ANNEX 1 - MANDATORY CONDITIONS:
The following conditions in Annex 1 are mandatory under the provisions of the Licensing Act 2003:
1. Alcohol shall not be sold or supplied:
(a) At any time when there is no designated premises supervisor in respect of the premises licence, or
(b) At any time when the designated premises supervisor does not hold a personal licence or his/her personal licence is suspended
2. Every sale or supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.
3. The responsible person shall take all reasonable steps to ensure that staff on relevant premises do not carry out, arrange or participate in any irresponsible promotions in relation to the premises.
In this paragraph, an irresponsible promotion means any one or more of the following activities, or substantially similar activities, carried on for the purpose of encouraging the sale or supply of alcohol for consumption on the premises in a manner which carries a significant risk of leading or contributing to crime and disorder, prejudice to public safety, public nuisance, or harm to children -
(a) games or other activities which require or encourage, or are designed to require or
encourage, individuals to -
(i) drink a quantity of alcohol within a time limit (other than to drink alcohol sold or
supplied on the premises before the cessation of the period in which the responsible
person is authorised to sell or supply alcohol), or
(ii) drink as much alcohol as possible (whether within a time limit or otherwise);
(b) provision of unlimited or unspecified quantities of alcohol free or for a fixed or discounted fee to the public or to a group defined by a particular characteristic (other than any promotion or discount available to an individual in respect of alcohol for consumption at a table meal, as defined in section 159 of the Act);
(c) provision of free or discounted alcohol or any other thing as a prize to encourage or reward the purchase and consumption of alcohol over a period of 24 hours or less;
(d) provision of free or discounted alcohol in relation to the viewing on the premises of a sporting event, where that provision is dependent on -
(i) the outcome of a race, competition or other event or process, or
(ii) the likelihood of anything occurring or not occurring;
(e) selling or supplying alcohol in association with promotional posters or flyers on, or in the
vicinity of, the premises which can reasonably be considered to condone, encourage or
glamorise anti-social behaviour or to refer to the effects of drunkenness in any favourable
manner.
4. The responsible person shall ensure that no alcohol is dispensed directly by one person into the mouth of another (other than where that other person is unable to drink without assistance by reason of a disability).
5. The responsible person shall ensure that free tap water is provided on request to customers where it is reasonably available.
6. (a) The premises licence holder or club premises certificate holder shall ensure that an age verification policy applies to the premises in relation to the sale or supply of alcohol.
(b) The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and a holographic mark.
7. The responsible person shall ensure that -
(a) where any of the following alcoholic drinks is sold or supplied for consumption on the
premises (other than alcoholic drinks sold or supplied having been made up in advance
ready for sale or supply in a securely closed container) it is available to customers in the
following measures -
(i) beer or cider: ½ pint;
(ii) gin, rum, vodka or whisky: 25 ml or 35 ml; and
(iii) still wine in a glass: 125 ml; and
(b) customers are made aware of the availability of these measures.
8. The admission of children to the exhibition of any film shall be restricted in accordance with the film classification awarded by the British Board of Film Classification (BBFC), or any successor person or persons designated as the authority under section 4 of the Video Recordings Act 1984.
ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE:
The following conditions in Annex 2 are conditions consistent with the operating schedule submitted by the applicant within the application:
1. The number of events involving either the playing of live music or the playing of recorded music together with the provision of facilities for dancing shall be limited to:
a) 10 (ten) during the calendar year ending 31 December 2012; and
b) not more than 20 (twenty) days per calendar year thereafter.
Such events shall not take place between Sunday and Thursday inclusive.
2. A written record of all events covered under Annex 2 Condition 1 (above) shall be kept on the licensed premises. Event records shall be kept for a minimum of 2 (two) years and be made available for inspection by an authorised officer of the Licensing Authority upon request.
3. All doors and windows to the Hall shall be kept shut during the playing of music, save to permit access to and egress from the building.
