ANNEX 1 - MANDATORY CONDITIONS
The following conditions in Annex 1 are mandatory under the provisions of the Licensing Act 2003:
1.1 Alcohol shall not be sold or supplied:
(a) At any time when there is no designated premises supervisor in respect of the
premises licence, or
(b) At any time when the designated premises supervisor does not hold a personal licence or his/her personal licence is suspended
1.2 Every sale or supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.
1.3 Where one or more individuals are being used at the licensed premises to carry out a security activity, each such individual must be licensed by the Security Industry Authority (unless where the individual is exempt from obtaining an SIA registration under the Private Security Industry Act 2001).
1.4 The responsible person shall take all reasonable steps to ensure that staff on relevant premises do not carry out, arrange or participate in any irresponsible promotions in relation to the premises.
In this paragraph, an irresponsible promotion means any one or more of the following activities, or substantially similar activities, carried on for the purpose of encouraging the sale or supply of alcohol for consumption on the premises in a manner which carries a significant risk of leading or contributing to crime and disorder, prejudice to public safety, public nuisance, or harm to children -
(a) games or other activities which require or encourage, or are designed to require or
encourage, individuals to -
(i) drink a quantity of alcohol within a time limit (other than to drink alcohol sold or
supplied on the premises before the cessation of the period in which the responsible
person is authorised to sell or supply alcohol), or
(ii) drink as much alcohol as possible (whether within a time limit or otherwise);
(b) provision of unlimited or unspecified quantities of alcohol free or for a fixed or
discounted fee to the public or to a group defined by a particular characteristic (other than
any promotion or discount available to an individual in respect of alcohol for
consumption at a table meal, as defined in section 159 of the Act);
(c) provision of free or discounted alcohol or any other thing as a prize to encourage or
reward the purchase and consumption of alcohol over a period of 24 hours or less;
(d) provision of free or discounted alcohol in relation to the viewing on the premises of a
sporting event, where that provision is dependent on -
(i) the outcome of a race, competition or other event or process, or
(ii) the likelihood of anything occurring or not occurring;
(e) selling or supplying alcohol in association with promotional posters or flyers on, or in the
vicinity of, the premises which can reasonably be considered to condone, encourage or
glamorise anti-social behaviour or to refer to the effects of drunkenness in any favourable
manner.
1.5 The responsible person shall ensure that no alcohol is dispensed directly by one person into the mouth of another (other than where that other person is unable to drink without assistance by reason of a disability).
1.6 The responsible person shall ensure that free tap water is provided on request to customers where it is reasonably available.
1.7 (a) The premises licence holder or club premises certificate holder shall ensure that an age verification policy applies to the premises in relation to the sale or supply of alcohol.
(b) The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and a holographic mark.
1.8 The responsible person shall ensure that -
(a) where any of the following alcoholic drinks is sold or supplied for consumption on the
premises (other than alcoholic drinks sold or supplied having been made up in advance
ready for sale or supply in a securely closed container) it is available to customers in the
following measures -
(i) beer or cider: ½ pint;
(ii) gin, rum, vodka or whisky: 25 ml or 35 ml; and
(iii) still wine in a glass: 125 ml; and
(b) customers are made aware of the availability of these measures.
1.9 The relevant person (the holder of the premises licence, the designated premises supervisor (if any) in respect of such a licence, the personal licence holder who makes or authorises a supply of alcohol under such a licence, or any member or officer of a club present on the premises in a capacity which enables the member or officer to prevent the supply in question) shall ensure that no alcohol is sold or supplied for consumption on or off the premises for a price which is less than the permitted price. Please refer to the enclosure regarding the calculation methodology to be used for this purpose.
ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
The following conditions in Annex 2 are conditions consistent with the operating schedule submitted by the applicant within the application:
2.1 The premises licence BPL0381-010498 shall be time limited to 25th to 27th July 2014 only. Licensed activities on 25th July 2014 shall be for campsite attendees only.
2.2 The capacity for the event - including attendees, staff, performers, stallholders and contractors - shall not exceed 7500 persons at any one time.
2.3 The premises licence holder shall create and implement an Event Management Plan (EMP) to promote the licensing objectives. A final version of the EMP and up to date site plans shall be sent by the premises licence holder to the Licensing Authority and all Responsible Authorities no later than 14 (fourteen) days prior to the first day of the event. Any proposed revisions to the EMP shall be notified in writing with the relevant Responsible Authority and Licensing Authority before the master EMP is updated - which shall be as soon as reasonably practicable following the revision. The premises licence, event management plan and risk assessments shall be kept with all other event documentation in the event control for the duration of the festival and this location shall be clearly identified on the site plan. An up to date event site plan shall be retained with the EMP at all times.
