ANNEX 1 - MANDATORY CONDITIONS
The following conditions in Annex 1 are mandatory under the provisions of the Licensing Act 2003:
1. Alcohol shall not be sold or supplied:
(a) At any time when there is no designated premises supervisor in respect of the
premises licence, or
(b) At any time when the designated premises supervisor does not hold a personal licence or his/her personal licence is suspended
2. Every sale or supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.
3. Where a premises licence includes a condition that at specified times one or more individuals must be at the premises to carry out a security activity, the licence must include a condition that each such individual must be licensed by the Security Industry Authority.
4. Where a premises licence authorises the exhibition of films, the admission of children to the exhibition of any film must be restricted in accordance with the film classification.
ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
The following conditions in Annex 2 are conditions consistent with the operating schedule submitted by the applicant within the application. These will include, where required, existing expressed conditions and embedded restrictions contained within existing authorisations and enactments as specified by the Secretary of State, in accordance with Schedule 8(6) of the Licensing Act 2003:
1. Staff shall receive suitable training in accordance with the licence holders policies and procedures.
2. The licence holder shall participate in a local Pubwatch scheme (or similar) where such a scheme operates within the locality of the licensed premises.
3. Plastic or toughened glasses shall be used during any outdoor event involving the supply of alcohol.
4. A secure deposit box shall be available on the licensed premises for any confiscated items.
5. CCTV shall be installed and operated on the licensed premises covering both internal and external areas of the licensed premises. Recordings should be retained for a minimum period of 28 days.
6. Litter bins shall be provided and litter shall be collected and managed.
7. External lighting and security lighting shall be provided to the licensed premises. (Note: It may be prudent for the licence-holder to liaise with the local Environmental Health Office to ensure that any lighting does not cause public nuisance).
8. The premises management shall adopt best practice in relation to point of sale promotions (for example BBPA/Portman Group guidelines) and the National Alcohol Harm Reduction Strategy Toolkit, whilst such guidance is available.
9. Where appropriate the premises management shall regularly test all procedures, applicances and systems pertinent to public safety.
10. Adequate soundproofing measures and sound limitation equipment shall be installed and maintained on the licensed premises.
11. Effective ventilation systems shall be installed on the licensed premises in order to assist with the prevention of any nuisance from odour.
12. Children shall only be permitted on the premises until 19:00hrs except in the restaurant area where children shall be permitted until 23:00hrs.
13. Children in the restaurant area shall be accompanied by a responsible adult on all occasions.
ANNEX 3 - CONDITIONS ATTACHED AFTER A HEARING BY THE LICENSING AUTHORITY
1. Appropriate signage shall be displayed and maintained on the licensed premises requesting that patrons leave the area quietly and respect neighbours of the licensed premises.
2. The premises management shall as far as practical ensure that all windows and doors are closed (save for access and egress) during any performance of amplified music.
3. Use of outside areas for the consumption of alcohol shall cease at 23:30hrs on all occasions.
4. Opened bottles or glasses shall be retained or disposed of on the licensed premises.
5. The volume control of any recorded music or any amplification equipment shall be under the direct control of the designated premises supervisor (DPS) or their representative with provision made for the sound to be turned down at the direct request of an authorised officer of the Local Authority or Police.
