ANNEX 1 - MANDATORY CONDITIONS
The following conditions in Annex 1 are mandatory under the provisions of the Licensing Act 2003:
1.1 Where one or more individuals are being used at the licensed premises to carry out a security activity, each such individual must be licensed by the Security Industry Authority (unless where the individual is exempt from obtaining an SIA registration under the Private Security Industry Act 2001).
ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
The following conditions in Annex 2 are conditions consistent with the operating schedule submitted by the applicant within the application:
1. There shall be no adult entertainment or services, activities, other entertainment or matters ancillary to the use of the premises that may give rise to concern in respect of children.
2. Road closure shall be in effect for the Market Place - to promote the public safety objective.
3. The licence holders shall ensure that:
(a) local community Police officers are kept adequately informed and involved concerning all aspects of the event;
(b) event organisers and stewards shall supervise and co-ordinate all activities for the duration of the event and shall have mobile phone contacts for use in the event of an emergency;
(c) event staging and activity equipment shall be supplied, set-up, dismantled and supervised by suitably experienced technicians;
(d) litter bins shall be provided in Market Place and ‘Barclays Bank’ car park with a litter pick to take place after the event has finished;
(e) floodlighting shall be provided for the event in addition to the street lighting already available (note it may be prudent to liaise with the local Environmental Health Officer to ensure that adequate measures are in place to minimise the risk of nuisance caused by light pollution);
(f) the stage area shall be adequately barriered/fenced with no access being available to the general public;
(g) first aiders and the St.John’s Ambulance shall be in attendance for the event; and
(h) emergency vehicle routes and access in Market Place shall be kept clear and unobstructed at all times for the duration of the event.
4. In respect of noise control, the licence holder shall ensure that:
(a) the Premises Licence Holder or a nominated person authorised to act on behalf of the Premises Licence Holder shall be on site for the duration of the event and be available to control all music sound levels;
(b) Music from the event shall be permitted only between 13:00hrs and 22:00hrs (as stated in the licence and summary of it).
(c) At all times during the operating hours, the Premises Licence Holder or a nominated assistant shall be available to receive and respond to nuisance-related complaints. A contact telephone number shall be provided to the Licensing Authority for that purpose prior to the day of the event.
(d) The Premises Licence Holder shall take all reasonable steps to ensure that noise levels from all of the activities taking place during the event are controlled to minimise nuisance at nearby noise sensitive premises.
(e) The Music Noise Level or sound configuration of amplified music shall be turned down or adjusted at the direct request (either in person or over the telephone) of an authorised officer of the Licensing Authority if in their opinion it is at such a level as to be likely to constitute a nuisance.
(f) Officers authorised by the Licensing Authority shall be given unfettered access to all areas of the licensed premises where necessary for the purposes of monitoring compliance with the licence conditions.
ANNEX 3 - CONDITIONS ATTACHED AFTER A HEARING BY THE LICENSING AUTHORITY
