Christmas Eve and New Year’s Eve
Live and recorded music activities and performance of dance and similar activities may commence at 08:00hrs and cease by 00:30hrs on Christmas Eve or by 01:00hrs on New Year’s Eve. Supply of alcohol on such occasions may commence at 11:00hrs and cease by 00:30hrs on Christmas Eve or by 01:00hrs on New Year’s Eve.
ANNEX 1 - MANDATORY CONDITIONS
The following conditions in Annex 1 are mandatory under the provisions of the Licensing Act 2003:
1.1 Alcohol shall not be sold or supplied:
(a) At any time when there is no designated premises supervisor in respect of the
premises licence, or
(b) At any time when the designated premises supervisor does not hold a personal licence or his/her personal licence is suspended
1.2 Every sale or supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.
1.3 The admission of children to the exhibition of any film shall be restricted in accordance with the film classification awarded by the British Board of Film Classification (BBFC), or any successor person or persons designated as the authority under section 4 of the Video Recordings Act 1984.
1.4 Where one or more individuals are being used at the licensed premises to carry out a security activity, each such individual must be licensed by the Security Industry Authority (unless where the individual is exempt from obtaining an SIA registration under the Private Security Industry Act 2001).
1.5 The responsible person must ensure that staff on relevant premises do not carry out, arrange or participate in any irresponsible promotions in relation to the premises.
In this paragraph, an irresponsible promotion means any one or more of the following activities, or substantially similar activities, carried on for the purpose of encouraging the sale or supply of alcohol for consumption on the premises -
(a) games or other activities which require or encourage, or are designed to require or encourage, individuals to -
(i) drink a quantity of alcohol within a time limit (other than to drink alcohol sold or supplied on the premises before the cessation of the period in which the responsible person is authorised to sell or supply alcohol), or
(ii) drink as much alcohol as possible (whether within a time limit or otherwise);
(b) provision of unlimited or unspecified quantities of alcohol free or for a fixed or discounted fee to the public or to a group defined by a particular characteristic in a manner which carries a significant risk of undermining a licensing objective;
(c) provision of free or discounted alcohol or any other thing as a prize to encourage or reward the purchase and consumption of alcohol over a period of 24 hours or less in a manner which carries a significant risk of undermining a licensing objective;
(d) selling or supplying alcohol in association with promotional posters or flyers on, or in the vicinity of, the premises which can reasonably be considered to condone, encourage or glamorise anti-social behaviour or to refer to the effects of drunkenness in any favourable manner;
(e) dispensing alcohol directly by one person into the mouth of another (other than where that other person is unable to drink without assistance by reason of disability).
1.6 The responsible person must ensure that free potable water is provided on request to customers where it is reasonably available.
1.7 (a) The premises licence holder or club premises certificate holder must ensure that an age verification policy is adopted in respect of the premises in relation to the sale or supply of alcohol.
(b) The designated premises supervisor in relation to the premises licence must ensure that the supply of alcohol at the premises is carried on in accordance with the age verification policy.
(c) The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request,
before being served alcohol, identification bearing their photograph, date of birth and
either -
(i) a holographic mark, or
(ii) an ultraviolet feature.
1.8 The responsible person must ensure that -
(a) where any of the following alcoholic drinks is sold or supplied for consumption on the premises (other than alcoholic drinks sold or supplied having been made up in advance ready for sale or supply in a securely closed container) it is available to customers in the following measures -
(i) beer or cider: ½ pint;
(ii) gin, rum, vodka or whisky: 25 ml or 35 ml; and
(iii) still wine in a glass: 125 ml;
(b) these measures are displayed in a menu, price list or other printed material which is
available to customers on the premises; and
(c) where a customer does not in relation to a sale of alcohol specify the quantity of
alcohol to be sold, the customer is made aware that these measures are available.
1.9 The relevant person (the holder of the premises licence, the designated premises supervisor (if any) in respect of such a licence, the personal licence holder who makes or authorises a supply of alcohol under such a licence, or any member or officer of a club present on the premises in a capacity which enables the member or officer to prevent the supply in question) shall ensure that no alcohol is sold or supplied for consumption on or off the premises for a price which is less than the permitted price.
For the purposes of this condition “duty” is to be construed in accordance with the Alcoholic Liquor Duties Act 1979, “permitted price” is the price found by applying the formula -
P = D + (D x V)
where - (i) P is the permitted price, (ii) D is the rate of duty chargeable in relation to the alcohol as if the duty were charged on the date of the sale or supply of the alcohol, and (iii) V is the rate of value added tax chargeable in relation to the alcohol as if the value added tax were charged on the date of the sale or supply of the alcohol;
[“value added tax” means value added tax charged in accordance with the Value Added Tax Act 1994]
ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
The following conditions in Annex 2 are conditions consistent with the operating schedule submitted by the applicant within the application:
2.1 There shall be no adult entertainment or services, activities, other entertainment or matters ancillary to the use of the premises that may give rise to concern in respect of children.
