ANNEX 1 - MANDATORY CONDITIONS:
The following conditions in Annex 1 are mandatory under the provisions of the Licensing Act 2003:
1. Alcohol shall not be sold or supplied:
(a) At any time when there is no designated premises supervisor in respect of the
premises licence, or
(b) At any time when the designated premises supervisor does not hold a personal licence or his/her personal licence is suspended
2. Every sale or supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.
3. Where one or more individuals are being used at the licensed premises to carry out a security activity, each such individual must be licensed by the Security Industry Authority (unless where the individual is exempt from obtaining an SIA registration under the Private Security Industry Act 2001).
4. The admission of children to the exhibition of any film shall be restricted in accordance with the film classification awarded by the British Board of Film Classification (BBFC), or any successor person or persons designated as the authority under section 4 of the Video Recordings Act 1984.
5. The responsible person shall take all reasonable steps to ensure that staff on relevant premises do not carry out, arrange or participate in any irresponsible promotions in relation to the premises.
In this paragraph, an irresponsible promotion means any one or more of the following activities, or substantially similar activities, carried on for the purpose of encouraging the sale or supply of alcohol for consumption on the premises in a manner which carries a significant risk of leading or contributing to crime and disorder, prejudice to public safety, public nuisance, or harm to children -
(a) games or other activities which require or encourage, or are designed to require or
encourage, individuals to -
(i) drink a quantity of alcohol within a time limit (other than to drink alcohol sold or
supplied on the premises before the cessation of the period in which the responsible
person is authorised to sell or supply alcohol), or
(ii) drink as much alcohol as possible (whether within a time limit or otherwise);
(b) provision of unlimited or unspecified quantities of alcohol free or for a fixed or
discounted fee to the public or to a group defined by a particular characteristic (other than
any promotion or discount available to an individual in respect of alcohol for
consumption at a table meal, as defined in section 159 of the Act);
(c) provision of free or discounted alcohol or any other thing as a prize to encourage or
reward the purchase and consumption of alcohol over a period of 24 hours or less;
(d) provision of free or discounted alcohol in relation to the viewing on the premises of a
sporting event, where that provision is dependent on -
(i) the outcome of a race, competition or other event or process, or
(ii) the likelihood of anything occurring or not occurring;
(e) selling or supplying alcohol in association with promotional posters or flyers on, or in the
vicinity of, the premises which can reasonably be considered to condone, encourage or
glamorise anti-social behaviour or to refer to the effects of drunkenness in any favourable
manner.
6. The responsible person shall ensure that no alcohol is dispensed directly by one person into the mouth of another (other than where that other person is unable to drink without assistance by reason of a disability).
7. The responsible person shall ensure that free tap water is provided on request to customers where it is reasonably available.
8. (a) The premises licence holder or club premises certificate holder shall ensure that an age verification policy applies to the premises in relation to the sale or supply of alcohol.
(b) The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and a holographic mark.
9. The responsible person shall ensure that -
(a) where any of the following alcoholic drinks is sold or supplied for consumption on the
premises (other than alcoholic drinks sold or supplied having been made up in advance
ready for sale or supply in a securely closed container) it is available to customers in the
following measures -
(i) beer or cider: ½ pint;
(ii) gin, rum, vodka or whisky: 25 ml or 35 ml; and
(iii) still wine in a glass: 125 ml; and
(b) customers are made aware of the availability of these measures.
ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE:
The following conditions in Annex 2 are conditions consistent with the operating schedule submitted by the applicant within the application:
1. Any licensable activities held on the licensed premises shall be for pre-booked functions or events only.
2. The consumption of alcohol in outdoor areas of the site shall be restricted to designated areas in front of the licensed building. No alcohol is authorised for consumption off the licensed site.
3. The premises licence holder shall ensure that:
(a) adequate numbers of staff (to attend to car parking, monitor outdoor areas of the site and service the bar) shall be employed on site commensurate with the nature and size of the licensable event;
(b) each event shall have a designated and suitably experienced events manager, and this person shall remain on site for the duration of the event;
(c) adequate external lighting shall be provided to outdoor areas, including the carpark, during the hours of darkness (note: it may be prudent for the premises licence holder to check the type and positioning of external lighting installations with the local Environmental Protection Officer to minimise any risk of causing public nuisance through light pollution);
(d) notices/signage are prominently displayed and maintained on the licensed site to alert patrons to public safety and prevention of public nuisance issues, including a request that patrons leave the premises in a quiet manner and giving contact details for local taxi or private hire companies;
(e) children shall be supervised by a responsible adult at all times whilst they are on the licensed premises during events involving licensable activities.
(f) a ‘Guest Conduct Policy’ is operated and communicated to guests to minimise any risk of inappropriate behaviour or conduct on the licensed premises;
(g) a heat and smoke alarm system shall be in place and adequately maintained;
(h) fire extinguishers and fire blankets shall be maintained in strategic positions throughout the licensed premises;
(i) the display of fireworks and use of Chinese lanterns shall be prohibited;
(j) handrails to aid elderly or disabled guests shall be strategically placed at the licensed premises;
(k) any alcohol kept on site shall be in a locked secure container in a combination locked storage room when the bar is not in use;
(l) all bar staff shall be adequately trained so they are familiar with licensing laws and controls;
(m) signage on the proof of age policy (see also Annex 1 mandatory condition 8) shall be prominently displayed and maintained near to the bar area of the licensed premises;
(n) management on the premises shall be available to assist guests with arranging for a taxi or private hire vehicle if necessary;
(o) noise from licensable activities at the licensed premises shall not cause any significant adverse impacts on the environment; and
(p) signage shall be installed on gates and fencing to alert children to keep off and not to climb.
4. Licensed activities shall only take place if Moreves Manor, Badley Road, Great Waldingfield, SUDBURY CO10 0RY is either (a) uninhabited; or (b) occupied as a dwellinghouse by the premises licence holder, a director or employee of the company/person(s) which is/who are the premises licence holder; or (c) lawfully used for purposes other than a dwellinghouse and is either under the ownership or direct control of the Premises Licence Holder.
5. All external doors and windows to the Barn shall be kept shut during licensed activities save to permit access to and egress from the Barn. All external doors to the Barn shall be fitted with self-closing devices.
ANNEX 3 - CONDITIONS ATTACHED AFTER A HEARING BY THE LICENSING AUTHORITY:
