CLUB PREMISES CERTIFICATE BCP0011 IS ONLY VALID BETWEEN 18:00hrs SECOND MONDAY SEPTEMBER and 18:00hrs SECOND MONDAY APRIL OF EACH YEAR.
ANNEX 1 - MANDATORY CONDITIONS:
The following conditions in Annex 1 are mandatory under the provisions of the Licensing Act 2003:
1. The responsible person shall take all reasonable steps to ensure that staff on relevant premises do not carry out, arrange or participate in any irresponsible promotions in relation to the premises.
In this paragraph, an irresponsible promotion means any one or more of the following activities, or substantially similar activities, carried on for the purpose of encouraging the sale or supply of alcohol for consumption on the premises in a manner which carries a significant risk of leading or contributing to crime and disorder, prejudice to public safety, public nuisance, or harm to children -
(a) games or other activities which require or encourage, or are designed to require or
encourage, individuals to -
(i) drink a quantity of alcohol within a time limit (other than to drink alcohol sold or
supplied on the premises before the cessation of the period in which the responsible
person is authorised to sell or supply alcohol), or
(ii) drink as much alcohol as possible (whether within a time limit or otherwise);
(b) provision of unlimited or unspecified quantities of alcohol free or for a fixed or
discounted fee to the public or to a group defined by a particular characteristic (other than
any promotion or discount available to an individual in respect of alcohol for
consumption at a table meal, as defined in section 159 of the Act);
(c) provision of free or discounted alcohol or any other thing as a prize to encourage or
reward the purchase and consumption of alcohol over a period of 24 hours or less;
(d) provision of free or discounted alcohol in relation to the viewing on the premises of a
sporting event, where that provision is dependent on -
(i) the outcome of a race, competition or other event or process, or
(ii) the likelihood of anything occurring or not occurring;
(e) selling or supplying alcohol in association with promotional posters or flyers on, or in the
vicinity of, the premises which can reasonably be considered to condone, encourage or
glamorise anti-social behaviour or to refer to the effects of drunkenness in any favourable
manner.
2. The responsible person shall ensure that no alcohol is dispensed directly by one person into the mouth of another (other than where that other person is unable to drink without assistance by reason of a disability).
3. The responsible person shall ensure that free tap water is provided on request to customers where it is reasonably available.
4. (a) The premises licence holder or club premises certificate holder shall ensure that an age verification policy applies to the premises in relation to the sale or supply of alcohol.
(b) The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and a holographic mark.
5. The responsible person shall ensure that -
(a) where any of the following alcoholic drinks is sold or supplied for consumption on the
premises (other than alcoholic drinks sold or supplied having been made up in advance
ready for sale or supply in a securely closed container) it is available to customers in the
following measures -
(i) beer or cider: ½ pint;
(ii) gin, rum, vodka or whisky: 25 ml or 35 ml; and
(iii) still wine in a glass: 125 ml; and
(b) customers are made aware of the availability of these measures.
6. The admission of children to the exhibition of any film shall be restricted in accordance with the film classification awarded by the British Board of Film Classification (BBFC), or any successor person or persons designated as the authority under section 4 of the Video Recordings Act 1984.
ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE:
The following conditions in Annex 2 are conditions consistent with the operating schedule submitted by the applicant within the application:
1. The supply of alcohol under the authority of Club Premises Certificate BCP0011 shall be limited to on not more that 6 (six) occasions on a Friday and on not more than 6 (six) occasions on a Sunday during the annual validity of the certificate. For the avoidance of doubt there is no frequency limitation to the supply of alcohol on a Saturday during the same period.
2. Supply of alcohol on a Friday or Sunday, as limited by condition Annex 2.1 above, shall be as an ancillary to the viewing of a televised sporting event or hosting of a club competition match.
3. The showing of a regulated film, specified as being part of a ‘race night’ activity, shall be limited to 1 (one) occasion during the annual validity of Club Premises Certificate BCP0011.
4. Live music performances shall be limited to 2 (two) occasions during the annual validity of Club Premises Certificate BCP0011.
5. Other than background recorded music, recorded music activity shall be limited to 2 (two) occasions during the annual validity of Club Premises Certificate BCP0011. Further, disco activities shall not commence prior to 18:00hrs.
6. There shall be no adult entertainment or services, activities, other entertainment or matters ancillary to the use of the premises that may give rise to concern in respect of children.
7. All bar staff shall be adequately directed by the Club management on the procedures to follow in respect of checking identity and controlling the supply of alcohol to individual members or guests. Alcohol shall not be supplied to individuals in such quantities as may lead to excessive consumption and associated criminal or disorderly behaviour.
8. Adequate numbers of bar staff shall be on duty whilst the club is open for licensable activities, and the need for additional numbers of staff for club social events (for example quiz nights or race night) shall be assessed and facilitated by the Club management.
9. Signage shall be prominently displayed and maintained on the Club premises, including at exit points, requesting that members and guests leave quietly and disperse from the vicinity of the Club promptly so as to minimise any risk of causing public nuisance.
10. All external doors and windows to the building shall be kept shut during the playing of amplified music save to permit access to and egress from the building (appropriate air conditioning should be installed if necessary).
11. Use of the outside area for drinking is to finish no later than 23:30hrs on all occasions.
12. The volume control of recorded music or any amplification equipment shall be under the direct control of a responsible individual as nominated by the Club for that purpose, with provision made for the sound to be turned down at the direct request of an authorised officer of the Licensing Authority or a Police Officer.
ANNEX 3 - CONDITIONS ATTACHED AFTER A HEARING BY THE LICENSING AUTHORITY:
1. The hiring of the Club premises and its facilities for members and guests 'private' functions, involving licensable activities, shall be prohibited.
2. An appropriate official of the Club, as designated by the Club management, shall be responsible for maintaining a book to record and verify (including an authorised signature) of the actual opening and closing hours of the Club premises (within permitted hours as authorised by Club Premises Certificate BCP0011).
3: The Club management shall ensure that glasses and litter/waste shall be cleared away by closing time.
4: The terminal hour for the supply of alcohol activity shall be reduced by 30 minutes from those proposed by application 005733, and as now identified on Club Premises Certificate BCP0011 and summary of it, in order to provide a defined period for drinking-up and dispersal of club members and guests.
