ANNEX 1 - MANDATORY CONDITIONS:
The following conditions in Annex 1 are mandatory under the provisions of the Licensing Act 2003:
1. Alcohol shall not be sold or supplied:
(a) At any time when there is no designated premises supervisor in respect of the
premises licence, or
(b) At any time when the designated premises supervisor does not hold a personal licence or his/her personal licence is suspended
2. Every sale or supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.
3. Where one or more individuals are being used at the licensed premises to carry out a security activity, each such individual must be licensed by the Security Industry Authority (unless where the individual is exempt from obtaining an SIA registration under the Private Security Industry Act 2001).
4. The admission of children to the exhibition of any film shall be restricted in accordance with the film classification awarded by the British Board of Film Classification (BBFC), or any successor person or persons designated as the authority under section 4 of the Video Recordings Act 1984.
ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE:
The following conditions in Annex 2 are conditions consistent with the operating schedule submitted by the applicant within the application:
1. Persons under the age of 18 shall not be permitted access to the bar.
2. Children shall not be permitted on the premises during the showing of any age restricted films or the performance of any age restricted plays.
3. There shall be no events carried on at the licensed premises involving nudity, semi-nudity or involving any other content that may be considered inappropriate or give rise to concern in respect of children.
4. All members of staff and of the management Committee shall be adequately Criminal Records Bureau checked and a training programme shall be conducted and kept up to date to incorporate drugs awareness, promotion of sensible drinking, responsible sale of alcohol and all other matters relevant to the promotion of the licensing objectives.
5. The licence holder shall actively participate in any local Safer Neighbourhood, Crime Reduction or similar schemes in operation in the locality of the licensed premises.
6. The licence holder shall actively participate in any local PubWatch or similar scheme and shall operate a ‘Challenge 21’ scheme in order to minimise the risk of underage sales.
7. In order to promote the prevention of crime and disorder, the licence holder shall:
(a) Install and maintain adequate intruder detection alarms and CCTV systems;
(b) Operate a secure entry system by use of key code or telephone entry, and provide for a system of ensuring that the licensed premises is adequately secured at all times;
(c) Install and maintain an adequate system of external lighting and safety lighting to the interior of the licensed premises;
(d) Ensure that the bar is operated on an over-18’s members only scheme incorporating a photo-identity card to be carried whilst members are on the premises;
(e) Ensure that bar stock shall be adequately secured in a locked cupboard and behind a steel mesh security grill installed at the bar counter;
(f) Prominently display and maintain ‘Rules of the Bar’ (incorporating a statement that drunken or disorderly behaviour shall not be tolerated) and also rules relating to membership. Rules of membership are to be read, signed and complied with by all members on all occasions;
(g) Ensure that plastic glasses are used for all drinks to be consumed in outdoor areas of the licensed premises; and
(h) Ensure that drugs and other prohibited substances are not permitted on the premises.
8. In order to promote public safety, the licence holder shall:
(a) Carry out a Fire Safety Risk Assessment on at least one occasion per annum and record the results;
(b) Carry out a general Risk Assessment of the premises on at least one occasion per annum and record the results;
(c) Provide hirers with full details of the terms and conditions of the premises licence, including any maximum permitted capacity, and also the procedures to be followed in the event of a fire or other emergency;
(d) Comply with all relevant fire regulations and health and safety regulations, including making sure that exits are clearly identified and signposted, fire safety/emergency procedure notices are prominently displayed and maintained and that any fire safety equipment is regularly checked;
(e) Ensure that a log book of safety checks is kept and that all checks conducted are recorded before events take place;
(f) Ensure that an appropriate first aid kit and incident book are kept and maintained on the licensed premises;
(g) Ensure that staff receive training on basic fire fighting and first aid; and
(h) Ensure that the car park area is adequately illuminated during the hours of darkness.
9. The licence holder shall ensure that all hirers of the licensed premises are advised to:
(a) Keep all fire exits and escape routes clear and free from obstruction (such as furniture or equipment), and to not wedge open fire doors;
(b) Keep all exit signs and emergency lighting turned on for the duration of any event;
(c) Ensure that there are no obvious fire hazards on the premises;
(d) Provide, in addition to the hirer, a minimum of 2 competent attendants to be on duty at the premises to assist people entering and leaving. No attendant for this purpose shall be under the age of than 18. If most of the audience/attendees are under 16, the number of attendants shall be not less than one per 50 children (or part thereof) present. All persons on duty shall have been instructed on their essential responsibilities in the event of fire or other emergency, including attention to disabled persons, the location and use of the fire fighting equipment available, how to call the fire brigade and the evacuation procedure;
(e) Ensure that the number of people on the premises at any time does not exceed the agreed capacity for seated or dancing audiences (as may be set in agreement with the Suffolk Fire and Rescue Service);
(f) Ensure the Fire Service is called to every outbreak of fire, however slight, and that details are given to the Booking Secretary;
(g) Ensure that no performances take place which may involve danger to the public;
(h) Not permit any highly flammable substances to be brought into, or used, in any part of the premises;
(i) Not erect decorations of a combustible nature, for example polystyrene or cotton wool, without the consent of the management committee;
(j) Not use unauthorised heating appliances when the premises are open to the public without the consent of the management committee. Portable Liquid Petroleum Gas appliances shall not be used;
(k) Not bring any portable electrical appliances onto the premises unless they have been Portable Appliance Tested; and
(l) Ensure that adequate arrangements are made for the safe evacuation of any disabled persons.
10. In order to promote the prevention of public nuisance, the licence holder shall:
(a) Install and maintain a sound volume limiter to ensure that music volume levels do not exceed an acceptable preset level;
(b) Ensure that air venting from the premises is designed so as to be away from the residential area;
(c) Minimise light pollution by using external sensor lighting to provide adequate lighting for safety but is only lit during the hours of darkness and is of a subtle nature;
(d) Appraise hirers of the licensing hours;
(e) Alert users of the premises to the car park which minimises the need for any on-road parking;
(f) Alert users of the premises to the convenience/accessibility of local bus services;
(g) Appraise hirers of the importance of avoiding creating a public nuisance when the premises are vacated;
(h) Display and maintain notices prominently on the licensed premises reminding users of the importance of leaving the premises quietly;
(i) Ensure that hirers are advised to ensure those leaving the premises at night do so quietly; and
(j) Ensure that hirers are advised to use any noise reduction equipment provided at the licensed premises.
11. In order to promote the protection of children from harm, the licence holder shall ensure that:
(a) Precautions are taken to provide premises which are, as far as possible, safe for use by children;
(b) All staff and Committee members are adequately Criminal Records Bureau checked including a POVA and POCA check;
(c) All children are to be excluded from the bar area (signage will be clearly displayed over the bar entrance);
(d) The kitchen and storage areas shall be areas to which children’s access is restricted;
(e) Storage cupboards containing cleaning materials shall be kept locked during times of public access;
(f) If children are using the premises facilities whilst the bar is open, that separate toilet facilities shall be made available;
(g) The premises garden is fenced and hedged to provide an enclosed area;
(h) Main entrance doors are lockable electronically to prevent children from straying from the building and also to prevent unauthorised persons gaining entry;
12. The licence holder shall ensure that all hirers of the licensed premises are advised that:
(a) No alcohol shall be supplied to those aged under 18;
(b) No drugs or prohibited substances shall be brought onto the premises;
(c) No gambling or entertainment of an adult or sexual nature shall be permitted;
(d) Sufficient adult supervisors shall be provided to protect children from harm;
(e) Appropriate instruction/training shall take place for those securing the protection of children from harm; and
(f) Any activities or conduct by users which may affect the physical, moral or psychological wellbeing of children shall not be permitted or tolerated under any circumstances.
