ANNEX 1 - MANDATORY CONDITIONS
The following conditions in Annex 1 are mandatory under the provisions of the Licensing Act 2003:
1.1 Alcohol shall not be sold or supplied:
(a) At any time when there is no designated premises supervisor in respect of the
premises licence, or
(b) At any time when the designated premises supervisor does not hold a personal licence or his/her personal licence is suspended
1.2 Every sale or supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.
1.3 Where one or more individuals are being used at the licensed premises to carry out a security activity, each such individual must be licensed by the Security Industry Authority (unless where the individual is exempt from obtaining an SIA registration under the Private Security Industry Act 2001).
1.4 The admission of children to the exhibition of any film shall be restricted in accordance with the film classification awarded by the British Board of Film Classification (BBFC), or any successor person or persons designated as the authority under section 4 of the Video Recordings Act 1984.
1.5 The responsible person shall take all reasonable steps to ensure that staff on relevant premises do not carry out, arrange or participate in any irresponsible promotions in relation to the premises.
In this paragraph, an irresponsible promotion means any one or more of the following activities, or substantially similar activities, carried on for the purpose of encouraging the sale or supply of alcohol for consumption on the premises in a manner which carries a significant risk of leading or contributing to crime and disorder, prejudice to public safety, public nuisance, or harm to children -
(a) games or other activities which require or encourage, or are designed to require or
encourage, individuals to -
(i) drink a quantity of alcohol within a time limit (other than to drink alcohol sold or
supplied on the premises before the cessation of the period in which the responsible
person is authorised to sell or supply alcohol), or
(ii) drink as much alcohol as possible (whether within a time limit or otherwise);
(b) provision of unlimited or unspecified quantities of alcohol free or for a fixed or
discounted fee to the public or to a group defined by a particular characteristic (other than
any promotion or discount available to an individual in respect of alcohol for
consumption at a table meal, as defined in section 159 of the Act);
(c) provision of free or discounted alcohol or any other thing as a prize to encourage or
reward the purchase and consumption of alcohol over a period of 24 hours or less;
(d) provision of free or discounted alcohol in relation to the viewing on the premises of a
sporting event, where that provision is dependent on -
(i) the outcome of a race, competition or other event or process, or
(ii) the likelihood of anything occurring or not occurring;
(e) selling or supplying alcohol in association with promotional posters or flyers on, or in the
vicinity of, the premises which can reasonably be considered to condone, encourage or
glamorise anti-social behaviour or to refer to the effects of drunkenness in any favourable
manner.
1.6 The responsible person shall ensure that no alcohol is dispensed directly by one person into the mouth of another (other than where that other person is unable to drink without assistance by reason of a disability).
1.7 The responsible person shall ensure that free tap water is provided on request to customers where it is reasonably available.
1.8 (a) The premises licence holder or club premises certificate holder shall ensure that an age verification policy applies to the premises in relation to the sale or supply of alcohol.
(b) The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and a holographic mark.
1.9 The responsible person shall ensure that -
(a) where any of the following alcoholic drinks is sold or supplied for consumption on the
premises (other than alcoholic drinks sold or supplied having been made up in advance
ready for sale or supply in a securely closed container) it is available to customers in the
following measures -
(i) beer or cider: ½ pint;
(ii) gin, rum, vodka or whisky: 25 ml or 35 ml; and
(iii) still wine in a glass: 125 ml; and
(b) customers are made aware of the availability of these measures.
ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
The following conditions in Annex 2 are conditions consistent with the operating schedule submitted by the applicant within the application:
GENERAL STEPS TO PROMOTE THE LICENSING OBJECTIVES
2.1 The event site shall be constructed as indicated on the approved plan (attached as Annex 4), save for any amendments that are subsequently agreed with the licensing authority or a responsible authority. Where any such amendments are made, the latest version of the site plan shall be promptly incorporated within the Event Management Plan (EMP).
2.2 A dynamic event management plan (EMP) shall be prepared and maintained to direct the management and control of the event. A copy of the EMP shall be kept at the event control room and shall contain:
(a) General operational procedures for the event;
(b) The organisational structure of the event;
(c) A site layout plan for the event (see also 2.1 above);
(d) Details of the proposed event promotional and ticketing arrangements;
(e) An outline of the strategy to be deployed to safeguard the public during ingress and egress at the event site;
(f) Details of waste management strategy and procedures;
(g) An assessment of any special effects and control measures that will be implemented;
(h) An assessment of first aid requirements and details of provision;
(i) An assessment of sound generation and control measures that will be implemented;
(j) An assessment of the types of audience behaviour anticipated;
(k) Details of the sound management measures to be implemented;
(l) Details of any full scale evacuation plan;
(m) Details of traffic management to and from the event;
(n) Security measures to be implemented, including staffing levels and competencies;
(o) Details of crime reduction measures to be implemented;
(p) Details of the communication facilities to be provided; and
(q) Contact details for senior staff who might reasonably need to be contacted by a responsible authority or the licensing authority during the course of the event.
