ANNEX 1 - MANDATORY CONDITIONS
The following conditions in Annex 1 are mandatory under the provisions of the Licensing Act 2003:
1. Alcohol shall not be sold or supplied:
(a) At any time when there is no designated premises supervisor in respect of the
premises licence, or
(b) At any time when the designated premises supervisor does not hold a personal licence or his/her personal licence is suspended
2. Every sale or supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.
3. Where one or more individuals are being used at the licensed premises to carry out a security activity, each such individual must be licensed by the Security Industry Authority (unless where the individual is exempt from obtaining an SIA registration under the Private Security Industry Act 2001).
4. The responsible person shall take all reasonable steps to ensure that staff on relevant premises do not carry out, arrange or participate in any irresponsible promotions in relation to the premises.
In this paragraph, an irresponsible promotion means any one or more of the following activities, or substantially similar activities, carried on for the purpose of encouraging the sale or supply of alcohol for consumption on the premises in a manner which carries a significant risk of leading or contributing to crime and disorder, prejudice to public safety, public nuisance, or harm to children -
(a) games or other activities which require or encourage, or are designed to require or
encourage, individuals to -
(i) drink a quantity of alcohol within a time limit (other than to drink alcohol sold or
supplied on the premises before the cessation of the period in which the responsible
person is authorised to sell or supply alcohol), or
(ii) drink as much alcohol as possible (whether within a time limit or otherwise);
(b) provision of unlimited or unspecified quantities of alcohol free or for a fixed or
discounted fee to the public or to a group defined by a particular characteristic (other than
any promotion or discount available to an individual in respect of alcohol for
consumption at a table meal, as defined in section 159 of the Act);
(c) provision of free or discounted alcohol or any other thing as a prize to encourage or
reward the purchase and consumption of alcohol over a period of 24 hours or less;
(d) provision of free or discounted alcohol in relation to the viewing on the premises of a
sporting event, where that provision is dependent on -
(i) the outcome of a race, competition or other event or process, or
(ii) the likelihood of anything occurring or not occurring;
(e) selling or supplying alcohol in association with promotional posters or flyers on, or in the
vicinity of, the premises which can reasonably be considered to condone, encourage or
glamorise anti-social behaviour or to refer to the effects of drunkenness in any favourable
manner.
5. The responsible person shall ensure that no alcohol is dispensed directly by one person into the mouth of another (other than where that other person is unable to drink without assistance by reason of a disability).
6. The responsible person shall ensure that free tap water is provided on request to customers where it is reasonably available.
7. (a) The premises licence holder or club premises certificate holder shall ensure that an age verification policy applies to the premises in relation to the sale or supply of alcohol.
(b) The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and a holographic mark.
8. The responsible person shall ensure that -
(a) where any of the following alcoholic drinks is sold or supplied for consumption on the
premises (other than alcoholic drinks sold or supplied having been made up in advance
ready for sale or supply in a securely closed container) it is available to customers in the
following measures -
(i) beer or cider: ½ pint;
(ii) gin, rum, vodka or whisky: 25 ml or 35 ml; and
(iii) still wine in a glass: 125 ml; and
(b) customers are made aware of the availability of these measures.
ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
The following conditions in Annex 2 are conditions consistent with the operating schedule submitted by the applicant within the application:
1. Premises licence BPL0340 shall be time-limited to have effect for the period from Friday 23 August 2013 until Monday 26 August 2013 (inclusive) and shall be for Lavenham Carnival 2013 only and no other purpose.
2. There shall be no off sales of alcohol under the authority of premises licence BPL0340 for Lavenham Carnival 2013.
3. The event shall be limited to not more than 5000 (five-thousand) persons at any one time. For the avoidance of doubt this total capacity limit includes the event management team, staff, crew, contractors, performers, artists and stallholders. Entrance to the main elements of the event, attracting an admission fee, shall be by ticket or programme only.
