ANNEX 1 - MANDATORY CONDITIONS
The following conditions in Annex 1 are mandatory under the provisions of the Licensing Act 2003:
1.1 The admission of children to the exhibition of any film shall be restricted in accordance with the film classification awarded by the British Board of Film Classification (BBFC), or any successor person or persons designated as the authority under section 4 of the Video Recordings Act 1984.
1.2 Where one or more individuals are being used at the licensed premises to carry out a security activity, each such individual must be licensed by the Security Industry Authority (unless where the individual is exempt from obtaining an SIA registration under the Private Security Industry Act 2001).
ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
The following conditions in Annex 2 are conditions consistent with the operating schedule submitted by the applicant within the application:
2.1 All event organisers of events involving licensable activities reliant on premises licence BPL0322 shall be required to prepare and implement an Event Management Plan (EMP) to promote the licensing objectives. For events expected to attract 500 persons or more at any one time (including staff, performers and contractors on site) the Event Management Plan shall be provided to the Licensing Authority, and be made available to Responsible Authorities, not less than 14 days prior to the first day of the event. Any proposed revisions to the EMP shall be notified in writing to the relevant Responsible Authority and Licensing Authority before the master EMP is updated - which shall be as soon as reasonably practicable following the revision. The premises licence, event management plan and risk assessments shall be kept with all other event documentation in the event control for the duration of the event and this location shall be clearly identified on the site plan. An up to date event site plan shall be retained with the EMP at all times.
2.2 All event organisers of events involving licensable activities and with an anticipated capacity of 500 or more persons at any one time shall be required to liaise with the district Safety Advisory Group (SAG), should such a scheme operate in the locality. Where the SAG determines that it is appropriate for the event organiser/premises user to attend a SAG meeting then the event organiser shall attend prior to the first day of the event (and within any reasonable timeframe determined by the SAG).
2.3 The premises licence holder shall advise all hirers of the venue to comply with terms and conditions of this premises licence, to ensure promotion of the licensing objectives, and shall recommend that all event organisers reference the Health and Safety Executive (HSE) guidance document HSG195 ‘The Event Safety Guide’ (or any equivalent replacement thereof) for outdoor public events. For any firework, pyrotechnic or bonfire entertainment the event organisers shall also be directed to the Health and Safety Executive (HSE) guidance document ‘Working Together on Firework Displays’ (or any equivalent replacement thereof).
2.4 The following additional conditions apply in relation to any licensed music event:
(i) During operating hours on days on which a licensed event is held, the event organiser/premises user, or other responsible person nominated by the event organiser/premises user, shall be available to receive and respond to nuisance-related complaints. A contact number shall be made readily available for that purpose.
(ii) The volume or sound configuration of amplified music shall be turned down or adjusted upon the reasonable request (either in person or over the telephone) of an authorised officer of the Licensing Authority or a Police Officer.
2.5 All staging, marquees or temporary structures used at the licensed venue shall have suitable and sufficient risk assessments carried out and shall be erected, maintained and supervised by competent, and appropriately qualified where necessary, persons. Such persons shall (if so requested) be able to demonstrate to responsible authorities that they have the relevant credentials to safely install and operate such structures.
2.6 There shall be no adult entertainment or services, activities, other entertainment or matters ancillary to the use of the premises that may give rise to concern in respect of children.
2.7 Suitable and sufficient levels, timings and duties of medical, security staff and stewarding for licensable events shall be risk assessed and agreed between the event organiser/premises user and relevant provider or contractor. Such assessments or methodology shall be referenced or appended to the Event Management Plan (EMP) for the event.
2.8 The event organiser/premises user shall ensure that suitable and sufficient public safety risk assessments shall be conducted and documented for each and every licensable event and made immediately available to responsible authorities upon request.
2.9 Any impromptu, unscheduled or unauthorised entertainments, performances or activities that occur which may give rise to child protection concerns shall be immediately closed and any unauthorised performers or participants ejected from the site. Note: The Police should be promptly called to any such activities where criminal or disorderly behaviour or conduct has or is about to take place.
2.10 Premises licence BPL0322 does NOT authorise the sale or supply of alcohol. For events where alcohol is present, but there is no regulated sale or supply (for example attendees bringing their own alcohol for their own consumption or a separate valid temporary event notice has effect), the event organiser shall conduct suitable and sufficient risk assessments and ensure that staff and stewards monitor and supervise event attendees and are vigilant to indications of underage drinking, drug use or excessive consumption of alcohol. All instances of underage drinking, drug use or drunkenness shall be challenged and the Police promptly called to any issues of concern.
2.11 All stewards, security and staff shall be suitably and sufficiently briefed on the Event Management Plan, including emergency evacuation procedures, and licence controls (including main licensing offences) prior to the commencement of a licensed event or activity.
2.12 The event organiser/premises user for events involving licensable activities under authority of premises licence BPL0322 shall ensure that suitable and sufficient public liability insurance is maintained in force covering use of the licensed premises and that a copy of the schedule is made available for inspection by an authorised officer upon request.
2.13 The event organiser/premises user shall operate and implement a suitable and sufficient lost child policy, and advertise key elements in support of the policy to event attendees. The event organiser/premises user shall liaise with the Police over formulation of the policy, including good practice on robust messaging and handover procedures. Any persons responsible for child welfare, for example crèche or lost child facilities, shall have satisfied the event organiser that they are fit and proper to fulfil the role prior to being tasked.
