ANNEX 1 - MANDATORY CONDITIONS
The following conditions in Annex 1 are mandatory under the provisions of the Licensing Act 2003:
1.1 Alcohol shall not be sold or supplied:
(a) At any time when there is no designated premises supervisor in respect of the
premises licence, or
(b) At any time when the designated premises supervisor does not hold a personal licence or his/her personal licence is suspended
1.2 Every sale or supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.
1.3 Where one or more individuals are being used at the licensed premises to carry out a security activity, each such individual must be licensed by the Security Industry Authority (unless where the individual is exempt from obtaining an SIA registration under the Private Security Industry Act 2001).
1.4 The admission of children to the exhibition of any film shall be restricted in accordance with the film classification awarded by the British Board of Film Classification (BBFC), or any successor person or persons designated as the authority under section 4 of the Video Recordings Act 1984.
1.5 The responsible person shall take all reasonable steps to ensure that staff on relevant premises do not carry out, arrange or participate in any irresponsible promotions in relation to the premises.
In this paragraph, an irresponsible promotion means any one or more of the following activities, or substantially similar activities, carried on for the purpose of encouraging the sale or supply of alcohol for consumption on the premises in a manner which carries a significant risk of leading or contributing to crime and disorder, prejudice to public safety, public nuisance, or harm to children -
(a) games or other activities which require or encourage, or are designed to require or
encourage, individuals to -
(i) drink a quantity of alcohol within a time limit (other than to drink alcohol sold or
supplied on the premises before the cessation of the period in which the responsible
person is authorised to sell or supply alcohol), or
(ii) drink as much alcohol as possible (whether within a time limit or otherwise);
(b) provision of unlimited or unspecified quantities of alcohol free or for a fixed or
discounted fee to the public or to a group defined by a particular characteristic (other than
any promotion or discount available to an individual in respect of alcohol for
consumption at a table meal, as defined in section 159 of the Act);
(c) provision of free or discounted alcohol or any other thing as a prize to encourage or
reward the purchase and consumption of alcohol over a period of 24 hours or less;
(d) provision of free or discounted alcohol in relation to the viewing on the premises of a
sporting event, where that provision is dependent on -
(i) the outcome of a race, competition or other event or process, or
(ii) the likelihood of anything occurring or not occurring;
(e) selling or supplying alcohol in association with promotional posters or flyers on, or in the
vicinity of, the premises which can reasonably be considered to condone, encourage or
glamorise anti-social behaviour or to refer to the effects of drunkenness in any favourable
manner.
1.6 The responsible person shall ensure that no alcohol is dispensed directly by one person into the mouth of another (other than where that other person is unable to drink without assistance by reason of a disability).
1.7 The responsible person shall ensure that free tap water is provided on request to customers where it is reasonably available.
ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
The following conditions in Annex 2 are conditions consistent with the operating schedule submitted by the applicant within the application:
1. All performers and members of staff working with children and vulnerable persons, for example children’s workshops, shall be adequately vetted, to include Criminal Records Bureau (CRB) checking. All childrens' entertainers must produce their CRB certificates to the event organisers/licence holders for inspection before they are permitted to perform.
2. There shall be no events or activities at the event involving hypnotism.
3. All sales of alcohol shall take place from the clubhouse only. There shall be no alcohol sold, supplied or consumed in other areas of the site beyond the perimeter of the clubhouse.
4. There shall be adequate numbers of trained club staff involved with the sale and supply of alcohol under the supervision of Rolf Beggerow, Ken Ramsey and Donna Ramsey from Hadleigh United FC.
5. Plastic/polycarbonate containers shall be used for the consumption of alcohol. Glasses or bottles shall not be permitted to be taken into outdoor areas of the site.
6. Attendees shall not be permitted to bring their own alcohol on site, and stewards/security staff shall take all reasonable steps to enforce this requirement.
7. There shall be no camping provision made or allowed for members of the public. Camping facilities shall be for stallholders/exhibitors/performers/club members and guests only.
8. There shall be no camp-fires permitted on site at any time for the duration of the event. The only fire permitted on site shall be as part of the closing ceremony from 17:00hrs on Sunday 29th August 2010. The event organisers shall liaise with Suffolk Fire and Rescue Service to ensure that adequate fire safety measures are in place, including containment/barriers and safe exclusion zone, to ensure public safety. The ceremony shall not include any fire-blowing or fire-throwing.
