\pard\ltrpar\keepn\s3\ul\b\fs24\par \pard\ltrpar\li-1276 ANNEX 1 - MANDATORY CONDITIONS\ulnone\b0\f2\par \pard\ltrpar\keepn\li-1276\f0\fs20 The following conditions in Annex 1 are mandatory under the provisions of the Licensing Act 2003:\par \pard\ltrpar\f2\par \pard\ltrpar\fi-709\li-567\ri-766\qj\f0\fs22 1.1\tab Alcohol shall not be sold or supplied:\par \pard\ltrpar\li-1276\ri-766\qj\par \pard\ltrpar\li-567\ri-766\qj (a) \tab At any time when there is no designated premises supervisor in respect of the\par \tab premises licence, or\par \par \pard\ltrpar\fi-567\ri-766\qj (b)\tab At any time when the designated premises supervisor does not hold a personal licence or his/her personal licence is suspended\par \pard\ltrpar\ri-766\qj\par \pard\ltrpar\fi-709\li-567\ri-766\qj 1.2\tab Every sale or supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.\par \par 1.3\tab Where one or more individuals are being used at the licensed premises to carry out a security activity, each such individual must be licensed by the Security Industry Authority (unless where the individual is exempt from obtaining an SIA registration under the Private Security Industry Act 2001).\par \par 1.4\tab The responsible person must ensure that staff on relevant premises do not carry out, arrange or participate in any irresponsible promotions in relation to the premises.\par \pard\ltrpar\fi-570\li3\qj\par \pard\ltrpar\li3\qj In this paragraph, an irresponsible promotion means any one or more of the following activities, or substantially similar activities, carried on for the purpose of encouraging the sale or supply of alcohol for consumption on the premises -\par \pard\ltrpar\li-567\qj\par \pard\ltrpar\li3\qj (a) games or other activities which require or encourage, or are designed to require or encourage, individuals to -\par \par \pard\ltrpar\li720\qj (i) drink a quantity of alcohol within a time limit (other than to drink alcohol sold or supplied on the premises before the cessation of the period in which the responsible person is authorised to sell or supply alcohol), or\par (ii) drink as much alcohol as possible (whether within a time limit or otherwise);\par \pard\ltrpar\fi1287\li-567\qj\par \pard\ltrpar\qj (b) provision of unlimited or unspecified quantities of alcohol free or for a fixed or discounted fee to the public or to a group defined by a particular characteristic in a manner which carries a significant risk of undermining a licensing objective;\par \par (c) provision of free or discounted alcohol or any other thing as a prize to encourage\tab or reward the purchase and consumption of alcohol over a period of 24 hours or less in a manner which carries a significant risk of undermining a licensing objective;\par \par (d) selling or supplying alcohol in association with promotional posters or flyers on, or in the vicinity of, the premises which can reasonably be considered to condone, encourage or glamorise anti-social behaviour or to refer to the effects of\tab drunkenness in any favourable manner; \par \par (e) dispensing alcohol directly by one person into the mouth of another (other than where that other person is unable to drink without assistance by reason of disability).\par \par \pard\ltrpar\fi-709\li-567\qj 1.5\tab The responsible person must ensure that free potable water is provided on request to customers where it is reasonably available.\par \par 1.6\tab (a) The premises licence holder or club premises certificate holder must ensure that an age verification policy is adopted in respect of the premises in relation to the sale or supply of alcohol.\par \par \pard\ltrpar\li-567\qj (b) The designated premises supervisor in relation to the premises licence must ensure that the supply of alcohol at the premises is carried on in accordance with the age verification policy.\par \par (c) The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request,\par \pard\ltrpar\fi567\li-567\qj before being served alcohol, identification bearing their photograph, date of birth and\par either -\par \pard\ltrpar\fi1287\li873\qj (i) a holographic mark, or\par (ii) an ultraviolet feature.\par \par \pard\ltrpar\fi-709\li-567\ri-766\qj 1.7\tab The responsible person must ensure that -\par \pard\ltrpar\li-567\ri-766\qj\par (a) where any of the following alcoholic drinks is sold or supplied for consumption on the premises (other than alcoholic drinks sold or supplied having been made up in advance ready for sale or supply in a securely closed container) it is available to customers in the following measures -\par \pard\ltrpar\fi567\li720\ri-766\qj\par \pard\ltrpar\fi567\li153\ri-766\qj (i) beer or cider: \'bd pint;\par (ii) gin, rum, vodka or whisky: 25 ml or 35 ml; and\par (iii) still wine in a glass: 125 ml;\par \par \pard\ltrpar\li-567\ri-766\qj (b) these measures are displayed in a menu, price list or other printed material which is available to customers on the premises; and \par \par (c) where a customer does not in relation to a sale of alcohol specify the quantity of alcohol to be sold, the customer is made aware that these measures are available.