2.3 A premises log book shall be maintained on site to record the following matters. Where any separate arrangements have been made for alternate recording methods these shall be clearly referenced within the event management documentation.
(a) Incidents of crime and disorder and action taken;
(b) Incidents where an under aged person has attempted to purchase alcohol;
(c) Incidents of drug abuse and action taken;
(d) Incidents where drugs are seized;
(e) All emergency testing, i.e. fire alarm, emergency lighting, staff fire drills and fire extinguisher tests etc.
(f) Details of door supervisors, including details of staff and time on duty;
(g) Records of noise checks;
(h) Staff training;
(i) Lost and found items;
(j) Security patrols;
(k) Refusals of searches;
(l) All ejections from the premises;
(m) Review of all security procedures; and
(n) All incidents involving first aid treatment.
2.4 All members of staff shall receive the following training if relevant to the activity for which they are employed:
(a) General licensing law
(b) General crime prevention
(c) Dealing with drug misuse
(d) Dealing with disorder
(e) Fire and evacuation procedures
(f) Preventing underage drinking
(g) Health and safety
2.5 Access and egress arrangements shall be maintained for police, fire and medical vehicles and personnel whilst the public are on the premises.
PREVENTION OF CRIME AND DISORDER
2.6 Access to the event by the public shall be by ticket only. Access control arrangements shall be put into place, including the installation of a fenced security perimeter around the site.
2.7 Primary access for the public to the site shall only be at those locations marked “D” or “E” on the approved plan (see Annex 4 and Event Management Plan). If required, secondary access shall be made available at point “A”.
2.8 Access shall be refused to any individual that is identified to the event organisers by the police as presenting a significant risk to the safety of the public, the protection of children from harm or is likely to participate in crime or disorder.
2.9 Security staff shall be provided to monitor and control the site as outlined in the Event Management Plan.
2.10 All security personnel on duty shall wear clothing and/or identification tabs that clearly identify them as SIA registered door-staff - distinct from all stewards and other staff.
2.11 Random and targeted searches shall take place of the public entering the event.
2.12 Any item which is found to be in the possession of a searched individual, which it would be unlawful for them to possess, shall be confiscated and reported to the police.
2.13 Any item that is confiscated shall be retained in a secure location to which only nominated individuals have access.
2.14 No sale of alcohol shall take place in a single open vessel, intended for consumption by one individual, which contains more than 4 units of alcohol.
2.15 Suitable and sufficient measures shall be put in place to prevent members of the public from bringing alcohol into the licensed premises.
2.16 The maximum number of persons attending the event at any one time shall not exceed 12,500.
PUBLIC SAFETY
2.17 Public safety issues are addressed by virtue of the Health and Safety at Work etc. Act 1974 and the Regulatory Reform (Fire Safety) Order 2005. In achieving compliance with these, the event management shall be implementing the following measures:
(a) members of the public shall be prohibited from bringing glassware into the main event arena;
(b) sales of beverages intended for consumption on the premises shall not be made other than in tempered, shatterproof, plastic or paper vessels;
(c) First Aid facilities shall be provided, having regard to current nationally recognised and adopted guidance;
(d) medical attention shall be sought for any customer or member of staff who appears ill or incapacitated in any way;
(e) records of all first aid interventions and accidents shall be recorded in the premises log book or a separate first aid log book (see also condition 2.3 above);
(f) electrical systems shall be designed to prevent danger and circuits in the open air shall be protected by a suitable and sufficient residual current device (RCD);
(g) emergency exits shall be provided at the locations marked on the approved plan (see Annex 4 and Event Management Plan). In the event that an evacuation has to be undertaken of the entire site, advice shall be taken from the emergency services if this is reasonably practicable at the time; and
(h) an access route (a ‘red route’) shall be maintained for vehicles operated by an emergency service who are responding to an emergency, indicated on the approved plan at point “H”.
2.18 For the purpose of securing the safety of the public who will attend the event, the premises licence holder shall have due regard at all times, so far as is reasonably practicable, to relevant standards, guidance and best practices specified for public safety in HSG 195 (The Event Safety Guide - A guide to health, safety and welfare at music and similar events), as far as it applies to this type of event.
