ANNEX 1 - MANDATORY CONDITIONS
The following conditions in Annex 1 are mandatory under the provisions of the Licensing Act 2003:
1. The admission of children to the exhibition of any film shall be restricted in accordance with the film classification awarded by the British Board of Film Classification (BBFC), or any successor person or persons designated as the authority under section 4 of the Video Recordings Act 1984.
ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
The following conditions in Annex 2 are conditions consistent with the operating schedule submitted by the applicant within the application. These will include, where required, existing expressed conditions and embedded restrictions contained within existing authorisations and enactments as specified by the Secretary of State, in accordance with Schedule 8(6) of the Licensing Act 2003:
1. Alcohol shall not be sold or supplied except during permitted hours.
In this condition, permitted hours means:
a. On weekdays, other than Christmas Day, Good Friday or New Year’s Eve, 10 a.m. to 11 p.m.
b. On Sundays, other than Christmas Day or New Year’s Eve, 12 noon to 10.30 p.m.
c. On Good Friday 12 noon to 10.30 p.m.
d. On New Year’s Eve except on a Sunday, 10 a.m. to 11 p.m.
e. On New Year’s Eve on a Sunday, 12 noon to 10.30 p.m.
f. On New Year’s Eve from the end of permitted hours to the start of permitted hours on the following day (or, if there are no permitted hours on the following day, midnight on 31 December).
g. On Christmas day, as provided by the rules of the club and notified in writing by the chairman or secretary of the club to the chief executive of the justices for the petty sessions area in which the premises are. The said hours shall:
i. not exceed six and a half hours;
ii. not begin earlier than 12 noon;
iii. not end later than 10.30 p.m.
iv. provide for a break of at least 2 hours, including 3 p.m. to 5 p.m.;
v. not extend for more than three and a half hours after 5 p.m.
The above restrictions do not prohibit:
a. during the first twenty minutes after the above hours, the consumption of the alcohol on the premises;
b. during the first twenty minutes after the above hours, the taking of alcohol from the premises, unless the alcohol is supplied or taken in an open vessel;
c. during the first thirty minutes after the above ours, the consumption of the alcohol on the premises by persons taking meals there if the alcohol was supplied as ancillary to the meals;
d. the supply to, or consumption by, any person of alcohol in any premises where they are residing.
2. The bar shall be staffed by between two and four committee members at all times.
3. The licensed club premises shall not be let to any person under the age of 21 years.
4. A photo ID proof of age scheme shall be operated on the licensed club premises in order to assist with the prevention of underage sales.
5. Safety requirements are fully explained to any user of the licensed club premises.
6. All exit and escape routes shall be kept clear of any obstruction.
7. Exterior lighting shall be installed and maintained on the licensed club premises. (Note: It may be prudent for the licence-holder to liaise with the local Environmental Health Officer to ensure that any lighting is not likely to cause public nuisance).
8. Bottles shall not be put into outside receptacles at the end of an evening event.
9. Members and guests departing from the club premises shall be asked by any committee members on duty to leave quietly.
10. Any children admitted on the club premises whilst alcohol is being supplied shall be accompanied and supervised by a parent or responsible adult.
11. The club premises shall not be used for any activity that is inappropriate for children (for example adult films).
12. There shall be a suitable number of adult attendants on duty during any event or activity aimed at entertaining children.
13. The public safety provisions (including maximum permitted capacity) of the appended Public Entertainments Licence conditions, terms and restrictions shall continue to apply to the Club Premises Certificate unless where these conditions are overridden by the authorisations of the Club Premises Certificate (for example concerning hours authorised for licensable activities), or by the provisions of the Licensing Act 2003 or any other statutory modifications.
ANNEX 3 - CONDITIONS ATTACHED AFTER A HEARING BY THE LICENSING AUTHORITY
