ANNEX 1 - MANDATORY CONDITIONS
The following conditions in Annex 1 are mandatory under the provisions of the Licensing Act 2003:
1. Alcohol shall not be sold or supplied:
(a) At any time when there is no designated premises supervisor in respect of the
premises licence, or
(b) At any time when the designated premises supervisor does not hold a personal licence or his/her personal licence is suspended
2. Every sale or supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.
3. Where one or more individuals are being used at the licensed premises to carry out a security activity, each such individual must be licensed by the Security Industry Authority.
4. The admission of children to the exhibition of any film shall be restricted in accordance with the film classification awarded by the British Board of Film Classification (BBFC), or any successor person or persons designated as the authority under section 4 of the Video Recordings Act 1984.
ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
The following conditions in Annex 2 are conditions consistent with the operating schedule submitted by the applicant within the application. These will include, where required, existing expressed conditions and embedded restrictions contained within existing authorisations and enactments as specified by the Secretary of State, in accordance with Schedule 8(6) of the Licensing Act 2003:
1. The licence holder shall participate in a local Pubwatch scheme (or similar) where such a scheme operates within the locality of the licensed premises.
2. Plastic or toughened glasses shall be used during televised football matches when there are a large number of customers on the premises.
3. Doors and windows shall be kept closed during any music entertainment (save for access and egress) wherever this is practicable.
4. Signage shall be displayed and maintained on the licensed premises requesting that customers leave quietly.
5. Litter on the premises and in the immediate vicinity of the licensed premises shall be regularly cleared.
6. Children shall not be allowed on the licensed premises.
7. Glasses shall be regularly collected on the licensed premises to reduce the potential for spillages and breakages.
8. The appended Public Entertainments Licence conditions, terms and restrictions (including any limitations on permitted capacity) will continue to apply to the Premises Licence unless where these conditions are overridden by the authorisations of the Premises Licence (for example concerning hours authorised for licensable activities), or by the provisions of the Licensing Act 2003 or other statutory modifications.
9. CCTV shall be operated at the licensed premises, and tapes shall be retained for a minimum of 28 days.
10. The volume control of any amplification equipment being used on the licensed premises shall be under the direct control of the designated premises supervisor (DPS), or another responsible individual nominated by the DPS, on all occasions. At the direct request of an authorised officer of the Local Authority or Suffolk Constabulary the volume shall be turned down.
11. A Challenge 25 policy will be implemented requiring all customers who appear to be under the age of 25 to produce photographic identification in the form of a passport, driving licence or proof of age scheme (PASS) approved identification, before alcohol can be supplied or sold to them. All staff will be instructed, through training, that alcohol cannot be supplied or sold unless valid identification is produced. The premises licence holder shall ensure that notices are prominently displayed in the premises to advise patrons and staff that a ‘Challenge 25’ scheme operates in the premises.
12. All staff engaged in the sale of alcohol will be trained in Responsible Alcohol Retailing on commencing employment at the premises. This training can be administered in-house by the DPS. Training records shall be kept on the premises and produced to the Police/Local Authority on request. Training will be reviewed every 6 months to ensure that staff are up to date with the latest legislation and their training records endorsed accordingly. All staff will be made aware of the licence holder’s banning policy and zero tolerance to drugs on the premises, during both initial and refresher training.
13. A log will be kept at the premises, recording any significant incidents or any refusal of the sale of alcohol. It will be made available to an authorised officer of the Police or Council on request. It must be completed within 24 hours of the occurrence and must record: a) the date and time of the incident or refusal, b) names of staff and persons involved (if known), c) detail of incident or refusal. Incidents to be recorded should include (but not be limited to) any crime or disorder, injuries to staff or customers, refusal of the sale of alcohol, ejections, banning of customers, seizures of drugs/weapons, or any visit by relevant authorities or emergency services, and the purpose of the visit.
14. A CCTV recording system shall be installed and maintained. CCTV shall cover all areas of the premises open to the public, including entry and exit points, and must be capable of providing images of quality sufficient to support facial identification. The system must always operate during hours of licensable activity and/or when customers are on the premises. Equipment must be maintained in good working order, be correctly time and date stamped, and recordings must be kept for a period of 28 days. The Premises Licence Holder must ensure that a DPS or appointed member of staff able to operate the CCTV system, is always present when the premises are open to the public. That person will show any video to Police or an Authorised Officer with minimum delay when requested. A download of CCTV video in a viewable format on disc or storage device will be provided to the Police or an Authorised Officer as soon as possible, and in any case within 36 hours of the request. The CCTV system will be regularly checked to ensure that it is functioning correctly.
15. No illegal drugs will be permitted on the premises and notices to this effect shall be displayed at key locations within the licensable area. Signs advising that CCTV is in operation will also be displayed within the premises.
16. The licence holder will document a Banning and Ejection policy. This will include sanctions for customers who are found or suspected to be in possession of illegal drugs or found or suspected to be drug dealing. Where a customer is suspected of drug dealing on the premises, the Police will be informed, and any CCTV evidence will be retained.
17. While the premises is open for licensable activities, toilet areas will be checked regularly for signs of drug taking and customer welfare. Notices will be displayed in the toilets warning that drugs will not be tolerated, and that customers could be banned if found in possession of illegal substances. A toilet check record will be accurately and legibly signed by the member of staff conducting the check.
18. Management and staff will support the Police to obtain random drug swabs from surfaces within the premises for analysis, to identify illegal drugs use. Details of the concentrations of drugs found will be given to the licence holder, to further support them in upholding the Prevention of Crime and Disorder Licensing Objective.
ANNEX 3 - CONDITIONS ATTACHED AFTER A HEARING BY THE LICENSING AUTHORITY
