ANNEX 1 - MANDATORY CONDITIONS
The following conditions in Annex 1 are mandatory under the provisions of the Licensing Act 2003:
1.1 Alcohol shall not be sold or supplied:
(a) At any time when there is no designated premises supervisor in respect of the
premises licence, or
(b) At any time when the designated premises supervisor does not hold a personal licence or his/her personal licence is suspended
1.2 Every sale or supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.
1.3 Where one or more individuals are being used at the licensed premises to carry out a security activity, each such individual must be licensed by the Security Industry Authority (unless there is any exemption afforded to the relevant individual(s) by the Private Security Industry Authority Act 2001 (as amended)).
ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
The following conditions in Annex 2 are conditions consistent with the operating schedule submitted by the applicant within the application:
2.1 The licence holders shall observe all relevant legislative requirements, and operate the event in accordance with the ‘Event Risk Assessments’ (Ref: Harvest 2009-RA01), ‘Event Safety Management Plan’, ‘Medical Plan’, ‘Event Guidance’ and ‘Caterers & Traders Information’ documentation provided with the application as part of the operating schedule and to promote the licensing objectives. These documents are attached hereto. In addition, the licence holders shall have due regard to any recommendations made by responsible authorities to ensure that the event is run in such a way so as to promote of the licensing objectives.
2.2 The licence holders shall ensure that:
(a) all marquee equipment will be erected by competent trained persons from the marquee supplier and will be erected to manufacturers specifications in accordance with the MUTAmarq guidance document ‘Safe Use and Operation of Marquees and Temporary Structures’;
(b) all materials will be manufactured to either BS 3120 or new materials flame retarding fabric tested to BS 5438 Test 2A and 2B;
(c) the structure will conform to BS EN 13782: 2005 ‘Temporary Structures - Tents - Safety’;
(d) the supplier’s hire stock will meet the standards laid down by PERTEXA (MUTAmarq) ‘Code of Public Safety and Home Office Requirements’ expressed in Circular DCOL/14/1995 to Chief Fire Officers. The hire stock will be certificated by PERTEXA (Cert Number 328/2004) as being flame retardant and inspected as such;
(e) all windload calculations, method statements and Risk Assessments are provided to the local Environmental Protection Officer (EPO) as soon as the supplier is taken on but notwithstanding this all calculations shall be provided to the EPO at least 31 days prior to the first day of the event; and
(f) the marquees hired for the event will have the ability for double guying in the event of unusually high winds.
ANNEX 3 - CONDITIONS ATTACHED AFTER A HEARING BY THE LICENSING AUTHORITY