2.2 The premises licence holder shall pro-actively engage with responsible authorities and local community policing in relation to promotion of the licensing objectives.
2.3 Supply of alcohol shall be subject to a ‘membership only’ scheme as determined by the premises licence holder.
2.4 To promote the prevention of crime and disorder licensing objective, the premises licence holder shall:
(a) install and maintain appropriate intruder detection alarm and CCTV equipment;
(b) secure entry to the premises via key code or telephone entry only and operate a rigorous checking system to ensure that the hall is locked and secure at all times;
(c) install and maintain light sensor external lighting to the building and overnight safety lighting to the interior of building;
(d) store alcohol and bar stock in a lockable cupboard behind lockable steel mesh security grills to the Bar counter;
(e) ensure that the Bar will operate a members’ only scheme with membership card to be carried whilst on premises;
(f) ensure that all staff shall be trained to become drug aware, to encourage sensible drinking, discourage over consumption of alcohol or drink-driving and ensure adherence to licensing objectives with regard to the responsible sale of alcohol at all times; and
(g) operate a zero tolerance policy towards drunken and disorderly behaviour implemented through its emphasis on prevention via ‘Rules of the Bar’ (which shall be displayed) and rules of membership which shall be read and signed by all members which must be abided by at all times.
2.5 To promote the public safety licensing objective, the premises licence holder shall:
(a) carry out a general and fire safety risk assessment at least annually and record the results;
(b) provide hirers with a copy of the licensing conditions, and details of maximum permitted safe capacity;
(c) alert users, including via written hirer’s copy and the use of prominent notices, to emergency evacuation procedures including assembly points;
(d) maintain a Safety Log Book which shall record checks undertaken before events, emergency exits, emergency lighting, presence of firefighting equipment etc.;
(e) ensure that notices will be provided detailing the action to be taken in case of fire or other emergency in the entrance hall and in each room and all hirers of the hall will be supplied with a written copy;
(f) ensure that an appropriate first aid kit and incident register are located in the Kitchen area of the licensed premises;
(g) ensure that relevant members of staff are trained to deal with basic first aid and public safety matters;
(h) ensure adequate illumination is installed covering the external car park areas during the hours of darkness, and whilst the premises are being used for a licensable event or hiring.
2.6 To promote the prevention of public nuisance licensing objective, the premises licence holder shall:
(a) install, operate and maintain a sound volume limiter to ensure that music volume levels do not exceed an acceptable preset level (note: it is recommended that the local Environmental Protection Team be consulted on what is an appropriate noise limit for the venue). At all licensed events staff shall be present to ensure this is adhered to;
(b) ensure that air venting from the premises is designed so it is away from the residential area;
(c) minimise light pollution by use of external sensor lighting which provides adequate lighting for safety but is only lit during hours of darkness and is of a subtle nature;
(d) ensure that hirers are appraised of the licensing hours and controls and of the need for attendees to leave the premises and locality quietly and with consideration to the needs of neighbouring properties; and
(e) ensure that hirers are alerted to any public transport provision in the locality of the premises;
(f) maintain prominent notices reminding users of the importance of leaving the premises quietly
2.7 To promote the protection of children from harm licensing objective, the premises licence holder shall:
(a) take all reasonable precautions to provide premises which are safe for the uses of children;
(b) vet relevant members of staff including by means of a Disclosure and Barring Service check (where the role or position is permissible to be checked);
(c) ensure that storage for cleaning materials shall be locked during public access hours;
(d) ensure that if children are using the hall facilities whilst the Members’ bar is open then separate toilet facilities shall be made available;
(e) ensure that the premises garden is fenced and hedged to provide an enclosed area; and
(f) ensure that main entrance doors can be locked to prevent children straying from the building and also to prevent unauthorised persons from gaining entry.
2.8 The premises licence holder shall, including via its hiring agreement, require hirers to comply with the premises licence restrictions and any other matters relevant to promotion of the licensing objectives as determined by the premises licence holder. This shall include, but is not limited to:
(a) monitoring and supervision of attendees behaviour;
(b) the numbers, ratio and minimum ages of attendants required to supervise the event;
(c) prohibition on alcohol or illegal drugs being brought onto the premises;
(d) maintaining a safe environment, and ensuring escape and emergency routes are kept free from obstruction or hazard;
(e) awareness of public safety measures, including maximum capacity, fire safety and evacuation procedures;
(f) instruction and use of any noise limiter equipment provided by the premises licence holder;
(g) child protection matters; and
(h) main licensing offences including prohibition on the sale of alcohol to under 18s.
ANNEX 3 - CONDITIONS ATTACHED AFTER A HEARING BY THE LICENSING AUTHORITY
None applicable to premises licence BPL0352-2015
