ANNEX 1 - MANDATORY CONDITIONS
The following conditions in Annex 1 are mandatory under the provisions of the Licensing Act 2003:
1.1 Alcohol shall not be sold or supplied:
(a) At any time when there is no designated premises supervisor in respect of the premises licence, or
(b) At any time when the designated premises supervisor does not hold a personal licence or his/her personal licence is suspended
1.2 Every sale or supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.
1.3 Where one or more individuals are being used at the licensed premises to carry out a security activity, each such individual must be licensed by the Security Industry Authority (unless where the individual is exempt from obtaining an SIA registration under the Private Security Industry Act 2001).
1.5 The responsible person must ensure that staff on relevant premises do not carry out, arrange or participate in any irresponsible promotions in relation to the premises.
In this paragraph, an irresponsible promotion means any one or more of the following activities, or substantially similar activities, carried on for the purpose of encouraging the sale or supply of alcohol for consumption on the premises -
(a) games or other activities which require or encourage, or are designed to require or encourage, individuals to -
(i) drink a quantity of alcohol within a time limit (other than to drink alcohol sold or supplied on the premises before the cessation of the period in which the responsible person is authorised to sell or supply alcohol), or
(ii) drink as much alcohol as possible (whether within a time limit or otherwise);
(b) provision of unlimited or unspecified quantities of alcohol free or for a fixed or discounted fee to the public or to a group defined by a particular characteristic in a manner which carries a significant risk of undermining a licensing objective;
(c) provision of free or discounted alcohol or any other thing as a prize to encourage or reward the purchase and consumption of alcohol over a period of 24 hours or less in a manner which carries a significant risk of undermining a licensing objective;
(d) selling or supplying alcohol in association with promotional posters or flyers on, or in the vicinity of, the premises which can reasonably be considered to condone, encourage or glamorise anti-social behaviour or to refer to the effects of drunkenness in any favourable manner;
(e) dispensing alcohol directly by one person into the mouth of another (other than where that other person is unable to drink without assistance by reason of disability).
1.6 The responsible person must ensure that free potable water is provided on request to customers where it is reasonably available.
1.7 (a) The premises licence holder or club premises certificate holder must ensure that an age verification policy is adopted in respect of the premises in relation to the sale or supply of alcohol.
(b) The designated premises supervisor in relation to the premises licence must ensure that the supply of alcohol at the premises is carried on in accordance with the age verification policy.
(c) The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request,
before being served alcohol, identification bearing their photograph, date of birth and
either -
(i) a holographic mark, or
(ii) an ultraviolet feature.
1.8 The responsible person must ensure that -
(a) where any of the following alcoholic drinks is sold or supplied for consumption on the premises (other than alcoholic drinks sold or supplied having been made up in advance ready for sale or supply in a securely closed container) it is available to customers in the following measures -
(i) beer or cider: ½ pint;
(ii) gin, rum, vodka or whisky: 25 ml or 35 ml; and
(iii) still wine in a glass: 125 ml;
(b) these measures are displayed in a menu, price list or other printed material which is
available to customers on the premises; and
(c) where a customer does not in relation to a sale of alcohol specify the quantity of
alcohol to be sold, the customer is made aware that these measures are available.
1.9 The relevant person (the holder of the premises licence, the designated premises supervisor (if any) in respect of such a licence, the personal licence holder who makes or authorises a supply of alcohol under such a licence, or any member or officer of a club present on the premises in a capacity which enables the member or officer to prevent the supply in question) shall ensure that no alcohol is sold or supplied for consumption on or off the premises for a price which is less than the permitted price.
For the purposes of this condition “duty” is to be construed in accordance with the Alcoholic Liquor Duties Act 1979, “permitted price” is the price found by applying the formula -
P = D + (D x V)
where - (i) P is the permitted price, (ii) D is the rate of duty chargeable in relation to the alcohol as if the duty were charged on the date of the sale or supply of the alcohol, and (iii) V is the rate of value added tax chargeable in relation to the alcohol as if the value added tax were charged on the date of the sale or supply of the alcohol;
[“value added tax” means value added tax charged in accordance with the Value Added Tax Act 1994]
ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
The following conditions in Annex 2 are conditions consistent with the operating schedule submitted by the applicant within the application:
2.1 The capacity for any event involving a licensable activity - including attendees, staff, performers, stallholders and contractors - shall not exceed 4,999 persons at any one time.
2.2 Premises licence BPL0255-013784 is for the regular licensable uses of Kentwell Hall (namely restaurant, tearoom, historical recreations, ‘Scaresville’ activity, pre-booked functions and weddings) and shall not authorise any outdoor concert, festival or similar activity. Those types of one-off larger scale public event shall be applied for as a separate premises licence application in each case.
2.3 Alcohol shall only be sold or supplied from the restaurant, tearoom and Overcroft areas of the licensed premises, in accordance with the plan attached as Annex 4. For the avoidance of any doubt consumption of alcohol across the site is not restricted.
2.4 All supply of alcohol shall cease by midnight with the exception of ‘Scaresville’ activities only.
2.5 Outdoor live music shall cease by 23:00hrs on all occasions.
2.6 Outdoor recorded music and dance shall cease by 23:00hrs on all occasions and shall continue beyond midnight indoors on a Thursday, Friday and Saturday for ‘Scaresville’ activities only. Indoor regulated entertainment shall be limited to the restaurant, tearoom and Overcroft. For the avoidance of doubt, no regulated entertainment shall take place on the balcony of the Overcroft.
