ANNEX 1 - MANDATORY CONDITIONS:
The following conditions in Annex 1 are mandatory under the provisions of the Licensing Act 2003:
1. Alcohol shall not be sold or supplied:
(a) At any time when there is no designated premises supervisor in respect of the premises licence, or
(b) At any time when the designated premises supervisor does not hold a personal licence or his/her personal licence is suspended.
2. Every sale or supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.
3. (a) The premises licence holder or club premises certificate holder shall ensure that an age verification policy applies to the premises in relation to the sale or supply of alcohol.
(b) The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and a holographic mark.
ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE:
The following conditions in Annex 2 are conditions consistent with the operating schedule submitted by the applicant within the application:
1. The licensed premises shall be maintained as an eastern European food and drinks retailer, and shall not be used exclusively or primarily for the sale or supply of alcohol.
2. There shall be no supplies of alcohol for consumption on the licensed premises or immediately outside of the premises.
3. (a) CCTV shall be provided in the form of a recordable system, capable of providing pictures of evidential quality in all lighting conditions particularly facial recognition.
(b) CCTV equipment shall be maintained in good working order and be correctly time and date stamped. Recordings shall be kept in date order, numbered sequentially and kept for a minimum period of 31 (thirty-one) days and handed to the Police upon demand.
(c) The premises licence holder shall ensure that at all times the designated premises supervisor (DPS) or appointed member of staff is capable and competent at downloading CCTV footage into a recordable format, either disc or VHS video cassette, for the Police/Local Authority upon demand.
(d) The recording equipment and tapes/discs shall be kept in a secure environment under the control of the DPS or other responsible named individual.
(e) An operational daily log report shall be maintained and endorsed by signature, indicating that the system has been checked and is compliant. In the event of any failings, any actions taken are to be recorded.
(f) In the event of any technical failure of the CCTV equipment the premises licence holder/DPS shall immediately report the failure to the Police on contact telephone number 01473 613500 (or any alternative number given by the Police for that purpose).
4. An incident book shall be kept and maintained on the licensed premises at all times. The book shall detail, in brief, age challenge and any other relevant incidents. Incidents entered into the book shall be timed, dated and signed by the author and produced to an authorised officer of the Police/Local Authority upon demand.
5. Records in respect of staff members licensing accreditations and training shall be kept on the premises and produced to an authorised officer of the Police and Local Authority upon demand.
6. Any reasonable request made by the Police in respect of the prevention of crime and disorder or protection of children from harm licensing objectives shall be complied with.
7. Whilst the premises are open for licensed activities a responsible person shall be on duty at all times, and this individual shall be aware of the requirement to promote the licensing objectives and also the terms and conditions of premises licence BPL0385.
8. Waste and litter at the licensed premises, and in the immediate vicinity of the premises, shall be adequately managed by the premises licence holder to ensure that it does not cause any public nuisance.
9. Escape routes and exits at the licensed premises shall be kept free from obstruction or hazard, and adequately identified and signed.
10. There shall be no irresponsible drinks promotions at the licensed premises.
11. There shall be no adult entertainment or services, activities, other entertainment or matters ancillary to the use of the premises that may give rise to concerns in respect of children.
ANNEX 3 - CONDITIONS ATTACHED AFTER A HEARING BY THE LICENSING AUTHORITY:
