alcohol as possible (whether within a time limit or otherwise);
(b) provision of unlimited or unspecified quantities of alcohol free or for a fixed or
discounted fee to the public or to a group defined by a particular characteristic (other than
any promotion or discount available to an individual in respect of alcohol for
consumption at a table meal, as defined in section 159 of the Act);
(c) provision of free or discounted alcohol or any other thing as a prize to encourage or
reward the purchase and consumption of alcohol over a period of 24 hours or less;
(d) provision of free or discounted alcohol in relation to the viewing on the premises of a
sporting event, where that provision is dependent on -
(i) the outcome of a race, competition or other event or process, or
(ii) the likelihood of anything occurring or not occurring;
(e) selling or supplying alcohol in association with promotional posters or flyers on, or in the
vicinity of, the premises which can reasonably be considered to condone, encourage or
glamorise anti-social behaviour or to refer to the effects of drunkenness in any favourable
manner.
2. The responsible person shall ensure that no alcohol is dispensed directly by one person into the mouth of another (other than where that other person is unable to drink without assistance by reason of a disability).
3. The responsible person shall ensure that free tap water is provided on request to customers where it is reasonably available.
4. (a) The premises licence holder or club premises certificate holder shall ensure that an age verification policy applies to the premises in relation to the sale or supply of alcohol.
(b) The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and a holographic mark.
5. The responsible person shall ensure that -
(a) where any of the following alcoholic drinks is sold or supplied for consumption on the
premises (other than alcoholic drinks sold or supplied having been made up in advance
ready for sale or supply in a securely closed container) it is available to customers in the
following measures -
(i) beer or cider: ½ pint;
(ii) gin, rum, vodka or whisky: 25 ml or 35 ml; and
(iii) still wine in a glass: 125 ml; and
(b) customers are made aware of the availability of these measures.
ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
The following conditions in Annex 2 are conditions consistent with the operating schedule submitted by the applicant within the application:
1. There shall be no supplies of alcohol for consumption OFF the licensed premises.
2. There shall be a thirty minute period after the last authorised supply of alcohol in order to facilitate appropriate dispersal and drinking-up time for club members and their guests.
3. The club rules and conditions (as may from time to time be modified) shall continue to apply.
4. The club management shall employ door supervisors at all times when a licensable activity is being carried out and where the club management consider them necessary to:
Prevent the admission and ensure the departure from the premises of drunk and disorderly persons, without causing further disorder;
Keep out excluded individuals (subject to court or pub watch bans)
5. No members or guests shall be admitted, or permitted to leave whilst carrying open or sealed bottles or glasses.
6. The club management shall ensure that the consumption of alcohol is restricted to the areas identified on the plan attached at Annex 4.
7. The club management shall ensure that the maximum occupancy of the licensed premises is restricted at any one time to 80 persons, or else any revised maximum safe capacity limit as agreed with the Fire Officer under the Regulatory Reform (Fire Safety) Order 2005.
8. The club management shall ensure that public information notices about crime and disorder issues are displayed at the request of the Local Authority or Police.
9. The club management shall display any restrictions on the admittance of individuals according to age (e.g. children) on or immediately outside the premises.
10. The club management shall display any conditions of entry to the premises in the vicinity of any entrance to the premises.
11. The club management shall be responsible for the disposal of waste on the frontage of the premises and make provision for the emptying of litter bins in the vicinity of the premises.
12. The club management shall ensure that lighting is provided outside the premises (and in the car park) during the hours of darkness when any licensable activity takes place on the premises. Note: It may be prudent for the club management to liaise with the local Environmental Health Officer over the specification and positioning of external lighting to minimise any potential for causing public nuisance by light pollution.
13. The club management shall ensure that:
(a) escape routes and exits, including external exits, are maintained to ensure that they are not obstructed, in good order with non-slippery and even surfaces, free of trip hazards and clearly identified;
(b) where chairs and tables are provided, internal gangways are kept unobstructed;
(c) all exit doors are easily openable and do not require the use of a key, card, code or similar means;
(d) doors at such exits are regularly checked to ensure that they function satisfactorily and a record of the check is kept;
(e) all fire doors are maintained effectively self-closing and not held open other than by approved devices (for example, electromagnetic releases operated by smoke detectors).
(f) the edges of the treads of steps and stairways are maintained so as to be conspicuous.
14. Safety checks shall be carried out before the admission of the public or club members and guests; and details of such checks shall be kept in a log-book.
15. The club management shall ensure, unless modified by any separate regulatory controls, that:
(a) hangings, curtains and temporary decorations are maintained in a flame-retardant condition;
(b) any upholstered seating meets on a continuous basis the pass criteria for smouldering ignition source 0, flaming ignition source 1 and crib ignition source 5 when tested in accordance with section 5 of BS 5852:1990;
(c) hangings, curtains and temporary decorations are arranged so as not to obstruct exits, fire safety signs or fire-fighting equipment;
(d) temporary decorations are not used without prior notification to the licensing authority/fire authority.
