ANNEX 1 - MANDATORY CONDITIONS
The following conditions in Annex 1 are mandatory under the provisions of the Licensing Act 2003:
1. Alcohol shall not be sold or supplied:
(a) At any time when there is no designated premises supervisor in respect of the
premises licence, or
j. At any time when the designated premises supervisor does not hold a personal licence or his/her personal licence is suspended
2. Every sale or supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.
ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
The following conditions in Annex 2 are carried across to the new premises licence from the existing conditions and restrictions contained within existing authorisations, and regulatory enactments as specified by the Secretary of State, and as required by Schedule 8(6) of the Licensing Act 2003:
1. No person under the age of 14 shall be in the bar of the licensed premises during the permitted hours, unless one of the following applies:
(a) He is the licence-holder’s child
(b) He resides in the premises, but is not employed there
(c) He is in the bar solely for the purpose of passing to or from some part of the premises which is not a bar and to or from which there is no other convenient means of access or egress
(d) The bar is in railway refreshment rooms or other premises constructed, fitted and intended to be used bona fide for any purpose to which the holding of a premises licence is ancillary
2. Alcohol should not be sold or supplied except during the hours shown on the premises licence (Part 1) and summary of the licence. The restrictions on these authorised hours do not prohibit:
a. During the first thirty minutes after the authorised hours for supply of alcohol the consumption of alcohol on the premises;
b. during the first thirty minutes after the authorised hours, the taking of the alcohol from the premises unless the alcohol is supplied or taken in an open vessel;
c. during the first thirty minutes after the authorised hours the consumption of the alcohol on the premises by persons taking meals there if the alcohol was supplied for consumption as ancillary to the meals;
d. consumption of the alcohol on the premises or the taking of sale or supply of alcohol to any person residing in the licensed premises;
e. the ordering of alcohol to be consumed off the premises, or the despatch by the vendor of the alcohol so ordered;
f. the sale of alcohol to a trader or club for the purposes of the trade or club;
g. the sale or supply of alcohol to any canteen or mess, being a canteen in which the sale or supply of alcohol is carried out under the authority of the Secretary of State or an authorised mess of members of Her Majesty’s naval, military or air forces;
h. the taking of alcohol from the premises by a person residing there; or
i. the supply of alcohol for consumption on the premises to any private friends of a person residing there who are bona fide entertained by him at his own expense, or the consumption of alcohol by persons so supplied; or
j. the supply of alcohol for consumption on the premises to persons employed there for the purposes of the business carried on by the holder of the licence, or the consumption of liquor so supplied, if the liquor is supplied at the expense of their employer or of the person carrying on or in charge of the business on the premises.
3. Admission, including re-admission, to the licensed premises shall be prohibited after 23:00hrs, with the exception of New Years Eve which shall be midnight.
4. Any alcoholic drinks promotions shall comply with any recommendations of the Portman Group and/or the British Pub Association.
5. The licence holder shall ensure that any person selling or supplying alcoholic drink under the authority of a personal licence holder shall ask for a photo ID proof of age where they have reason to suspect that the individual may be under 18 years of age. If photo ID is not produced upon request then the individual shall not be served with an alcoholic beverage.
6. The licence holders shall attend at least one meeting of any Pubwatch meetings held during each calendar year.
7. The licence holder shall ensure that staff shall regularly collect empty glasses and bottles, and that staff shall clear away any spillages and breakages as soon as reasonably practicable.
8. The licence holder shall ensure that after 23:00hrs any recorded music being played is turned down in volume.
9. The licence holder shall ensure that patrons leaving the premises are asked by the licence holder or staff on duty to leave quietly.
10. The licence holder shall ensure that any litter is regularly cleared away from the immediate vicinity of the premises.
11. Any children’s play equipment in external areas of the premises shall be maintained in a condition fit for its intended purpose, and any manufacturers recommendations shall be complied with.
ANNEX 3 - CONDITIONS ATTACHED AFTER A HEARING BY THE LICENSING AUTHORITY
1. Any equipment used for ‘recorded music’ entertainments shall be under the direct control of either the designated premises supervisor or the licence holder, or member of staff nominated by the designated premises supervisor or licence holder, on all occasions.
2. Use of external areas of the premises used for the consumption of alcohol shall be limited to 11:30pm on all occasions, which includes a period of 30 minutes from 11:00pm to allow for appropriate dispersal and drinking-up time.