2.19 Where it is not possible for the premises licence holder to adhere to HSG 195, due to there being no relevant specified standard or guidance, then the premises licence holder shall have due regard to the next best-suited Health and Safety Executive published relevant guidance for public safety relevant to this type of event.
PREVENTION OF PUBLIC NUISANCE OF PUBLIC NUISANCE
2.20 No music shall be played in the open air between 23:00hrs and 10:00hrs the following day, unless forming part of authorised children’s activities between 09:00hrs and 10:00hrs.
2.21 No live or recorded music, other than sound tests/checks, shall be played on the Main Stage on Friday 9 September 2011. Any such sound tests/checks shall be carried out in accordance with the following conditions 2.24(a) to 2.24(f):
2.22 The premises licence holder shall:
(a) take all reasonable steps to ensure that noise levels from all of the licensed activities taking place during the event are controlled to ensure compliance with the conditions relating to noise control; and
(b) appoint a competent, professional Sound Management Consultant to promote the prevention of public nuisance from noise and to ensure minimal disruption to persons in the vicinity of the licensed venue.
2.23 Noise control for the event shall be based on the following principles or measures:
(a) any music (acoustic or amplified) or amplified speech in respect of any of the licensed activities shall be transmitted at the minimum intensity for the enjoyment of the audience in order to promote the prevention of public nuisance licensing objective;
(b) the orientation of the main stage and sound system shall be as specified in the application (and Site Plan HAJ11 - v7);
(c) an even distribution of sound in the Music Stage arena and the Disco Tent (‘The Late Lounge’), at the minimum intensity for the enjoyment of the audience; and
(d) the quality of sound shall be maintained to avert any need to compensate for any loss of clarity with increased volume.
2.24 The following noise control limits shall be complied with (for the avoidance of doubt, these supersede any noise limits proposed by the premises licence holder within their application for the premises licence):
(a) between 11:00hrs and 23:00hrs the Music Noise Level shall not exceed 55dB(A) (LAeq 15mins) as measured at 1m from the façade of any Noise Affected Premises;
(b) between 11:00hrs and 23:00hrs the Leq (15mins) sound level shall not exceed 70dB in either the 63Hz or 125Hz octave frequency bands as measured at 1m from the façade of any Noise Affected Premises at a distance of 2km and beyond the site;
(c) between 23:00hrs and 02:00hrs the Music Noise Level shall not exceed 40db(A) (LAeq 15mins) as measured at 1m from the façade of any Noise Affected Premises;
(d) between 23:00hrs and 02:00hrs the Music Noise Level shall not exceed 42db(A) (LAeq 1min) as measured at 1m from the façade of any Noise Affected Premises;
(e) between 23:00hrs and 02:00hrs the LZeq (15mins) shall not exceed 55dB in either the 63Hz or 125Hz octave frequency bands as measured at 1m from the façade of any Noise Affected Premises at a distance of 2km and beyond from the site; and
(f) the Music Noise Level at the front of house consoles shall in any case not exceed 98dB (LAeq 15 mins) and the Maximum Sound Pressure Level (LMax) at any point in an audience shall not exceed 140dB.
In Conditions 2.24(a) to 2.24(f) inclusive, the term “Music Noise Level” shall be as defined in the “Code of Practice on Environmental Noise Control at Concerts”, The Noise Council, 1995.
2.25 The premises licence holder shall ensure that members of the audience in the Main Stage or Disco Tent (‘The Late Lounge’) are not allowed within 3 (three) metres of any loudspeaker.
2.26 The appointed Sound Management Consultant shall be on site for the duration of the festival whenever music is being played and be available to control all music sound levels. Adequate on-site and off-site wireless, Type 1 Sound Level Meters shall be used in order to allow responsive control of all noise sources.
2.27 The installation of sound amplification and public address systems shall be completed no later than 14:00hrs on Friday 9 September 2011 in order to allow for sound testing and any necessary adjustments.
2.28 A noise propagation test shall be undertaken between 14:00hrs and 16:00hrs on 9 September 2011 in order to set appropriate control limits at the sound mixer position for the Main Stage and Disco Tent (‘The Late Lounge’). The sound systems shall be configured and operated in a similar manner as intended for the event. The sound source used for the test shall be similar in character to the music likely to be produced during the licensed event.
2.29 The duration of any noise propagation or sound checks at the Music Stage arena or Disco Tent (‘The Late Lounge’) shall not exceed 30 minutes per location on each day of the event. The noise limits expressed in condition 2.24 above shall be adhered to during any noise propagation or sound checks.
2.30 The premises licence holder’s sound amplification systems shall not be used after the permitted hours of musical entertainment on any day of the event for the relaying of music or for any other purpose except for emergency announcements relating to public order and safety. The premises licence holder shall take all reasonable steps to ensure that no noise nuisance is caused by other sound amplification systems during the event.
