ANNEX 1 - MANDATORY CONDITIONS
The following conditions in Annex 1 are mandatory under the provisions of the Licensing Act 2003:
1. Alcohol shall not be sold or supplied:
(a) At any time when there is no designated premises supervisor in respect of the
premises licence, or
(b) At any time when the designated premises supervisor does not hold a personal licence or his/her personal licence is suspended
2. Every sale or supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.
ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
The following conditions in Annex 2 are conditions consistent with the operating schedule submitted by the applicant within the application:
1. Alcohol shall only be sold as an accompaniment to food being consumed on the licensed premises.
2. Performances of live music shall be restricted to not more than one performance every two calendar months.
3. The premises licence holders shall operate and enforce a last admission time for new customers of not later than 23:00hrs.
4. The premises licence holders shall ensure that any person(s) behaving in an inappropriate or disorderly way are removed from the licensed premises. (Note: If the premises management are in any doubt concerning their own ability to safely remove such person(s) then it may be prudent for them to promptly call the Police).
5. The premises licence holders shall ensure that appropriate notices are prominently displayed and maintained in the bar area of the licensed premises, with such signage to advise upon the prohibition on the sale of alcohol to any persons under the age of 18. Notices should also be displayed and maintained on the licensed premises requiring patrons to leave the area quietly.
6. The premises licence holders shall ensure that the volume control of any recorded music or amplification equipment being used shall remain under the direct control of the designated premises supervisor, or their representative, with provision made for the sound to be turned down upon the direct request of an authorised officer of the Local Authority or Police.
7. The premises licence holders shall ensure that no drinks are available for consumption from glass bottles.
8. The premises licence holders shall ensure that the maximum occupancy of the licensed premises is restricted at any one time to 50 (fifty) persons.
9. The premises licence holders shall ensure that customers waiting for takeaway meals shall be provided with seating in the restaurant area.
10. The premises licence holders shall ensure that any person selling or supplying alcohol under the authority of a personal licence shall request photo identity proof of age where they have reason to suspect that an individual may be under 18 years of age.
11. Any restrictions on the admittance of individuals according to their age or any conditions of entry to the licensed premises shall be displayed in the vicinity of the entrance to the licensed premises.
12. The premises licence holders shall ensure that doors and windows shall be kept closed (saved for access or egress) to minimise the potential for noise nuisance from the premises whilst music is being played.
13. The premises licence holder shall ensure that offensive smells from the licensed premises are not permitted so as to cause a nuisance to nearby properties, and that the premises are adequately vented. (Note: It may be prudent for the premises licence holders to liaise with the Local Planning Authority in respect of any venting/odour control equipment due to the listed building status of the premises).
ANNEX 3 - CONDITIONS ATTACHED AFTER A HEARING BY THE LICENSING AUTHORITY
1. Litter and waste refuse shall be cleared from the immediate vicinity of the licensed premises on a daily basis.
2. The hours and activities authorised by premises licence BPL0336 shall be reduced to those as set out on the licence and summary. There shall be no Late Night Refreshment activity at the premises (whether for consumption on the premises or to takeaway).
