ANNEX 1 - MANDATORY CONDITIONS
The following conditions in Annex 1 are mandatory under the provisions of the Licensing Act 2003:
1.1 Alcohol shall not be sold or supplied:
(a) At any time when there is no designated premises supervisor in respect of the
premises licence, or
(b) At any time when the designated premises supervisor does not hold a personal licence or his/her personal licence is suspended
1.2 Every sale or supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.
1.3 Where one or more individuals are being used at the licensed premises to carry out a security activity, each such individual must be licensed by the Security Industry Authority (unless where the individual is exempt from obtaining an SIA registration under the Private Security Industry Act 2001).
1.4 The responsible person shall take all reasonable steps to ensure that staff on relevant premises do not carry out, arrange or participate in any irresponsible promotions in relation to the premises.
In this paragraph, an irresponsible promotion means any one or more of the following activities, or substantially similar activities, carried on for the purpose of encouraging the sale or supply of alcohol for consumption on the premises in a manner which carries a significant risk of leading or contributing to crime and disorder, prejudice to public safety, public nuisance, or harm to children -
(a) games or other activities which require or encourage, or are designed to require or
encourage, individuals to -
(i) drink a quantity of alcohol within a time limit (other than to drink alcohol sold or
supplied on the premises before the cessation of the period in which the responsible
person is authorised to sell or supply alcohol), or
(ii) drink as much alcohol as possible (whether within a time limit or otherwise);
(b) provision of unlimited or unspecified quantities of alcohol free or for a fixed or
discounted fee to the public or to a group defined by a particular characteristic (other than
any promotion or discount available to an individual in respect of alcohol for
consumption at a table meal, as defined in section 159 of the Act);
(c) provision of free or discounted alcohol or any other thing as a prize to encourage or
reward the purchase and consumption of alcohol over a period of 24 hours or less;
(d) provision of free or discounted alcohol in relation to the viewing on the premises of a
sporting event, where that provision is dependent on -
(i) the outcome of a race, competition or other event or process, or
(ii) the likelihood of anything occurring or not occurring;
(e) selling or supplying alcohol in association with promotional posters or flyers on, or in the
vicinity of, the premises which can reasonably be considered to condone, encourage or
glamorise anti-social behaviour or to refer to the effects of drunkenness in any favourable
manner.
1.5 The responsible person shall ensure that no alcohol is dispensed directly by one person into the mouth of another (other than where that other person is unable to drink without assistance by reason of a disability).
1.6 The responsible person shall ensure that free tap water is provided on request to customers where it is reasonably available.
ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
The following conditions in Annex 2 are conditions consistent with the operating schedule submitted by the applicant within the application:
1. Children shall not be permitted access to the licensed premises unless accompanied by an adult.
2. There shall be no adult entertainment or services, activities, other entertainment or matters ancillary to the use of the premises that may give rise to concern in respect of children.
3. The licence holder shall ensure that the event is organised by persons with experience commensurate to the nature and scale of the event, in order to ensure that at all times for the duration of the event it is managed in accordance with promotion of the licensing objectives;
4. The event shall be ticket only;
5. Adequate numbers of stewards and Police shall be in attendance for the duration of the event. The licence holder should agree sufficient levels of security, stewarding and Policing with Suffolk Constabulary;
6. Risk assessments shall be made available upon request to responsible authorities prior to, and during, the commencement of the event;
7. St.John’s Ambulance Service shall be on site for the duration of the event;
8. The licence holder shall ensure that a sufficient public liability insurance policy is in place to cover the event, and the policy certificate shall be made available for inspection upon reasonable request;
9. The following noise control conditions shall be complied with for the event, as agreed between the licence holder, event management and Environmental Protection Officer:
a. Noise control for the event shall be based on the following principles:
i Orientation of the main stage and sound system shall be as specified in the application (and licence plan as Annex 4) i.e. facing east;
ii An even distribution of sound in the Music Stage arena, at the minimum intensity for the enjoyment of the audience;
iii The quality of sound shall be maintained to avert any need to compensate for any loss of clarity with increased volume;
b. i The control limits set at the mixer positions shall be adequate to ensure that the Music Noise Level* shall not, at 1m from the facade of any noise sensitive premises (being premises where the occupants are likely to suffer nuisance from excessive noise) exceed 60dB(A) over a 15-minute period and 62 dB(A) over a 1-minute period.
ii The control limits set at the mixer positions shall be adequate to ensure that the Maximum Sound Pressure Level (LMax) shall not exceed 70dB in either the 63Hz or 125Hz octave frequency bands, as measured at 1m from the facade of any noise sensitive premises (being premises where the occupants are likely to suffer nuisance from excessive noise).
iii The Music Noise Level* at the front of house consoles shall in any case not exceed 98dB over a 15-minute period and the Maximum Sound Pressure Level (LMax) at any point in an audience shall not exceed 140dB at any time.
* The Music Noise Level is defined as the LAeq of the music noise measured at a particular location (as defined in the “Code of Practice on Environmental Noise Control at Concerts”, The Noise Council, 1995).
c. The Premises Licence Holder shall ensure that members of the audience in the Main Stage or Karaoke Marquee are not allowed within 2 metres of any loudspeaker.
d. The Premises Licence Holder shall ensure that the promoter, sound system supplier and all individual sound engineers are informed of the sound control limits prior to the commencement of licensed musical entertainment and that any instructions from either the Premises Licence Holder or the Licensing Authority are implemented.
e. The Premises Licence Holder or a nominated person authorised to act in the name of the Premises Licence Holder shall be on site for the duration of the event and be available to control all music sound levels.
f. Music from the event is permitted only between 14:00 hours and 2230 hours (as stated in the premises licence and summary of it).
g. The installation of sound amplification and public address systems shall be completed no later than 12:00 hours on 7 August 2010 in order to allow for noise propagation and sound testing and any necessary adjustments.
h. A noise propagation test shall be undertaken before 13:00 hours on 7 August 2010 in order to set appropriate control limits at the sound mixer position for the Main Stage and Karaoke Marquee. The sound systems shall be configured and operated in a similar manner as intended for the event. The sound source used for the test shall be similar in character to the music likely to be produced during the event.
i. Noise propagation tests and sound checks on sound amplification systems shall only be carried out between 12:00 hours and 14:00 hours.
j. The duration of any noise propagation tests or sound checks on sound amplification systems shall not exceed 30 minutes per location. The noise limits specified in Condition b above shall be adhered to during any noise propagation tests or sound checks.
k. At all times during the operating hours, the Premises Licence Holder or a nominated assistant shall be available to receive and respond to nuisance-related complaints. A contact telephone number shall be provided to the Licensing Authority for that purpose prior to the day of the event.
l. The Premises Licence Holder shall take all reasonable steps to ensure that noise levels from all of the activities taking place during the event are controlled to ensure compliance with the conditions relating to noise control.
m. The Music Noise Level or sound configuration of amplified music shall be turned down or adjusted at the direct request (either in person or over the telephone) of an authorised officer of the Licensing Authority.
n. Officers authorised by the Licensing Authority shall be given unfettered access to all areas of the licensed premises where necessary for the purposes of monitoring compliance with the licence conditions.
Lighting Controls
o. The Premises Licence Holder shall ensure that the lighting installed at the licensed premises are designed and orientated in such a manner as not to cause nuisance to the surrounding residents.
