ANNEX 1 - MANDATORY CONDITIONS:
The following conditions in Annex 1 are mandatory under the provisions of the Licensing Act 2003:
1. Alcohol shall not be sold or supplied:
(a) At any time when there is no designated premises supervisor in respect of the
premises licence, or
(b) At any time when the designated premises supervisor does not hold a personal licence or his/her personal licence is suspended
2. Every sale or supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.
3. The admission of children to the exhibition of any film shall be restricted in accordance with the film classification awarded by the British Board of Film Classification (BBFC), or any successor person or persons designated as the authority under section 4 of the Video Recordings Act 1984.
4. Where one or more individuals are being used at the licensed premises to carry out a security activity, each such individual must be licensed by the Security Industry Authority.
ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE:
The following conditions in Annex 2 are conditions consistent with the operating schedule submitted by the applicant within the application. These will include, where required, existing expressed conditions and embedded restrictions contained within existing authorisations and enactments as specified by the Secretary of State, in accordance with Schedule 8(6) of the Licensing Act 2003:
1. No person under the age of 14 shall be in the bar of the licensed premises during the permitted hours, unless one of the following applies:
(a) He is the child of the holder of the premises licence
(b) He resides in the premises, but is not employed there
(c) He is in the bar solely for the purpose of passing to or from some part of the premises which is not a bar and to or from which there is no other convenient means of access or egress
(d) The bar is in railway refreshment rooms or other premises constructed, fitted and intended to be used bona fide for any purpose to which the holding of a premises licence is ancillary
2. Alcohol should not be sold or supplied except during the hours authorised by the premises licence. Alcohol shall not be sold or supplied at any time for consumption off the premises.
3. The licensed premises shall be structurally adapted and bona fide used for the purpose of providing for persons resorting to the premises music and dancing to which the sale of alcohol is ancillary.
4. The maximum number of persons to be permitted on the licensed premises at any one time shall be set by agreement between the licence-holder and the fire officer.
5. No person under the age of 18 shall be present on the licensed premises whilst alcohol is being sold or supplied.
6. There shall be a minimum of one female SIA registered door supervisor on duty if searches are to be conducted on female customers.
7. SIA registered door supervisors shall be on duty on Thursdays, Fridays and Saturdays between 21:00hrs and the closure of the premises to the public.
8. Any individual or individuals banned under any active local Pubwatch scheme shall be refused entry to the licensed premises.
9. Any individual or individuals found in possession of any illegal substances or weapons shall be excluded from the licensed premises.
10. Door supervisors shall ensure that an orderly queue is maintained outside of the licensed premises.
11. Door supervisors shall enforce the capacity limit on the number of persons permitted on the licensed premises.
12. Customers shall not be permitted to leave the licensed premises whilst carrying bottles (whether open or sealed) or glasses.
13. Waste receptacles containing bottles shall only be put outside into the street after patrons have dispersed.
14. Consumption of alcohol is restricted to the areas identified on the plan of the premises attached as Annex 4.
15. Where staff have reason to suspect that a customer is under 18 years of age, that individual shall be requested to produce photographic identity proof of age documentation.
16. The licence-holder shall adopt and comply with BBPA (British Beer and Pub Association) or other industry approved guidelines on point of sale promotions.
17. The licence-holder shall adopt any recommended policy relating to responsible packaging, promoting and retailing issued by the Portman Group, and comply with any retailer alert bulletins.
18. The licence-holder shall implement a drugs policy in agreement with the Police and Local Authority.
19. The licence-holder shall provide on the licensed premises a secure deposit box to retain any confiscated items, and shall notify the Police of any items requiring safe disposal.
20. Signage shall be prominently displayed and maintained on the licensed premises advising customers and staff of any relevant crime and disorder issues, age restrictions and conditions of entry to the licensed premises. Signage shall also be prominently displayed and maintained on the licensed premises advising customers to leave the premises quietly and to respect local residents.
21. The licence holder shall participate in a local Pubwatch scheme (or similar) where such a scheme operates within the locality of the licensed premises.
22. CCTV shall be operated on the licensed premises and recordings retained for a minimum of 28 days.
23. External lighting to the premises shall be provided during the hours of darkness. (Note: It may be prudent for the licence-holder to liaise with the local Environmental Health Officer to ensure that any lighting does not cause public nuisance).
24. All doors and windows at the licensed premises shall be kept closed (save for access or egress) in order to minimise and noise escape.
25. All ventilation systems in use on the licensed premises shall have suitable sound attenuation.
26. The licence-holder shall take all reasonable steps to ensure that any flashing lights or bright lights in use inside or outside the licensed premises do not cause nuisance to nearby properties. (Note: It may be prudent for the licence-holder to liaise with the local Environmental Health Officer to ensure that any lighting does not cause public nuisance).
27. Waste receptacles used at the licensed premises shall be lidded and maintained in a clean condition.
28. Litter and waste shall be regularly cleared from the immediate vicinity of the licensed premises.
29. A suitable wind-down period shall be implemented at the licensed premises including lowering the volume of music being played and increasing the level of lighting.
30. The licence-holder shall ensure that any special effects or any mechanical installation are stored and operated so as to minimise any risk to the safety of the audience, staff or performers.
31. The licence holder shall seek guidance from the Local Authority prior to the use of any explosives, pyrotechnics, fireworks or devices of a similar nature.
32. The appended Public Entertainments Licence conditions, terms and restrictions (including any limitations on permitted capacity) will continue to apply to the Premises Licence unless where these conditions are overridden by the authorisations of the Premises Licence (for example concerning hours authorised for licensable activities), or by the provisions of the Licensing Act 2003 or other statutory modifications.
ANNEX 3 - CONDITIONS ATTACHED AFTER A HEARING BY THE LICENSING AUTHORITY:
1. The hours of operation for the licensed premises shall be those as shown on the premises licence BPL0073 and summary of it.
2. There shall be no new customers admitted to the licensed premises after 02:00hrs.
3. Staff on duty at the licensed premises shall ensure that glasses and bottles are regularly collected.
