ANNEX 1 - MANDATORY CONDITIONS
The following conditions in Annex 1 are mandatory under the provisions of the Licensing Act 2003:
1. Alcohol shall not be sold or supplied:
(a) At any time when there is no designated premises supervisor in respect of the premises licence, or
(b) At any time when the designated premises supervisor does not hold a personal licence or his/her personal licence is suspended
2. Every sale or supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.
3. The admission of children to the exhibition of any film shall be restricted in accordance with the film classification awarded by the British Board of Film Classification (BBFC), or any successor person or persons designated as the authority under section 4 of the Video Recordings Act 1984.
ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
The following conditions in Annex 2 are conditions consistent with the operating schedule submitted by the applicant within the application:
1. Music activities in outdoor areas of the licensed premises shall, on all occasions, cease by 23:00hrs.
2. The licence holder shall ensure that strong management and supervisory controls and adequate training for members of staff are put in place. Such training shall in particular cover promotion of the licensing objectives and raising awareness of licensing offences - including prohibition on underage drinking, drunkenness on the premises and in public, use of drugs or controlled substances, violent and antisocial behaviour and the need to protect children from harm.
3. The licence holders shall adopt best practice guidance, for example Portman Group guidelines on alcoholic drinks strategy, wherever it is practicable to do so.
4. The licence holder shall promote a ‘designated driver scheme’ at the licensed premises to help minimise the risk of drink-driving.
5. The licence holder, or their nominated representative, shall participate in any local Pubwatch scheme (or similar) where such a scheme operates within the locality of the licensed premises.
6. Plastic or toughened drinking vessels shall be used for beer festivals taking place in external areas of the licensed premises.
7. An adequate CCTV system shall be installed and maintained on the licensed premises.
8. Litter bins shall be provided and litter shall be collected and managed.
9. There shall be a risk management assessment check on at least one occasion every week.
10. There shall be adequate provision of general staffing on the premises to ensure security of the premises and the safety of customers whilst they are on the premises.
11. There shall be regular testing, and certification where appropriate, of all procedures, applicances and systems pertinent to safety.
12. There shall be regular supervisory checks made by staff on duty to any part of the premises accessible to customers, including the patio and external areas, in order to minimise the risk of public nuisance.
13. There shall be no irresponsible drinks promotions at the licensed premises.
14. Customer arrival and departure shall be adequately managed by staff on duty at the licensed premises.
15. External lighting and security lighting shall be installed and maintained at the licensed premises. (Note: It may be prudent for the licence-holder to liaise with the local Environmental Health Office to ensure that any lighting does not cause public nuisance).
16. An effective ventilation system shall be installed and maintained at the licensed premises in order to minimise the potential for public nuisance caused by odour.
17. A ‘Due Diligence Log’ shall be completed every time regulated entertainment activities take place at the licensed premises, including checking of external areas.
18. Training shall be given to members of staff on the ‘protection of children from harm’ licensing objective and this shall be recorded. Staffing levels at the licensed premises shall be adequate to secure this objective.
19. Children under the age of 16 years old shall not be permitted in bar areas of the licensed premises after 21:00hrs or during any regulated entertainment activities.
20. A proof of age scheme / request for photographic identity documents shall be operated to assist in the prevention of underage sales.
21. Children present in the dining area of the licensed premises must be supervised by a responsible adult at all times, and staff shall supervise these areas whilst children are present.
22. A refusals register shall be operated and kept at the licensed premises.
