ANNEX 1 - MANDATORY CONDITIONS
The following conditions in Annex 1 are mandatory under the provisions of the Licensing Act 2003:
1. Alcohol shall not be sold or supplied:
(a) At any time when there is no designated premises supervisor in respect of the
premises licence, or
(b) At any time when the designated premises supervisor does not hold a personal licence or his/her personal licence is suspended
2. Every sale or supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.
ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
The following conditions in Annex 2 are conditions consistent with the operating schedule submitted by the applicant within the application:
1. The premises licence holder shall ensure that there will be:
(a) Ongoing health and safety, risk assessment and fire training;
(b) In-house weekly testing of fire alarms, fire extinguisher locations and fire exit accessibility; and
(c) In-house monthly testing of emergency lighting.
2. Alcohol shall only be served by waiter/waitress service.
3. Suitable beverages other than alcoholic drinks shall be equally available on the licensed premises.
4. Emergency exits signs shall be maintained as clearly visible.
5. There shall be regular servicing and testing of fire alarms, fire extinguishers, emergency lighting, extractors and portable appliances.
6. Any music being played at the licensed premises shall be background music only.
7. External windows and doors shall be lockable.
8. Kitchen extractor systems shall be maintained so as to minimise any potential for public nuisance caused by noxious smells or odour.
9. Children shall only be admitted to the licensed premises if accompanied by an adult.
10. There shall be no activities conducted on the licensed premises that would be harmful to children.
11. The licensed premises shall provide high chairs for babies and young children.
12. Any music being played at the licensed premises shall be inaudible at 5 metres distance from the premises.
13. Music speakers shall not be positioned on the wall adjoining 53 Gainsborough Street and neither shall they be positioned in the conservatory area of the licensed premises.
14. The volume control of any recorded music or amplification equipment shall be under the direct control of the designated premises supervisor (DPS), or another responsible individual nominated by the DPS, with provision made for the volume level to be turned down upon direct request of an authorised officer of the Local Authority or Police.
ANNEX 3 - CONDITIONS ATTACHED AFTER A HEARING BY THE LICENSING AUTHORITY
