ANNEX 1 - MANDATORY CONDITIONS
The following conditions in Annex 1 are mandatory under the provisions of the Licensing Act 2003:
1.1 Alcohol shall not be sold or supplied:
(a) At any time when there is no designated premises supervisor in respect of the
premises licence, or
(b) At any time when the designated premises supervisor does not hold a personal licence or his/her personal licence is suspended
1.2 Every sale or supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.
1.3 Where one or more individuals are being used at the licensed premises to carry out a security activity, each such individual must be licensed by the Security Industry Authority (unless there is any exemption afforded to the relevant individual(s) by the Private Security Industry Authority Act 2001 (as amended)).
1.4 The admission of children to the exhibition of any film shall be restricted in accordance with the film classification awarded by the British Board of Film Classification (BBFC), or any successor person or persons designated as the authority under section 4 of the Video Recordings Act 1984.
ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
The following conditions in Annex 2 are conditions consistent with the operating schedule submitted by the applicant within the application:
2.1 The licence holders shall ensure that all sales of alcohol are consumed within the festival boundary and are not available, or taken, for consumption beyond the festival boundary.
2.2 Attendees to the event shall not be permitted to bring their own alcohol into the licensed area.
2.3 There shall be no entertainments or services offered at the festival that may give rise to concerns over the protection of children from harm licensing objective. Further, any impromptu, unscheduled or unauthorised entertainments or performances that occur that may give cause for concern in respect of protecting children from harm shall be immediately closed and the unauthorised performers or participants ejected from the site.
2.4 Stewards and/or SIA registered security staff shall be stationed at each site exit, and adequate notices posted to request that attendees leave with due consideration to local residents and businesses.
2.5 Stewards shall be positioned across the site and shall be in radio contact with the ‘Event Control’ at all times.
2.6 Stewards shall be fully briefed on Licensing, Health & Safety, Fire, Incident and Emergency matters and procedures.
2.7 The licence holders shall ensure that the campsite is stewarded 24 hours a day for the duration of the event, and that SIA registered security operatives shall also be on duty. The licence holders shall maintain reasonable levels of both noise and behaviour (including that campfires, drumming or ‘ghetto blaster’ sound systems shall be prohibited). Adequate notices alerting attendees to these matters shall also be posted on the event website in the lead up to the event.
2.8 There shall be a minimum of 23 (twenty-three) toilets for customer use, as well as adequate provision made for toilet cleaning and sanitation. Separate and adequate sanitary facilities shall be provided for stall holders, crew and artists.
2.9 The licence holders shall provide the local Environmental Health Officer with a mobile telephone contact number(s) for Vanguardia Consulting, appointed agents to control the sound levels at Festinho 2009, as soon as possible and in any event at least 14 days prior to the start of the festival.
2.10 A programme for monitoring noise at the nearest noise sensitive properties shall be submitted to, and agreed in writing by, the Environmental Health Officer a minimum of 14 days prior to the event. The consultant should use a Type 1 integrating-averaging Sound Level Meter (or equivalent system) with octave band frequency logging (to allow for monitoring specifically at the 63Hz and 125Hz bands). All monitoring data shall be recorded and made available to an authorised officer of the Local Authority upon request at any time during the event.
2.11 The licence holders shall implement adequate procedures for dealing with campsite noise as agreed with the Environmental Health Officer, and such procedures shall be submitted to, and agreed in writing by, the Environmental Health Officer a minimum of 14 days prior to the event.
2.12 The licence holders shall implement an adequate scheme detailing precise arrangements (location and generator type or other power supply arrangements) for lighting of the car park, and such scheme shall be submitted to, and agreed in writing by, the Environmental Health Officer a minimum of 14 days prior to the event. The scheme shall also include measures to mitigate noise from associated plant/equipment including generators.
2.13 In all other respects the licence holders shall observe all relevant legislative requirements, and unless modified by any of the conditions above stated as Annex 2 to premises licence BPL0356, operate the event in accordance with their ‘Licence Application Notes and Proposed Conditions’ and ‘Event Control’ documentation. These documents are attached hereto. In addition, the licence holders shall have due regard to any recommendations made by responsible authorities to ensure that the event is run in such a way so as to promote of the licensing objectives.