9. All attendees to the event shall be ticketed at the point of entry and the event organisers shall monitor the number of persons on site, including staff, stewards and performers, at any one time. The event organisers shall ensure that attendees are counted by clicker or other reliable means, and that the site perimeter is adequately secured.
10. The event organisers/licence holders shall ensure that the maximum safe capacity for the site shall not be exceeded and in the event of excess attendees they shall not be permitted entry until on site attendance has diminished sufficiently.
11. The live Public Address (PA) system shall not operate beyond 19:00hrs, unless required to ensure public safety or for other reasonable urgent/emergency situation.
12. There shall be no lasers, pyrotechnics/fireworks, strobe lighting or smoke machines used during any part of the event.
13. CCTV shall be operated on the site, as already provided by Hadleigh United Football Club. Note: It is recommended that recordings be retained for a minimum of 28 days after the conclusion of the event.
14. Stewards/security staff on site shall supervise and control a safe and orderly departure of attendees from the event.
15. There shall be no events, activities or performances involving any full or partial nudity.
16. There shall be no activities involving child performers at the event.
17. Exhibitor parking shall be at the Football Club, with attendees being able to park in Holbecks Park, with both parking areas supervised by stewards throughout the duration of the event.
18. Site security shall be managed by a mix of 4 (four) SIA trained security guards and 10 (ten) supporting stewards making a total of 14 (fourteen). It should be noted that it is a mandatory condition of licence that any person engaged in a security activity must be SIA registered (see mandatory condition 1.3 and Section 21 of the Licensing Act 2003).
19. Security and stewards shall maintain an adequate radio circuit contact system, and wear hi-visibility clothing or other readily identifiable means of recognition.
20. All stewards shall be adequately trained in emergency evacuation procedures, and shall operate under the authority of the security staff.
21. Any disruptive/nuisance issues on site shall be dealt with promptly by security/event team members depending on type of disruption.
22. Traffic on and off the site shall be adequately managed and marshalled by stewards/security.
23. There shall be 3 blocks of 6 portable toilets (18 in total), in addition to the toilet facilities in the club house and in the changing areas.
24. Adequate first aid facilities shall be maintained on site, including those available via the club house.
25. The camping area shall be adequately barriered and supervised to minimise the potential of crime or disorder. The maximum number of campers shall be confirmed in advance of the event (no public permitted).
26. Adequate first aid/ambulance provision shall be in place for the duration of the event.
27. Concert: The orientation of the band should be facing towards the South West of the site (away from residential properties in Benton Street and Tinkers Lane). The Concert shall cease by 19:00 hours.
28. Drumming workshop: This shall be low level drumming and all drumming shall be carried out by a band member. These shall run between 11:30-12:00 and 15:30-16:00 only on each day. This shall be carried out within a marquee only and not in the open air.
29. Buskers: All shall be acoustic only. Buskers shall be kept to the South West area of the site to maximise distance from residential properties and operate between 10:30hrs-12:30hrs and 14:00hrs-17:00hrs only.
30. Belly dancing: This shall not be broadcast over the PA system and the stereo speakers should be orientated towards the South West of the site.
31. DJ workshop: The speakers should be orientated towards the South West of the site, away from residential premises.
32. Scruffts Dog Show: No music shall be broadcast over the PA system as part of this activity.
33. Overall: All music (acoustic and amplified) and amplified speech shall be performed at the minimum intensity for the enjoyment of the audience in order to minimise disturbance to nearby residential properties.
34. A designated person(s) shall be on site for the duration of the festival and be available to control all music and amplified speech sound levels at the request of Environmental Health Officers. During operating hours, the Designated Person(s) shall be available to receive and respond to nuisance related complaints. A contact number shall be readily available for that purpose. No other form of music (amplified or acoustic) or amplified speech is to be added other than what that which has been agreed with the Environmental Health Officers.
35. The applicants shall comply with the health and safety and fire safety advice as agreed with the Environmental Health Officer and Fire Safety Officer. The event safety management plan should be retained on site and as agreed.
ANNEX 3 - CONDITIONS ATTACHED AFTER A HEARING BY THE LICENSING AUTHORITY
Not applicable.