2.4 Sufficient numbers of radio-linked security staff and stewards shall be provided to monitor and control the site as detailed in the EMP and in accordance with the premises licence holder’s risk assessment in consultation with the security provider.
2.5 The premises licence holder shall ensure that all staff attend an event and site briefing within 7 (seven) days of the commencement of the event to ensure promotion of the licensing objectives. The briefing shall cover matters including the prevention of drunk and disorderly behaviour, evacuation plans, location of first aid/medical provision and event programme and timings.
2.6 All staff shall be readily identifiable to the public attending the event by means of branded and/or high visibility apparel.
2.7 All staff involved with management of the event shall be in radio communications with each other and the event control via walkie-talkie network. This facility shall be maintained for the duration of the event.
2.8 The premises licence holder shall operate a wristband system for event attendees.
2.9 Clear signage shall be displayed and maintained on the licensed premises for the duration of the event alerting attendees to matters pertinent to ensuring public safety.
2.10 Suitable and sufficient provision of first aid/medical cover shall be maintained for the duration of the event in accordance with the premises licence holder’s risk assessment and plan, in consultation with the medical provider for the event.
2.11 Car parking attendants and stewarding shall be deployed for the duration of the event, all of which shall be clearly identifiable to the public via uniform.
2.12 Suitable and sufficient fire extinguishers, blankets and other fire fighting equipment shall be deployed around the site for the duration of the event. The locations of fire fighting equipment shall be market on the site plan for the event and signposted on site.
2.13 Full site and event risk assessments shall be conducted in a suitable and sufficient manner to promote public safety prior to the admission of the public to the event, and ongoing throughout licensable activities. This shall include a full risk assessment of temporary demountable structures (staging, marquees etc) which shall be erected, inspected and demounted by a suitably competent and qualified person.
2.14 An identified taxi and private hire drop-off/pick-up point shall be in place for the duration of the event and suitably promoted in the event literature/promotional material.
2.15 Signage shall be displayed and maintained alerting the public to local licensed taxi and private hire contact details, together with a reminder to avoid drinking and driving.
2.16 Attendees acting in a drunk, disorderly or anti-social manner shall be ejected from the site and afforded assistance by the event staff to ensure safe departure (for example via taxi) or handover from the site. Serious matters/incidents shall be reported to the Police immediately.
2.17 The following noise control limits shall be complied with:
(a) Between 12:00hrs and 23:00hrs the Music Noise Level shall not exceed 53dB(A) (LAeq 15mins) as measured at 1m from the façade of any noise sensitive premises;
(b) Between 12:00hrs and 23:00hrs the Leq (15mins) sound level shall not exceed 70dB in either the 63Hz or 125Hz octave frequency bands as measured at 1m from the façade of any noise sensitive premises;
(c) The Music Noise Level at the front of house consoles shall in any case not exceed 98dB (LAeq 15 mins) and the Maximum Sound Pressure Level (LMax) at any point in an audience shall not exceed 140dB.
In Conditions 2.17(a) to 2.17(c) inclusive, the term “Music Noise Level” shall be as defined in the “Code of Practice on Environmental Noise Control at Concerts”, The Noise Council, 1995.
2.18 Noise propagation tests (sound checks) shall not be undertaken after 22:00hrs or before 10:00hrs. The noise limits specified above shall be adhered to during any noise or sound checks.
2.19 The Premises License Holder shall ensure that members of the audience are not allowed within 2 meters of any loudspeaker.
2.20 The Premises Licence Holder or a nominated person authorised to act in the name of the Premises Licence Holder shall be on site for the duration of the event and be available to control all music sound levels.
2.21 At least 3 days prior to the commencement of the event, the Premises Licence Holder shall provide the Licensing Authority with:
(a) A telephone number for their nominated representative(s);
(b) A telephone number which may be given to members of the public wishing to complain directly to, or otherwise contact, the Premises Licence Holder.
The telephone numbers shall be continuously manned during the licensed operating hours of the event.
2.22 The Premises Licence Holder shall take all reasonable steps to ensure that noise levels from all of the activities taking place during the event are controlled to ensure compliance with the conditions relating to noise control.
2.23 Perimeter sound checks shall be undertaken hourly during event opening times.
2.24 Clearly legible and suitable notices shall be displayed and maintained at the event exits, requesting customers to respect the needs of local residents and to leave the premises and area quietly. Sufficient staff shall be available at the main event exits after 23:00hrs, to ensure that customers disperse quietly.
2.25 The Music Noise Level or sound configuration of amplified music shall be turned down or adjusted at the direct request (either in person or over the telephone) of an authorised officer of the Licensing Authority or Police providing that the noise levels exceed any of the limits specified in Condition 2.17.
2.26 There shall be no adult entertainment or services, activities, other entertainment or matters ancillary to the use of the premises that may give rise to concern in respect of children.