2.31 All systems of sound amplification and reproduction through the public address system shall remain under the control of the premises licence holder, except where that control has been assumed by an authorised officer of the Licensing Authority or the emergency services in accordance with the Emergency Contingency Plan.
2.32 The premises licence holder shall provide means of communication to enable contact to be made between the Sound Management Consultant and all sound control consoles on site.
2.33 The premises licence holder shall ensure that the Sound Management Consultant, sound system supplier and all individual sound engineers are informed of the sound control limits prior to the commencement of licensed regulated entertainment activities and that instructions from the noise control consultant/chief sound engineer regarding noise levels shall be implemented.
2.34 Means of communication shall be provided to enable contact to be made between officers of the Licensing Authority and any person in control of noise sources on the licensed premises. For this purpose, the premises licence holder shall provide the Licensing Authority with:
(a) telephone numbers for their nominated representative(s) and the appointed Sound Management Consultant at least 3 (three) days prior to the commencement of the event; and
(b) a telephone number which may be given to members of the public wishing to complain directly to or otherwise contact the premises licence holder. This telephone number shall be provided at least 3 (three) days prior to the commencement of the event.
The telephone lines listed in 2.34(a) and (b) shall be continuously manned during the licensed operating hours of the event.
2.35 The premises licence holder’s nominated representative(s) shall have the authority to require the immediate reduction of amplified sound levels from all licensed activities on all parts of the site.
2.36 The premises licence holder shall take all reasonable steps to ensure that noise levels from all of the activities taking place during the event are controlled to ensure compliance with the conditions relating to noise control.
2.37 All reasonable steps shall be taken by the premises licence holder to prevent noise from fireworks and other explosives (e.g. gas cylinders). The premises licence holder shall implement a policy to ensure the confiscation of fireworks and for ejecting persons behaving dangerously or causing a disturbance relating to the use of fireworks or explosion of gas cylinders.
2.38 Suitable and clearly legible notices shall be displayed and maintained at the event exits, requesting customers to respect the needs of local residents and to leave the premises and area quietly. Sufficient numbers of staff shall be available at the main event exits after 22:30hrs, to ensure that customers disperse quietly.
2.39 The premises licence holder or noise control consultant/chief sound engineer shall make available to the Licensing Authority data relating to the noise levels being produced from the Music Stage arena and Disco Tent (‘The Late Lounge’), if so required.
2.40 The premises licence holder shall put in place reasonable procedures for minimising disturbance to residents arising from noise emanating from the campsites. This shall include the presence of 24-hour stewarding and security for the duration of the event.
2.41 The premises licence holder shall implement procedures for dealing with campsite noise as agreed with the Licensing Authority.
2.42 The Music Noise Level or sound configuration of amplified music shall be turned down or adjusted at the direct request (either in person or over the telephone) of an authorised officer of the Licensing Authority providing that the noise levels exceed the limits specified in conditions 2.24(a) to 2.24(f) inclusive.
2.43 Officers authorised by the Licensing Authority shall be given unfettered access to all areas of the licensed premises where necessary for the purposes of monitoring compliance with the licence conditions.
2.44 The premises licence holder shall ensure that the requirements of the Event Management Plan (EMP) and Sound Management Method Statement submitted with the licence application are implemented and adhered to at all time during the licensed event.
2.45 The event site and the campsites shall be adequately lit to promote the prevention of crime and disorder and shall be designed and orientated in such a manner so as to not cause nuisance to surrounding residents.
PROTECTION OF CHILDREN FROM HARM
2.46 Children shall not be permitted access to the licensed site unless accompanied by a person aged 18 years or over.
2.47 Suitable and sufficient measures shall be put into place to reunite children on the site who have become misplaced from their accompanying adult. These shall include a designated point which shall be staffed by individuals who have been subject to a recent and satisfactory enhanced criminal records check.
2.48 A ‘Challenge 21’ scheme shall be adopted and operated at the licensed event, and ‘Challenge 21’ notices shall be displayed and maintained at the premises in areas where alcohol is sold or supplied.
2.49 All staff engaged in the sale and supply of alcohol shall be trained to accept only the following as proof of age:
o a passport;
o a photo driving licence; or
o identity card bearing the ‘PASS’ hologram.
2.50 The date on which a person would have had to have been born on, or before, to be aged 18 or over shall be prominently displayed on all tills at the premises which are used for the sale or supply of alcohol.
ANNEX 3 - CONDITIONS ATTACHED AFTER A HEARING BY THE LICENSING AUTHORITY