4. All external doors to the Hall and all doors to the entrance lobby to the Hall shall be fitted with self-closing devices.
5. The premises licence holder and designated premises supervisor (DPS) shall actively monitor, and conduct regular risk assessments relating to, the sale and supply of alcohol and use of the premises for licensed activity. Relevant policies and procedures, including hiring agreements, shall be revised as necessary to ensure the ongoing promotion of the licensing objectives.
6. Bar staff shall be personal licence holders, or else suitably and sufficiently trained on licensing and social responsibility issues relating to the sale and supply of alcohol. It is recommended that written records of training given or undertaken should be kept by the premises licence holder.
7. The premises licence holder shall ensure that all hirers of the licensed premises are provided with written details of the premises licence (number BPL0391) and the licensing objectives.
8. The designated premises supervisor (DPS) shall liaise and co-operate with the local Police on any relevant local crime and disorder issues.
9. The premises licence holder shall risk assess licensed activities at the premises and require the use of plastic drinking vessels where considered appropriate to promote the licensing objectives.
10. All alcohol consumed on the licensed premises shall be sold or supplied from the licensed bar at the premises. Users of the facilities at the hall shall not be permitted to bring their own alcohol onto the site for consumption. Suitable notices shall be prominently displayed and maintained on the licensed premises relating to this requirement.
11. An incident log and a refusals register, legibly detailing any refused sales and crime or disorder issues at the premises, shall be maintained by the premises licence holder and kept on the licensed premises. The incident log and refusals register shall be made available for inspection by an authorised officer of the Police or Local Authority upon request.
12. There shall be sufficient numbers of staff on duty to ensure adequate supervision of the premises during licensed activities.
13. The premises licence holder shall implement a suitable and sufficient vetting process for reviewing then authorising or rejecting requests for hirings of the licensed premises.
14. The premises licence holder shall conduct regular public safety risk assessments relating to the use of the premises for licensed activity. All equipment at the licensed premises pertinent to the promotion of public safety shall be regularly checked by the premises licence holder as part of such assessment.
15. The procedure to follow in the event of an emergency evacuation, identifying the assembly point and arrangements for the safe evacuation of disabled persons, shall be prominently displayed and maintained on the licensed premises.
16. A supervisory check of the licensed premises shall be conducted by a member of staff following each hiring to ensure that the attendees have left the area considerately so as to minimise the risk of public nuisance.
17. Notices shall be prominently displayed and maintained at the licensed premises to alert users/attendees to leave the area quietly and respect the needs of local residents and businesses. The hiring agreement used by the premises licence holder shall also reflect this requirement, and alert the hirer of the need to maintain the good conduct of attendees whilst they are on the premises and entering/leaving the venue.
18. Notices shall be prominently displayed and maintained at the licensed premises relating to underage sale of alcohol offences. Notices relating to the ‘Challenge 21’ scheme shall also be displayed and maintained.
19. The premises licence holder shall operate and maintain an electrical cut-off device to safeguard that amplified music does not extend past the hours authorised by premises licence BPL0391.
20. Waste bottles and glass shall not be disposed of into a bottle bank or similar outdoor waste receptacle after 22:00hrs on any occasion.
21. There shall be no adult entertainment or services, activities, other entertainment or matters ancillary to the use of the premises that may give rise to concern in respect of children.
22. Persons under the age of 18 shall not be permitted access to the bar.
23. Persons under the age of 18 shall not be permitted access to the licensed premises, whilst the premises are being used for licensed activity, unless accompanied by an adult.
24. The premises licence holders shall operate a ‘Challenge 21’ proof of age scheme. Staff shall require a bona fide form of photographic identity confirming date of birth (such as driving licence photo card, passport or PASS accredited proof of age card) from any person attempting to purchase alcohol who appears to be under 21 years of age.
ANNEX 3 - CONDITIONS ATTACHED AFTER A HEARING BY THE LICENSING AUTHORITY:
