ANNEX 1 - MANDATORY CONDITIONS
The following conditions in Annex 1 are mandatory under the provisions of the Licensing Act 2003:
1.1 Alcohol shall not be sold or supplied:
(a) At any time when there is no designated premises supervisor in respect of the
premises licence, or
(b) At any time when the designated premises supervisor does not hold a personal licence or his/her personal licence is suspended
1.2 Every sale or supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.
1.3 Where one or more individuals are being used at the licensed premises to carry out a security activity, each such individual must be licensed by the Security Industry Authority (unless where the individual is exempt from obtaining an SIA registration under the Private Security Industry Act 2001).
1.4 The responsible person shall take all reasonable steps to ensure that staff on relevant premises do not carry out, arrange or participate in any irresponsible promotions in relation to the premises.
In this condition, an irresponsible promotion means any one or more of the following activities, or substantially similar activities, carried on for the purpose of encouraging the sale or supply of alcohol for consumption on the premises in a manner which carries a significant risk of leading or contributing to crime and disorder, prejudice to public safety, public nuisance, or harm to children -
(a) games or other activities which require or encourage, or are designed to require or
encourage, individuals to -
(i) drink a quantity of alcohol within a time limit (other than to drink alcohol sold or
supplied on the premises before the cessation of the period in which the responsible
person is authorised to sell or supply alcohol), or
(ii) drink as much alcohol as possible (whether within a time limit or otherwise);
(b) provision of unlimited or unspecified quantities of alcohol free or for a fixed or
discounted fee to the public or to a group defined by a particular characteristic (other than
any promotion or discount available to an individual in respect of alcohol for
consumption at a table meal, as defined in section 159 of the Act);
(c) provision of free or discounted alcohol or any other thing as a prize to encourage or
reward the purchase and consumption of alcohol over a period of 24 hours or less;
(d) provision of free or discounted alcohol in relation to the viewing on the premises of a
sporting event, where that provision is dependent on -
(i) the outcome of a race, competition or other event or process, or
(ii) the likelihood of anything occurring or not occurring;
(e) selling or supplying alcohol in association with promotional posters or flyers on, or in the
vicinity of, the premises which can reasonably be considered to condone, encourage or
glamorise anti-social behaviour or to refer to the effects of drunkenness in any favourable
manner.
1.6 The responsible person shall ensure that no alcohol is dispensed directly by one person into the mouth of another (other than where that other person is unable to drink without assistance by reason of a disability).
1.7 The responsible person shall ensure that free tap water is provided on request to customers where it is reasonably available.
ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
The following conditions in Annex 2 are conditions consistent with the operating schedule submitted by the applicant within the application:
2.1 The licence holders shall observe all relevant legislative requirements, and operate the event in accordance with the ‘Event Safety Management Plan’ (which may continue to be updated up until the commencement of the event and shall incorporate agreements between the licence holders and all responsible authorities), with the final version, including full risk assessment, to be retained on site in hard copy format.
2.2 The licence holders shall ensure that:
(a) all activities are clearly signposted, including a ‘lost child’ area which shall be maintained as clearly identifiable and shall be manned for the duration of the event;
(b) suitable and sufficient levels of professional security and stewarding shall be provided for the duration of the event and this is to include constant patrols of the event site, campsite and carpark;
(c) the event shall be ticket only and restricted to not more than 1500 tickets available for purchase in advance of the event only. No money shall be taken at the point of entry to the event site and identity checks shall be carried out to evidence that the attendee is the original ticket-holder;
(d) all attendees wishing to use the bar facilities shall be required to purchase tokens for drinks, in order that monies may be held securely away from the bar. All attendees shall be reminded to keep their valuable items with them at all times;
(e) based on the full risk assessment conducted, relevant areas (including ponds) shall be suitably and sufficiently secured - for example by means of gates, rope or crash barriers - with all exits clearly marked and signposted;
(f) a minimum of 30 stewards shall be used by the event organisers for providing information and assistance to the public;
(g) a suitable and sufficient number of Red Cross, or other suitably qualified and experienced, emergency first aid/ambulance service operatives shall be on site for the duration of the event;
(h) professional contractors/consultants, with qualification and experience commensurate with the nature and scale of the event, shall be used for erection of temporary structures and the operation of all sound and lighting equipment;
(i) shuttle buses shall be provided to and from the event between Ipswich Railway Station and the event site, and the licence holders shall ensure that any advice on traffic management given by the Police shall be complied with, and the flow of traffic to and from the site shall be suitably and sufficiently managed;
(j) all stewards used for the event shall receive child protection training in advance of the event commencing;
(k) all under 14 year olds on the licensed site must be accompanied by an adult, and any under 18 year olds camping overnight must have an adult in their party;
(l) all drinks available from the bar shall be served in plastic drinking vessels and no glass, bottles or alcohol shall be permitted into the festival site;
(m) alcohol and equipment on site shall be adequately secured and monitored, including overnight.
2.3 The licence holders shall comply with the requirements of the Licensing Authority with regard to the installation and operation of all sound amplification and public address systems. This shall include the setting of noise output levels and the provision of noise measuring equipment.
2.4 The licence holders shall ensure that:
(a) Between 12:00-23:00 hours the Music Noise Level shall not exceed 53db(A) (LAeq 15mins) as measured at 1m from the façade of any Noise Affected Premises.
(b) Between 12:00-23:00 hours the Maximum Sound Pressure Level (LMax) shall not exceed 70dB in either the 63Hz or 125Hz octave frequency bands as measured at 1m from the façade of any Noise Affected Premises.
(c) Between 22:30-01:00 hours the Music Noise Level shall not exceed 40db (LAeq 15mins) as measured at 1m from the façade of any Noise Affected Premises.
(d) Between 22:30-01:00 hours the Music Noise Level shall not exceed 42db (LAeq 1min) as measured at 1m from the façade of any Noise Affected Premises.
(e) Between 22:30-01:00 hours the LZeq 15mins shall not exceed 55dB in either the 63Hz or 125Hz octave frequency bands as measured at 1m from the façade of any Noise Affected Premises.
(f) The Music Noise Level at the front of house consoles shall in any case not exceed 95dB (LAeq 15 mins) and the Maximum Sound Pressure Level (LMax) at any point in an audience shall not exceed 140dB.
(g) In Conditions 2.4 to 2.15 inclusive: the term “Music Noise Level” shall be as defined in the “Code of Practice on Environmental Noise Control at Concerts”, The Noise Council, 1995; and "Noise Affected Premises" shall be taken to be any residential premises, the occupants of which consider that the specified noise limits should apply at their premises.
2.5 The licence holders shall ensure that members of the audience are not allowed within 3 metres of any loudspeaker.
2.6 A suitably qualified Sound Management Consultant shall be on site during the installation and testing of the sound amplification system in order to set appropriate control limits at the sound mixer position for the Music Stage and to ensure that the limits specified in Condition 2.4 are not exceeded. The sound systems shall be configured and operated in a similar manner as intended for the event. The sound source used for the test shall be similar in character to the music likely to be produced during the event.
2.7 Noise propagation tests (sound checks) shall not be undertaken after 22.00 hours on 20 May 2011 or before 10:00 hours on 21 May 2011. The noise limits expressed in Condition 2.4 above shall be adhered to during any noise or sound checks.
2.8 The licence holders shall ensure that the promoter, sound system supplier and all individual sound engineers are informed of the sound control limits prior to the commencement of licensed musical entertainment and that any instructions from either the licence holders or the Licensing Authority are implemented.
2.9 The licence holders or a nominated person authorised to act in the name of the licence holders shall be on site for the duration of the event and be available to control all music sound levels.
2.10 During operating hours, the licence holders or nominated representative shall be available to receive and respond to nuisance-related complaints. A contact telephone number shall be provided to the Licensing Authority for that purpose prior to the day of the event.
2.11 Clearly legible and suitable notices shall be displayed and maintained at the event exits, requesting customers to respect the needs of local residents and to leave the premises and area quietly. Sufficient numbers of staff shall be available at the main event exits, to ensure that customers disperse quietly.
2.12 The licence holders or their nominated representative shall make available to the Licensing Authority data relating to the noise levels being produced from the Music Stage, if so required.
2.13 The licence holders shall put in place reasonable procedures for minimising disturbance to residents arising from noise emanating from the campsites. This will include the presence of 24-hour stewarding and security for the duration of the event.
2.14 The Music Noise Level or sound configuration of amplified music shall be turned down or adjusted at the direct request (either in person or over the telephone) of an authorised officer of the Licensing Authority providing that the noise levels exceed the limits specified in Conditions 2.4 to 2.15 inclusive.
2.15 Officers authorised by the Licensing Authority shall be given unfettered access to all areas of the licensed premises where necessary for the purposes of monitoring compliance with the licence conditions.
2.16 The licence holders shall ensure that the lighting installed at the licensed venue and the campsites are designed and orientated in such a manner as not to cause nuisance to the surrounding residents.
2.17 The licence holders shall submit in writing, for approval by the Police and Licensing Authority, a policy to restrict or prohibit attendees bringing alcohol on to the licensed premises, which shall include proposals for monitoring and enforcing the policy. This policy shall be submitted to the Police and Licensing Authority by no later than 17:00 hours on 6 May 2011.