\par \fs20\par \pard\ltrpar\fi-709\li-567\ri-766\qj\fs22 1.8\tab\lang1033 The relevant person (the holder of the premises licence, the designated premises supervisor (if any) in respect of such a licence, the personal licence holder who makes or authorises a supply of alcohol under such a licence, or any member or officer of a club present on the premises in a capacity which enables the member or officer to prevent the supply in question) shall ensure that no alcohol is sold or supplied for consumption on or off the premises for a price which is less than the permitted price. \lang2057\par \pard\ltrpar\fi-425\li-142\ri-766\qj\lang1033\par \pard\ltrpar\li-567\ri-766\qj For the purposes of this condition \ldblquote duty\rdblquote is to be construed in accordance with the Alcoholic Liquor Duties Act 1979, \ldblquote permitted price\rdblquote is the price found by applying the formula -\par \pard\ltrpar\li-142\ri-766\qj\par \i\tab\tab\tab\tab\tab\b P = D + (D x V)\par \pard\ltrpar\fi-425\li-142\ri-766\qj\b0\i0 \par \pard\ltrpar\li-567\ri-766\qj where - (i) \b P\b0 is the permitted price, (ii) \b D\b0 is the rate of duty chargeable in relation to the alcohol as if the duty were charged on the date of the sale or supply of the alcohol, and (iii)\par \b V\b0 is the rate of value added tax chargeable in relation to the alcohol as if the value added tax were charged on the date of the sale or supply of the alcohol; \par [\ldblquote value added tax\rdblquote means value added tax charged in accordance with the Value Added Tax Act 1994]\par \pard\ltrpar\li-1276\lang2057\ul\b\par \fs24 ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE\ulnone\b0\f2\par \pard\ltrpar\keepn\s1\li-1276\ri-766\qj\i\f0\fs20 The following conditions in Annex 2 are conditions consistent with the operating schedule submitted by the applicant within the application:\par \pard\ltrpar\ri-766\i0\f2\par \pard\ltrpar\li-567\ri-766\qj\f0\par \pard\ltrpar\fi-709\li-567\ri-766\qj\fs22 2.1\tab Premises licence BPL0426 shall be for the Sudbury Carnival (as may be re-named/re-branded) and for no other purpose. \par \par 2.2\tab Premises Licence BPL0426 is limited to take effect on not more than 2 (two) consecutive days per calendar annum (which will be a Saturday and Sunday) in August for the dates of the Sudbury Carnival.\par \par 2.3\tab The premises licence holder shall, for each year of the event, create and implement an Event Management Plan (EMP) to promote the licensing objectives. A final version of the EMP shall be sent by the licence holder to all responsible authorities no later than 14 (fourteen) days prior to the first day of the event. Any proposed revisions to the EMP shall be notified in writing to the relevant responsible authority before the master EMP is updated. A copy of the EMP and any linked documentation shall be kept at the Event Control and the content shall include:\par \pard\ltrpar\sl220\slmult0\par (a)\tab Site plan with grid overlay to assist in the event of an emergency\par (b)\tab Event traffic plan\par (c)\tab Signage plan\par (d)\tab Site rules\par \pard\ltrpar\fi-709\li709\sl220\slmult0 (e)\tab Event entry/crowd and spectator safety methodology (including arena set-up and route management)\par \pard\ltrpar\sl220\slmult0 (f)\tab Event management organisational structure\par (g)\tab Event schedule/programme\par (h)\tab Communication channels (e.g. radio allocation/landline/mobiles)\par (i)\tab Communications to local residents\par (j)\tab Medical risk assessments and provision\par (k)\tab Public directions to the site\par \pard\ltrpar\fi-709\li709\sl220\slmult0 (l)\tab Risk assessment methodology (including insurance checks of floats and drivers and public liability insurance checks) and fore safety risk assessment\par (m)\tab Steward/marshalling coverage and contact details (including accreditation where appropriate)\par \pard\ltrpar\sl220\slmult0 (n)\tab Security cover arrangements/provider details\par (o)\tab Noise control plan\par (p)\tab Roles and responsibilities\par \pard\ltrpar\fi-709\li709\sl220\slmult0 (q) Alcohol outlet management (e.g. training/briefing for sellers/staff)\par (r)\tab Lost children policy and collection point\par \pard\ltrpar\li-567\ri-766\qj\f2\fs20\par \pard\ltrpar\fi-567\li-709\ri-766\qj\f0\fs22 2.4\tab There shall be no adult entertainment or services, activities, other entertainment or matters ancillary to the use of the premises that may give rise to concern in respect of children.\par \pard\ltrpar\li-1276\ri-766\qj\par \par \pard\ltrpar\li-1276\ul\b ANNEX 3 - CONDITIONS ATTACHED AFTER A HEARING BY THE LICENSING AUTHORITY\ulnone\b0\f2\par \pard\ltrpar\ri-766\qj\f0\par \pard\ltrpar\li-1276\ri-766\qj Not applicable\par \pard\ltrpar\ri-766\f2\fs20\par \par \pard\ltrpar\li-1276\ri-766\ul\b\f0\fs22 ANNEX 4 - PLANS\par \par \pard\ltrpar\li-1276\ri-766\qj\ulnone\b0 More detailed plans/siteplan for specific licensable events shall be submitted annually as part of the Event Management Plan requirements (see condition Annex 2 condition 2.3).
