ANNEX 1 - MANDATORY CONDITIONS
The following conditions in Annex 1 are mandatory under the provisions of the Licensing Act 2003:
1.1 Alcohol shall not be sold or supplied:
(a) At any time when there is no designated premises supervisor in respect of the
premises licence, or
(b) At any time when the designated premises supervisor does not hold a personal licence or his/her personal licence is suspended
1.2 Every sale or supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.
1.3 Where one or more individuals are being used at the licensed premises to carry out a security activity, each such individual must be licensed by the Security Industry Authority (unless where the individual is exempt from obtaining an SIA registration under the Private Security Industry Act 2001).
1.4 The admission of children to the exhibition of any film shall be restricted in accordance with the film classification awarded by the British Board of Film Classification (BBFC), or any successor person or persons designated as the authority under section 4 of the Video Recordings Act 1984.
1.5 The responsible person shall take all reasonable steps to ensure that staff on relevant premises do not carry out, arrange or participate in any irresponsible promotions in relation to the premises.
In this condition, an irresponsible promotion means any one or more of the following activities, or substantially similar activities, carried on for the purpose of encouraging the sale or supply of alcohol for consumption on the premises in a manner which carries a significant risk of leading or contributing to crime and disorder, prejudice to public safety, public nuisance, or harm to children -
(a) games or other activities which require or encourage, or are designed to require or
encourage, individuals to -
(i) drink a quantity of alcohol within a time limit (other than to drink alcohol sold or
supplied on the premises before the cessation of the period in which the responsible
person is authorised to sell or supply alcohol), or
(ii) drink as much alcohol as possible (whether within a time limit or otherwise);
(b) provision of unlimited or unspecified quantities of alcohol free or for a fixed or
discounted fee to the public or to a group defined by a particular characteristic (other than
any promotion or discount available to an individual in respect of alcohol for
consumption at a table meal, as defined in section 159 of the Act);
(c) provision of free or discounted alcohol or any other thing as a prize to encourage or
reward the purchase and consumption of alcohol over a period of 24 hours or less;
(d) provision of free or discounted alcohol in relation to the viewing on the premises of a
sporting event, where that provision is dependent on -
(i) the outcome of a race, competition or other event or process, or
(ii) the likelihood of anything occurring or not occurring;
(e) selling or supplying alcohol in association with promotional posters or flyers on, or in the
vicinity of, the premises which can reasonably be considered to condone, encourage or
glamorise anti-social behaviour or to refer to the effects of drunkenness in any favourable
manner.
1.6 The responsible person shall ensure that no alcohol is dispensed directly by one person into the mouth of another (other than where that other person is unable to drink without assistance by reason of a disability).
1.7 The responsible person shall ensure that free tap water is provided on request to customers where it is reasonably available.
ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
The following conditions in Annex 2 are conditions consistent with the operating schedule submitted by the applicant within the application:
2.1 The licence holders shall observe all relevant legislative requirements, and operate the event in accordance with the ‘Event Safety Management Plan’ (which may continue to be updated up until the commencement of the event and shall incorporate agreements between the licence holders and all responsible authorities), with the final version to be retained on site in hard copy format.
