ANNEX 1 - MANDATORY CONDITIONS:
The following conditions in Annex 1 are mandatory under the provisions of the Licensing Act 2003:
1. Alcohol shall not be sold or supplied:
(a) At any time when there is no designated premises supervisor in respect of the
premises licence, or
(b) At any time when the designated premises supervisor does not hold a personal licence or his/her personal licence is suspended
2. Every sale or supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.
3. Where one or more individuals are being used at the licensed premises to carry out a security activity each such individual must be licensed by the Security Industry Authority, unless an exemption applies to that individual under the Private Security Industry Authority Act 2001 or by virtue of any other relevant legislation.
ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE:
The following conditions in Annex 2 are conditions consistent with the operating schedule submitted by the applicant within the application:
1. Alcohol and late night refreshment shall not be sold or supplied except during permitted hours as shown on the licence and summary. These restrictions on authorised hours shall not apply to hotel residents and bona fide guests.
2. The appended Public Entertainments Licence conditions, terms and restrictions (including any limitations on permitted capacity) shall continue to apply to the Premises Licence unless where these conditions are overridden by the provisions of the Licensing Act 2003, other legislative requirements or any other statutory modifications.
3. Notices shall be prominently displayed at all exits from the licensed premises requesting that patrons leave the premises and area quietly and with consideration to the rights of neighbouring properties.
4. No person under 14 shall be in the bar of the licensed premises during the permitted hours unless one of the following applies:
(a) He/she is the child of the holder of the premises licence.
(b) He/she resides in the premises, but is not employed there.
(c) He/she is in the bar solely for the purpose of passing to or from some part of the premises which is not a bar and to or from which there is no other convenient means of access or egress.
(d) The bar is in railway refreshment rooms or other premises constructed, fitted and intended to be used bona fide for any purpose to which the holding of the licence is ancillary.
In this condition “bar” includes any place exclusively or mainly used for the consumption of alcohol. But an area is not a bar when it is usual for it to be, and it is, set apart for the service of table meals and alcohol is only sold or supplied to persons as an ancillary to their table meals.
5. Live and recorded music activities in outdoor areas of the licensed premises shall be limited in duration to a maximum of 2 hours in total in any one day, and live or recorded music activities outdoors shall not take place beyond 19:00hrs. Live music outdoors shall not involve any amplification or vocals.
6. Late Night Refreshment activity in outdoor areas of the licensed premises shall be limited to those persons taking table meals at the hotel that evening or bona fide guests of hotel residents.
7. The premises licence holder shall ensure that all relevant members of staff at the hotel receive adequate training concerning the terms and conditions of premises licence BPL0271.
8. An effective CCTV system shall be installed and maintained on the licensed premises in order to assist with promotion of the prevention of crime and disorder licensing objective.
9. The premises management shall operate a photo identity proof of age scheme at the licensed premises in order to assist with the prevention of underage sales.
10. The premises licence holder shall ensure that the licensed premises is managed effectively and responsibly at all times.
11. The premises licence holder shall conduct regular testing (and certification where appropriate) of procedures, appliances and systems pertinent to public safety.
13. Litter bins shall be provided outside of the premises (where this is in accordance with any planning requirements).
14. The premises licence holder shall install and maintain adequate noise limiter equipment on the licensed premises. The premises licence holder shall liaise directly with the local Environmental Health Officer to agree a suitable setting for such noise limiter equipment.
15. The volume control of any recorded music, amplification or noise limiter equipment being used at the licensed premises shall be under the direct control of the designated premises supervisor (DPS), or another responsible individual nominated by the DPS, with provision made for the volume level to be decreased upon the direct request of an authorised officer of the Local Authority or Police.
ANNEX 3 - CONDITIONS ATTACHED AFTER A HEARING BY THE LICENSING AUTHORITY:
No conditions imposed.
