ANNEX 1 - MANDATORY CONDITIONS
The following conditions in Annex 1 are mandatory under the provisions of the Licensing Act 2003:
1. Alcohol shall not be sold or supplied:
(a) At any time when there is no designated premises supervisor in respect of the
premises licence, or
(b) At any time when the designated premises supervisor does not hold a personal licence or his/her personal licence is suspended
2. Every sale or supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.
3. Where one or more individuals are being used at the licensed premises to carry out a security activity, each such individual must be licensed by the Security Industry Authority.
ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
The following conditions in Annex 2 are conditions consistent with the operating schedule submitted by the applicant within the application. These will include, where required, existing expressed conditions and embedded restrictions contained within existing authorisations and enactments as specified by the Secretary of State, in accordance with Schedule 8(6) of the Licensing Act 2003:
1. Alcohol shall not be sold or supplied except during permitted hours. In this condition, permitted hours means:
a. On weekdays (Monday to Saturday), other than Christmas Day, Good Friday or New Year’s Eve, 10:00hrs until 23:00hrs
b On Sundays, other than Christmas Day or New Year’s Eve, 12:00hrs midday to 22:30hrs
c. On Good Friday, 12:00hrs midday to 22:30hrs
d. On Christmas Day, 12:00hrs midday to 15:00hrs and 19:00hrs until 22:30hrs
e. On New Year’s Eve, except on a Sunday, 10:00hrs until 23:00hrs
f. On New Year’s Eve on a Sunday, 12:00hrs midday to 22:30hrs
g. On New Year’s Eve from the end of permitted hours on New Year’s Eve to the start of
permitted hours on the following day (or, if there are no permitted hours on the following day, midnight on 31 December).
The above restrictions do not prohibit:
a. during the first twenty minutes after the above hours the consumption of alcohol on the premises;
b. during the first thirty minutes after the above hours the consumption of the alcohol on the premises by persons taking meals there if the alcohol was supplied for consumption as ancillary to the meals;
d. consumption of the alcohol on the premises or the taking of sale or supply of alcohol to any person residing in the licensed premises;
f. the sale of alcohol to a trader or club for the purposes of the trade or club;
g. the sale or supply of alcohol to any canteen or mess, being a canteen in which the sale or supply of alcohol is carried out under the authority of the Secretary of State or an authorised mess of members of Her Majesty’s naval, military or air forces;
h. the taking of alcohol from the premises by a person residing there; or
i. the supply of alcohol for consumption on the premises to any private friends of a person residing there who are bona fide entertained by him at his own expense, or the consumption of alcohol by persons so supplied; or
j. the supply of alcohol for consumption on the premises to persons employed there for the purposes of the business carried on by the holder of the licence, or the consumption of liquor so supplied, if the liquor is supplied at the expense of their employer or of the person carrying on or in charge of the business on the premises.
2. Alcohol may be sold or supplied for one hour following the hours set out in Annex 2 (1) and on Christmas Day between 15:00hrs and 19:00hrs to persons taking table meals in the premises in a part of the premises [ground floor] usually set apart for the service of such persons and for consumption by such a person in that part of the premises as an ancillary to his meal. For other purposes or in other parts of the premises the hour set out in Annex 2 (1) shall continue to apply.
3. The premises shall be structurally adapted and bona fide used (intended to be used) for the purpose of habitually providing, for the accommodation of persons frequenting the premises, substantial refreshment to which the sale and supply of alcohol is ancillary.
4. There shall be no supply of alcohol for consumption OFF the licensed premises.
5. The premises licence is restricted to the sale of alcohol:
(a) so far as the club lounge (coloured blue on the plan attached at Annex 4) the members and guests of Masonic Lodges regularly meeting at the Hall and visiting members of other Masonic Lodges under the jurisdiction of the Grand Lodge of England.
(b) so far as the club lounge (coloured yellow on the plan attached at Annex 4) (i) all persons bona fide attending social and other functions held in the banqueting suite at the Hall which has been hired for the occasion by outside persons or organisations (ii) members and guests of Masonic Lodges regularly meeting at the Hall and visiting members of other Masonic Lodges under the jurisdiction of the Grand Lodge of England.
6. No person under 14 shall be in the bar of the licensed premises during the permitted hours unless one of the following applies:
He/she is the child of the holder of the premises licence.
He/she resides in the premises, but is not employed there.
He/she is in the bar solely for the purpose of passing to or from some part of the premises which is not a bar and to or from which there is no other convenient means of access or egress.
The bar is in railway refreshment rooms or other premises constructed, fitted and intended to be used bona fide for any purpose to which the holding of the licence is ancillary.
In this condition “bar” includes any place exclusively or mainly used for the consumption of alcohol. But an area is not a bar when it is usual for it to be, and it is, set apart for the service of table meals and alcohol is only sold or supplied to persons as an ancillary to their table meals.