2.2 The licence holders shall ensure that:
(a) the event is being run in accordance with guidelines set out in HSE195 (the ‘Purple Guide’);
(b) the event management team and contractors shall have experience commensurate with the nature and scale of the event, in order to ensure that at all times for the duration of the event it is managed safely and securely for all staff, employees, attendees and artists;
(c) a licensed and accredited security contractor shall be employed to oversee general public safety, and this shall be in operation 24/7 for the duration of the event;
(d) adequate levels and timings of Policing are maintained as agreed between the licence holders and Suffolk Constabulary;
(e) the event site shall be fenced and adequately lit to promote the prevention of crime and disorder - note it may be prudent to seek advice from the Environmental Protection Officer to minimise any risk of public nuisance caused by light pollution (see also condition 2.3.24);
(f) CCTV is operated and maintained throughout the site at various levels. It is recommended that recordings be retained for a minimum of 28 days after the event has finished;
(g) there shall be a minimum of one dedicated and suitably qualified Health and Safety Officer on site for the duration of the event;
(h) all contractors on site shall be correctly qualified and trained;
(i) relevant signage is displayed and maintained on site, including signage to promote the public safety objective;
(j) a professional noise management consultant and professional traffic management company shall be employed to promote the prevention of public nuisance and ensure minimal disruption to persons in the vicinity of the licensed venue;
(k) adequate traffic management steps are taken, including temporary speed limits and special traffic management systems to aid control of parking and flow of traffic;
(l) adequate on-site and off-site wireless noise level meters shall be used in order to allow responsive control of all noise sources;
(m) there shall be a dedicated children’s area with facilities specifically for children. All staff in such areas shall be adequately CRB vetted, and there shall be strict controls put in place and maintained to address access arrangements for parents/guardians and other persons;
(n) the event security team shall also have CRB vetting for those working with children, and babysitting and nappy changing facilities shall be available;
(o) all parents/guardians attending the event shall be required to tag their children with a provided wristband - with contact mobile phone numbers to be written on the tag to assist with returning any lost children promptly to their parent or guardian. Lost children shall be accompanied by a minimum of two CRB vetted staff at all times until they are safely returned to their parent/guardian;
(p) any films shown on site during the event shall be suitable for the age range of the audience - see also mandatory condition 1.4 of premises licence BPL0355;
(q) any music (acoustic and amplified) and amplified speech in respect of plays should be performed at the minimum intensity for the enjoyment of the audience in order to promote the prevention of public nuisance licensing objective;
(r) the maximum audience capacity at the open air stage venue shall be 7,500 persons (or other safe maximum as agreed with the Fire Safety Officer);
(s) the open air music venue shall cease licensable activity by 22:30hrs on both days of the event;
(t) Late night refreshment activity shall be for campers/guests only;
(u) Main bars shall close at 22:30hrs on Saturday 11th September 2010. The only bar remaining open beyond 22:30hrs shall be the later night venue serving campers/guests only. All alcohol outlets shall close by 22:30hrs on Sunday 12th September 2010;
(v) Non-camping ticket holders shall be required to be off the site overnight;
(w) The applicant shall make available for inspection, suitable and sufficient written health and safety risk assessments for all proposed activities, no later than 26th August 2010 (note: this may be as part of the Event Safety Management Plan document); and
(x) Brand experience alcohol outlets shall be limited to no more than two, being identified by the licence holder as the ‘Monkey Shoulder treehouse’ whiskey bar and ‘Angastura Rum’ promotion. Both shall cease activity by 22:30hrs on each day of the event.
2.3 In respect of noise control and prevention of public nuisance caused by lighting, the licence holders shall ensure that:
1. They shall comply with the requirements of the Licensing Authority with regard to the installation and operation of all sound amplification and public address systems. This shall include the setting of noise output levels and the provision of noise measuring equipment.
2. Noise control for the event shall be based on the following principles:
(a) Orientation of the main stage and sound system shall be as specified in the application (and Annex 4 Plan);
(b) An even distribution of sound in the Music Stage arena, at the minimum intensity for the enjoyment of the audience.
(c) The quality of sound shall be maintained to avert any need to compensate for any loss of clarity with increased volume;
3. The following limitations shall be complied with:
(a) Between 09:00hrs and 22:30hrs the Music Noise Level shall not exceed 53db(A) (LAeq 15mins) as measured at 1m from the façade of any Noise Affected Premises;
(b) Between 09:00hrs and 22:30hrs the Maximum Sound Pressure Level (LMax) shall not exceed 70dB in either the 63Hz or 125Hz octave frequency bands as measured at 1m from the façade of any Noise Affected Premises;
(c) Between 22:30hrs and 02:00hrs the Music Noise Level shall not exceed 40db(A) (LAeq 15mins) as measured at 1m from the façade of any Noise Affected Premises;
(d) Between 22:30hrs and 02:00hrs the Music Noise Level shall not exceed 42db(A) (LAeq 1min) as measured at 1m from the façade of any Noise Affected Premises;
(e) Between 22:30hrs and 02:00hrs the LZeq(15) shall not exceed 55dB in either the 63Hz or 125Hz octave frequency bands as measured at 1m from the façade of any Noise Affected Premises.
(f) The Music Noise Level at the front of house consoles shall in any case not exceed 98dB (LAeq 15 mins) and the Maximum Sound Pressure Level (LMax) at any point in an audience shall not exceed 140dB.
(g) In Conditions 2.3.3(a) to 2.3.3(f) inclusive, the term “Music Noise Level” shall be as defined in the “Code of Practice on Environmental Noise Control at Concerts”, The Noise Council, 1995.