4. The premises licence holder shall create and implement an Event Management Plan (EMP) to promote the licensing objectives. A final version of the EMP and up to date site plans shall be sent by the premises licence holder to the Licensing Authority and all Responsible Authorities no later than 14 (fourteen) days prior to the day of the event. Any proposed revisions to the EMP shall be agreed in writing with the relevant Responsible Authority before the master EMP is updated - which shall be as soon as reasonably practicable following the revision being agreed. The premises licence, event management plan and risk assessments shall be kept with all other event documentation in the event control for the duration of the event and this location shall be clearly identified on the site plan (see plan attached as Annex 4 and EMP).
5. The event shall be managed by suitably experienced and competent persons. There shall be a team of volunteer stewards, who shall be fully briefed about their roles by the premises licence holder before commencement of the event.
6. The premises licence holder shall ensure that adequate provision of first aid and medical cover is in place for the duration of the event, and that marshalling for the event is in place. Signposting shall be prominent across the event site.
7. SIA accredited security staff shall be on duty for the duration of the Summer Ball and Pop Concert activities with security provision, deployment and timings to be risk assessed by the premises licence holder and confirmed within the Event Management Plan for the event.
8. The premises licence holder shall ensure that all temporary demountable structures used for the event - to include marquees, staging, funfair and jousting facilities - shall be erected, maintained and demounted by fully competent, and qualified where appropriate, persons.
9. There shall be no adult entertainment or services, activities, other entertainment or matters ancillary to the use of the premises that may give rise to concern in respect of children.
10. There shall be sufficient numbers of stewards on duty, and sufficient signposting to aid the public - including A2 sized maps and a site plan within the event programme.
11. The premises licence holder shall ensure that vehicular access for emergency vehicles is kept clear and unobstructed so as to allow the unimpeded and safe access and egress of such vehicles in an emergency situation.
12. Prior to the 26 August event, when vintage cars and stall holders shall be moving onto the site, the premises licence holder shall ensure that stewards suitably and sufficiently cordon off the area to prohibit pedestrian access and ensure the safe and orderly movement of attractions onto the event site. An on-site speed limit of not more than 15 miles per hour shall be implemented and clearly communicated.
13. The premises licence holder shall brief stewards of emergency plans, e.g. evacuation of site, containment of a problem area, temporary containment of the public to keep them away from a problem area, before commencement of each event as part of a training and briefing event plan for all stewards. The Event Management Plan shall be retained at the two emergency control points on the site (the Pavilion and the PA hut) as well as at Bronze Control in the Village Hall.
14. All stalls and attractions shall be required to confirm to the premises licence holder that they have obtained their own public liability insurance before they are allowed to attend, and only suitably and sufficiently trained and experienced individuals shall be used for the more active or higher risk events e.g. the jousting, fun fair, falconry, donkey rides and dog agility shows.
15. The premises licence holder shall ensure that neighbours and the community who may be affected by the activities of the event shall be kept promptly informed, with all reasonable steps and precautions to be taken by the premises licence holder to minimise any risk of causing public nuisance.
16. Noise levels shall be monitored for the duration of the event and limited to not exceed 120db (or any lower level found more appropriate by the monitoring). It is recommended that the volume levels of any music event shall be immediately decreased should an authorised officer of the Licensing Authority have cause to contact the event management due to noise complaints occurring during the event.
17. Stewards shall be fully briefed to monitor for unattended children, and the premises licence holder shall provide a lost children advisory page within the event programme and a clearly identified collection point to be specified both in the programme and event maps. Announcements shall be made over the PA system to reunite any lost children with their parent or guardian. It is recommended that the premises licence holder’s methodology for such announcements is considered carefully to ensure that adequate safeguards are in place to ensure that children are only handed over to their genuine carer. In the event of concerns in this regard, or collecting adults being considered unfit through drink or drugs, then the Police should be promptly summoned prior to any handover.
18. The premises licence holder shall ensure that a suitable safe distance is maintained between spectators and the jousting activity. The jousting ring shall be suitably secured and barriers erected by competent persons. Stewards shall be deployed and briefed to ensure that spectators, and particularly children, are unable to drift or cross into the arena.
