ANNEX 1 - MANDATORY CONDITIONS
The following conditions in Annex 1 are mandatory under the provisions of the Licensing Act 2003:
1. Alcohol shall not be sold or supplied:
(a) At any time when there is no designated premises supervisor in respect of the
premises licence, or
(b) At any time when the designated premises supervisor does not hold a personal licence or his/her personal licence is suspended
2. Every sale or supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.
ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
The following conditions in Annex 2 are conditions consistent with the operating schedule submitted by the applicant within the application. These will include, where required, existing expressed conditions and embedded restrictions contained within existing authorisations and enactments as specified by the Secretary of State, in accordance with Schedule 8(6) of the Licensing Act 2003:
1. No person under the age of 14 shall be in the bar of the licensed premises during the permitted hours, unless one of the following applies:
(a) He/she is the child of the holder of the premises licence.
(b) He/she resides in the premises, but is not employed there.
(c) He/she is in the bar solely for the purpose of passing to or from some part of the premises which is not a bar and to or from which there is no other convenient means of access or egress.
(d) The bar is in premises constructed, fitted and intended to be used bona fide for any purpose to which the holding of the licence is ancillary.
(e) He/she is in an area where meals and non-alcoholic beverages are available for sale for consumption in that area.
(f) He/she is in the company of a person aged 18 or over.
(g) He/she is there:
- prior to 21:00hrs or
- between 21:00hrs and 21:30hrs where he/she or the said person is consuming a meal purchased before 21:00hrs
1. External and emergency lighting shall be installed on the licensed premises. (Note: It may be prudent for the licence-holder to liaise with the local Environmental Health Officer to ensure that any lighting used minimises the risk of public nuisance).
2. Escape routes and exits shall be clearly identified and kept free from obstruction.
3. The premises management shall participate in any local Pubwatch scheme (or similar) where this is available in the locality of the licensed premises.
4. Children shall not be permitted on the licensed premises unless they are accompanied by a responsible adult.
5. The premises management shall maintain an up to date accident and incident book.
6. All external windows and doors shall be kept closed (save for access and egress) during any performance of amplified music, with the exception of any background or incidental music. Where the licence-holder considers it necessary, appropriate air-conditioning may be installed on the licensed premises.
7. The premises management shall ensure that customer departure is supervised by any staff on duty.
8. Signage should be displayed and maintained on the licensed premises requesting that patrons leave the area quietly.
9. Use of external areas for the consumption of alcohol shall be limited to 23:30hrs on all occasions.