2.7 All late night refreshment shall cease by midnight with the exception of ‘Scaresville’ activities only.
2.8 Opening times shall cease by midnight with the exception of ‘Scaresville’ activities only.
2.9 The premises licence holder shall ensure effective and responsible management of the licensed premises at all times. Suitable and sufficient risk assessments shall be conducted and made available to an authorised officer of the licensing authority or a responsible authority upon request.
2.10 The premises licence holder shall ensure that a hiring agreement/contract is in place for each and every hiring of the licensed premises which includes one or more licensable activity.
2.11 The premises licence holder shall require the person responsible for an activity, event or hiring to take into account factors relevant to promotion of the licensing objectives which include, but are not limited to, noise control and public nuisance mitigation, traffic management/access routes, security/stewarding levels, capacity monitoring and control, first aid provision, fire and health and safety risk assessments.
2.12 No children under the age of 16 years shall be permitted on the licensed premises unless accompanied by a responsible adult. The premises licence holder shall ensure that all hirers are advised that children must be accompanied by a responsible adult and adequately supervised at all times.
2.13 There shall be no adult entertainment or services, activities, other entertainment or matters ancillary to the use of the premises that may give rise to concern in respect of children.
2.14 The premises licence holder or their nominated representative shall be on site for the duration of any event or hiring and shall provide a contact number to the hirer/event organiser.
2.15 All staff at the licensed premises shall be suitably and sufficiently briefed on emergency procedures including evacuation.
2.16 The premises licence holder shall comply with any reasonable recommendations made by an authorised officer of the Local Authority or a responsible authority which is relevant to promotion of a licensing objective for a particular activity, event or function.
2.17 There shall be no consumption of alcohol permitted beyond the perimeter boundary of the premises site. Bottles and glassware shall not be permitted beyond the boundary.
2.19 The premises licence holder shall ensure that all relevant staff members are suitably and sufficiently trained and supervised in respect of sale and supply of alcohol, dealing with intoxicated persons and conflict resolution techniques. Intoxicated persons shall not be permitted entry or access to the licensed premises.
2.20 There shall be adequate provision of litter and waste receptacles on site at the licensed premises, including for the safe collection of smoking-related waste.
2.21 The licensed premises site shall be adequately signposted and areas which are not prohibited access to the general public shall be adequately secured and identifiable as such.
2.22 The Police shall be notified in advance of any event or function with an anticipated capacity of 500 or more persons (including staff, performers and contractors/stallholders).
2.23 The premises licence holder shall ensure that staff and hirers are briefed to promptly notify the Police of any occurring instance, or likely incident, which may lead to crime or disorder.
2.24 The premises licence holder shall be alert to persons attempting to enter the site for activities and events from across fields and not through the usual entrance or so as to avoid payment, and shall operate a management plan to deter and to deal with such instances.
2.25 The premises licence holder shall maintain a legible written (or electronic) record of all events held at the licensed premises which involve one or more licensable activity, and this record shall be made available to an authorised officer of the Police or Local Authority upon reasonable request.
2.26 The premises licence holder shall ensure that a full risk assessment is completed for each activity, event or function, which is beyond the usual visiting house or garden activities. Such individual risk assessments shall be made available to an authorised officer of a responsible authority upon reasonable request.
2.27 The premises licence holder shall ensure that the management of staff, training and provision of security and stewarding are suitable and satisfactory for all licensable activities, events or functions.
2.28 The premises licence holder shall ensure that access and egress routes to and from the licensed premises are maintained so as kept clear and unobstructed for emergency vehicles. Access and egress routes shall be adequately signed and illuminated during the hours of darkness whilst any licensable activity, event or function is taking place.
2.26 Access and parking for guests/attendees shall be located so as away from any potential hazards (for example water, obstructions or trips/falls hazards). Areas of the site presenting any danger or hazard to guests/attendees shall be suitable and sufficiently safeguarded/excluded from public access.
2.27 The premises licence holder shall ensure that authorised activity timings and opening hours are strictly observed and clearly communicated in advance to all hirers, event organisers and attendees/guests (including within any hiring agreement documentation).
2.28 The premises licence holder shall ensure that litter picks/waste collection are conducted promptly following the end of a licensable activity, event or function.
2.29 During the operating hours of any licensable event, the premises licence holder (PLH), Designated Premises Supervisor (DPS), or another responsible individual nominated by the DPS/PLH shall be available to receive and respond to complaints. A contact number shall be made readily available to members of the public and the Authorities for that use.
2.30 The volume control of any recorded music or amplification equipment being used at the licensed premises shall be under the direct control of the designated premises supervisor (DPS), or another responsible individual nominated by the DPS, with provision made for the volume level to be decreased at the direct request of an authorised officer of the Police or Local Authority.
2.31 Clearly legible and suitable notices shall be displayed and maintained at exits, requesting that attendees/guests respect local residents and businesses by leaving the premises quietly.
2.32 The premises licence holder or their nominated representative shall, including by use a noise meter, monitor noise levels at regular intervals whilst amplified music is being played to ensure that the prevention of public nuisance is promoted and any noise levels agreed with the Local Authority are not being exceeded. Note: The local Environmental Protection Officer should be consulted prior on any matters relating to monitoring timings, durations, areas, noise levels or equipment to ensure that the objectives of this condition are met.
2.33 The premises licence holder shall ensure that hirers are informed of noise and sound control measures prior to the commencement of any musical entertainment, and that any instructions or reasonable requests from the premises licence holder or Local Authority are implemented.
2.34 There shall be no late night refreshment to take away from the licensed premises, beyond the boundary of the premises perimeter.
ANNEX 3 - CONDITIONS ATTACHED AFTER A HEARING BY THE LICENSING AUTHORITY
Not applicable.