4. The Premises Licence Holder shall ensure that members of the audience in the Main Stage or Disco Tent are not allowed within 3 metres of any loudspeaker.
5. The appointed Sound Management Consultant shall be on site for the duration of the festival and be available to control all music sound levels.
6. The installation of sound amplification and public address systems shall be completed no later than 14:00hrs on 10 September 2010 in order to allow for sound testing and any necessary adjustments. Times of testing shall be as specified in the Event Safety Management Plan submitted with the licence application.
7. A noise propagation test shall be undertaken between 14:00hrs and 17:00hrs on 10 September 2010 in order to set appropriate control limits at the sound mixer position for the Main Stage and Disco Tent. The sound systems shall be configured and operated in a similar manner as intended for the event. The sound source used for the test shall be similar in character to the music likely to be produced during the event.
8. Noise propagation and sound checks on sound amplification systems shall only be carried out during the time periods specified in Appendix F of the Event Management Plan submitted with the licence application. The duration of any such checks at the Music Stage arena or Disco Tent shall not exceed 30 minutes per location on each day of the event. The noise limits expressed in Condition 2.3.3 above shall be adhered to during any noise or sound checks.
9. The Premises Licence Holder’s sound amplification systems shall not be used after the permitted hours of musical entertainment on any day of the event for the relaying of music or for any other purpose except for emergency announcements relating to public order and safety. The Premises Licence Holder shall make all reasonable endeavours to ensure that no noise nuisance is caused by other sound amplification systems during the event.
10. All systems of sound amplification and reproduction through the public address system shall remain under the control of the Premises Licence Holder, except where that control has been assumed by an authorised officer of the Licensing Authority or the emergency services in accordance with the Emergency Contingency Plan.
11. The Premises Licence Holder shall provide means of communication to enable contact to be made between the Sound Management Consultant and all sound control consoles on site.
12. The Premises Licence Holder shall ensure that the Sound Management Consultant, sound system supplier and all individual sound engineers are informed of the sound control limits prior to the commencement of regulated entertainment and that instructions from the noise control consultant/chief sound engineer regarding noise levels shall be implemented.
13. Means of communication shall be provided to enable contact to be made between officers of the Licensing Authority and any person in control of noise source on the licensed premises.
14. During operating hours, the Premises Licence Holder or nominated assistant shall be available to receive and respond to nuisance-related complaints. A contact number shall be readily available for that purpose.
15. The Premises Licence Holder shall take all reasonable steps to ensure that noise levels from all of the activities taking place during the event are controlled to ensure compliance with the conditions relating to noise control.
16. All reasonable steps shall be taken by the Premises Licence Holder to prevent noise from fireworks and other explosives (e.g. gas cylinders). The Premises Licence Holder shall implement a policy to ensure the confiscation of fireworks and for ejecting persons behaving dangerously or causing a disturbance relating to the use of fireworks or explosion of gas cylinders.
17. Clearly legible and suitable notices shall be displayed and maintained at the event exits, requesting customers to respect the needs of local residents and to leave the premises and area quietly. Sufficient staff shall be available at the main event exits after 22:30hrs, to ensure that customers disperse quietly.
18. The Premises Licence Holder or noise control consultant/chief sound engineer will make available to the Licensing Authority data relating to the noise levels being produced from the Music Stage arena and Disco Tent, if so required.
19. The Premises Licence Holder shall put in place reasonable procedures for minimising disturbance to residents arising from noise emanating from the campsites. This will include the presence of 24-hour stewarding and security for the duration of the event.
20. The Premises Licence Holder will implement procedures for dealing with campsite noise as agreed with the Licensing Authority.
21. The Music Noise Level or sound configuration of amplified music shall be turned down or adjusted at the direct request (either in person or over the telephone) of an authorised officer of the Licensing Authority providing that the noise levels exceed the limits specified in Conditions 2.3.3(a) to 2.3.3(f) inclusive.
22. Officers authorised by the Licensing Authority shall be given unfettered access to all areas of the licensed premises where necessary for the purposes of monitoring compliance with the licence conditions.
23. The Premises Licence Holder shall ensure that the requirements of the Event Safety Management Plan and Sound Management Method Statement submitted with the licence application are implemented and adhered to at all time during the licensed event.
Lighting Controls
24. The Premises Licence Holder shall ensure that the lighting installed at the licensed venue and the campsites are designed and orientated in such a manner as not to cause nuisance to the surrounding residents (see also condition 2.2.(e)).
