ANNEX 1 - MANDATORY CONDITIONS
The following conditions in Annex 1 are mandatory under the provisions of the Licensing Act 2003:
1. Alcohol shall not be sold or supplied:
(a) At any time when there is no designated premises supervisor in respect of the
premises licence, or
(b) At any time when the designated premises supervisor does not hold a personal licence or his/her personal licence is suspended
2. Every sale or supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.
3. The admission of children to the exhibition of any film shall be restricted in accordance with the film classification awarded by the British Board of Film Classification (BBFC), or any successor person or persons designated as the authority under section 4 of the Video Recordings Act 1984.
4. Where one or more individuals are being used at the licensed premises to carry out a security activity, each such individual must be licensed by the Security Industry Authority.
ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
The following conditions in Annex 2 are conditions consistent with the operating schedule submitted by the applicant:
1. The premises licence holder shall ensure that all staff at the premises are trained in accordance with established J D Wetherspoons training procedures.
2. The premises shall be constructed in accordance with the plan provided with the application and annexed as Annex 4, and in case of any alteration a further plan, incorporating any alterations, shall be served on the Licensing Authority and all Responsible Authorities prior to the opening of the premises.
3. The premises licence holder shall adhere to the document ‘JDW approach to responsible drinks retailing’ (attached to these conditions) as may be amended from time to time.
4. Non-alcoholic beverages including soft drinks, drinking water, coffee and tea shall be available at all times whilst the sale by retail of alcohol takes place at the premises.
5. The premises licence holder shall take all reasonable steps to ensure that the Designated Premises Supervisor (DPS) or a nominated member of staff shall be a member of Pubwatch (or a similar scheme) where available and this individual shall use his or her best endeavours to attend regular meetings of such a scheme.
6. CCTV shall be installed at the premises in compliance with any reasonable requirements of the Police crime prevention officer and images/recordings shall be retained for a minimum of 31 days and made available to the Police upon request.
7. The premises licence holder shall operate a no-smoking policy at the premises.
8. The premises licence holder shall adhere to the ‘J D Wetherspoons dispersal policy’ (attached to these conditions) as may be amended from time to time.
9. The premises licence holder shall operate a “Challenge 21” policy.
10. Children under 16 shall not be permitted on the premises beyond 21:00hrs (or 21:30hrs if eating a meal).
11. At all times whilst children under the age of 16 are permitted on the premises, they shall be accompanied by an adult who shall maintain supervision of them.
12. At all times whilst children under the age of 16 are permitted on the premises, suitable food and non-alcoholic beverages shall be available.
13. A noise limiter, consisting of a digital sound processing unit, shall be installed at the premises and its volume pre-sets agreed with the Local Authority‘s Environmental Health Department in conjunction with a noise consultant acting on behalf of the premises licence holder.
These pre-sets shall take into account any proposed sound attenuation works or premises internal re-design which may have an impact on noise attenuation and break out from the premises including, if necessary, the installation of air conditioning, prior to any regulated entertainment being provided at the premises.
Where entertainment is provided that does not need electronic enhancement such as a Jazz band, the noise levels being generated externally shall be monitored by the on site manager(s) who must retain the ability to control or stop a particularly noisy event.
14. There shall be no use of the outside area for consumption of alcohol after 23:30hrs on any occasion.
15. Signage shall be prominently displayed and maintained on the licensed premises requesting that patrons leave the premises quietly and with consideration to the rights of local residents and neighbouring properties.
16. The Designated Premises Supervisor (DPS) shall risk assess the requirement for door supervisors in conjunction with the Police and thereafter provide door supervisors at such times and in such numbers as deemed necessary by the risk assessment.
17. The premises licence holder shall use best endeavours to ensure that wherever possible drinks are served in plastic or toughened glasses.
18. The premises licence holder shall use best endeavours to ensure that no opened bottles or glasses are removed from the premises (note: this condition shall not apply to external drinking area of the premises).
ANNEX 3 - CONDITIONS ATTACHED AFTER A HEARING BY THE LICENSING AUTHORITY
No conditions imposed by the Licensing Sub-Committee.
