ANNEX 1 - MANDATORY CONDITIONS
The following conditions in Annex 1 are mandatory under the provisions of the Licensing Act 2003:
1. Alcohol shall not be sold or supplied:
(a) At any time when there is no designated premises supervisor in respect of the
premises licence, or
(b) At any time when the designated premises supervisor does not hold a personal licence or his/her personal licence is suspended
2. The admission of children to the exhibition of any film shall be restricted in accordance with the film classification awarded by the British Board of Film Classification (BBFC), or any successor person or persons designated as the authority under section 4 of the Video Recordings Act 1984.
ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
The following conditions in Annex 2 are conditions consistent with the operating schedule submitted by the applicant within the application. These will include, where required, existing expressed conditions and embedded restrictions contained within existing authorisations and enactments as specified by the Secretary of State, in accordance with Schedule 8(6) of the Licensing Act 2003:
1. There shall be no supplies of alcohol for consumption OFF the licensed premises.
2. An adequate security alarm system shall be installed and maintained on the licensed premises.
3. The licence holder shall ensure that relevant staff receive adequate training in issues relevant to the promotion of the four licensing objectives at the Quay Theatre.
4. The car park and external areas shall be adequately illuminated during the hours of darkness whilst licensed activities are occurring on the premises. (Note: It may be prudent for the licence holder to liaise with the local Environmental Health Officer to minimise the potential for any lighting to cause public nuisance).
5. The premises management shall ensure that they promptly comply with any direct requests from the Police or other responsible authorities relevant to the promotion of the licensing objectives.
6. The supply of alcohol shall be as an ancillary to other licensable activities taking place on the premises.
7. A proof of age scheme shall be operated on the licensed premises in order to assist with the prevention of underage sales.
8. All escape routes and emergency exits shall be kept clear from obstruction, and all escape doors shall be kept unlocked and regularly checked to ensure that they function adequately.
9. The premises management shall ensure that all relevant staff are aware of the management’s risk assessment policies.
10. Safety equipment, fire alarms and signage shall be regularly checked and records of inspections and tests shall be kept by the premises management.
11. An adequate supply of first aid materials and equipment shall be available on the licensed premises.
12. Doors shall be kept closed (save for access or egress) during any performance in the Auditorium.
13. In the event of a performance of dance of an adult nature (for example involving striptease or nudity) the premises management shall ensure that children are not permitted to the entertainment.
14. Any members of staff who come into regular contact with under 16 year olds on the licensed premises (for example stewards on duty during children’s performances) shall provide the premises management with a Criminal Records Disclosure or similar criminal record certificate.
15. Signage shall be prominently displayed and maintained on the licensed premises advising staff and patrons of the prohibition of sale of alcohol to under 18’s.
16. The premises management shall ensure that principal bar staff are aware of all relevant offences in relation to the sale and supply of alcohol.
17. The premises management shall ensure that any person causing nuisance or exhibiting inappropriate behaviour on the licensed premises shall be advised to cease from doing so.
18. The minimum number of stewards present when members of the public are present shall be:
(i) up to 100 persons - 2 stewards
(ii) for each additional 50 persons or part thereof - 1 steward.
Each steward shall be readily identifiable to members of the public and shall be instructed and trained in the following:
(i) The action to be taken upon discovering a fire.
(ii) The position of the exits
(iii) The operation of the emergency lighting and fire fighting equipment
(iv) Raising the alarm and correct method of calling the Fire Brigade
(v) Evacuation of the public in the event of an emergency.
19. The number of persons permitted on the premises at any one time shall not exceed:
(a) During children’s performance: 145 (one hundred and forty-five) persons - this being 93 fixed seats the front 3 rows removed for a children’s performance and 52 children seated on the floor,
(b) When all seating is removed: The permitted number of persons shall not exceed 180 (one hundred and eighty).