16. The club management shall ensure that notices detailing the action to be taken in the event of fire or other emergencies, including how the fire brigade should be summoned, are prominently displayed and protected from damage and deterioration.
17. The fire brigade shall be called at once to any outbreak of fire, however slight, and the details recorded in a fire log-book.
18. The club management shall notify the local Fire & Rescue Service as soon as possible if the water supply to any hydrant, hose reel, sprinkler, drencher or other fire extinguishing installation is cut off or restricted.
19. Access to the licensed club premises for emergency vehicles shall be kept clear and free from obstruction.
20. The club management shall ensure that when disabled people are present, adequate arrangements exist to enable their safe evacuation in the event of an emergency, and ensure that members and guests are made aware of these arrangements.
21. The club management shall ensure that an adequate and appropriate supply of first aid equipment and materials is available on the premises.
22. The club management shall ensure, unless modified by any separate regulatory controls, that:
(a) in the absence of adequate daylight lighting in any area accessible to the public is fully operational;
(b) fire safety signs are adequately illuminated;
(c) emergency lighting shall not be altered without prior notification to the Licensing Authority;
(d) emergency lighting batteries are fully charged before admission of the public;
(e) in the event of failure of normal lighting, where the emergency lighting battery has a capacity of one hour, evacuation of the premises is possible within 20 minutes;
(f) where the emergency lighting battery has a capacity of three hours, evacuation of the premises is possible within one hour.
23. The club management shall ensure that the following systems are maintained and inspected by suitably qualified professional persons in accordance with any British Standards and at intervals recommended in national guidance, and will keep the records of such inspections available for inspection by authorised officers upon request:
Building Electrical Installation
Emergency Lighting System
Fire Warning System
Gas boiler, calorifier or appliance
Oil fired boiler or appliance
Suspended ceilings
Portable fire fighting equipment
Temporary Electrical Installation
24. The club management shall ensure that that valid public liability insurance in force and that a copy of the schedule is available for inspection by an authorised officer upon request.
25. The club management shall set designate an area away from the dance floor areas as a ‘chill out’ area whilst dancing and music entertainments are taking place.
26. The club management shall assist with safe departure of members and guests by making available contact numbers of local taxi or private hire firms.
27. Sufficient seating shall be available on the licensed club premises to accommodate 80% of the maximum capacity of persons permitted on the premises.
28. The club management shall ensure that the number of members and guests on the premises at any one time is monitored and recorded.
29. Internal gangways shall be kept free from any obstruction or impediment.
30. The club management shall not use any portable heating appliances, appliances requiring the use of gas cylinders or containers, paraffin or other mineral oil in any appliance (except for cooking purposes).
31. The club management shall ensure that:
(a) doors and windows are kept closed (except for ingress and egress) to reduce noise emissions from the premises;
(b) they display prominent, clear and legible notices at all exits requesting that members and guests respect the needs of local residents and leave the premises and the area quietly;
(c) they seek guidance and approval from the Licensing Authority prior to the use of explosives, pyrotechnics and fireworks of a similar nature which could cause disturbance in surrounding areas;
(d) the placing of bottles into receptacles outside the premises takes place at times that will minimise disturbance to nearby properties;
(e) during the final hour of opening the music is discernibly quieter;
(f) any direct request by an authorised officer of the Local Authority in relation to reducing noise levels is complied with;
(g) no amplified sound (including public announcements unless they are for purposes of public safety) in connection with the event continues beyond the permitted hours of the entertainment.
(h) offensive smells from the licensed premises are not permitted so as to cause a nuisance to nearby properties and the premises are properly vented;
(i) waste receptacles are emptied and cleaned regularly in order to prevent offensive smells;
(j) waste receptacles in external areas are suitable for use and lidded;
(k) litter is regularly cleared from the vicinity of the licensed club premises.
ANNEX 3 - CONDITIONS ATTACHED AFTER A HEARING BY THE LICENSING AUTHORITY
1. The Club Management Committee shall nominate a responsible individual to supervise the premises on all occasions whilst the Club is open for licensed activities.
2. The Club Management Committee shall promptly notify the Police, the Council’s Environmental Protection Officer and the Council’s Licensing Officer of contact details for the individual as referred to in Annex 3 condition 1 above, together with other key individuals responsible for the operation of the Club premises. Any changes to key contacts, whether permanent or temporary, shall be notified to those same parties as soon as reasonably practicable. The contact details shall include the name, position, contact phone number and contact address of the relevant person and this information shall also be displayed and maintained prominently on the Club notice board outside of the entrance to the Club premises.
3. An adequate signing-in record shall be kept and maintained at the Club Premises, with such record to include the name, address and signature of members and guests.
