ANNEX 1 - MANDATORY CONDITIONS:
The following conditions in Annex 1 are mandatory under the provisions of the Licensing Act 2003:
1. Alcohol shall not be sold or supplied:
(a) At any time when there is no designated premises supervisor in respect of the
premises licence, or
(b) At any time when the designated premises supervisor does not hold a personal licence or his/her personal licence is suspended
2. Every sale or supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.
ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE:
The following conditions in Annex 2 are conditions consistent with the operating schedule submitted by the applicant within the application. These will include, where required, existing expressed conditions and embedded restrictions contained within existing authorisations and enactments as specified by the Secretary of State, in accordance with Schedule 8(6) of the Licensing Act 2003:
1. No person under the age of 14 shall be in the bar of the licensed premises during the permitted hours, unless one of the following applies:
(a) He is the child of the holder of the premises licence
(b) He resides in the premises, but is not employed there
(c) He is in the bar solely for the purpose of passing to or from some part of the premises which is not a bar and to or from which there is no other convenient means of access or egress
(d) The bar is in railway refreshment rooms or other premises constructed, fitted and intended to be used bona fide for any purpose to which the holding of a premises licence is ancillary
2. Alcohol should not be sold or supplied except during the hours authorised by the premises licence. The restrictions on these authorised hours do not prohibit:
a. during the first thirty minutes after the above hours the consumption of alcohol on the premises;
b. during the first thirty minutes after the above hours, the taking of the alcohol from the premises unless the alcohol is supplied or taken in an open vessel;
c. during the first thirty minutes after the above hours the consumption of the alcohol on the premises by persons taking meals there if the alcohol was supplied for consumption as ancillary to the meals;
d. consumption of the alcohol on the premises or the taking of sale or supply of alcohol to any person residing in the licensed premises;
e. the ordering of alcohol to be consumed off the premises, or the despatch by the vendor of the alcohol so ordered;
f. the sale of alcohol to a trader or club for the purposes of the trade or club;
g. the sale or supply of alcohol to any canteen or mess, being a canteen in which the sale or supply of alcohol is carried out under the authority of the Secretary of State or an authorised mess of members of Her Majesty’s naval, military or air forces;
h. the taking of alcohol from the premises by a person residing there; or
i. the supply of alcohol for consumption on the premises to any private friends of a person residing there who are bona fide entertained by him at his own expense, or the consumption of alcohol by persons so supplied; or
j. the supply of alcohol for consumption on the premises to persons employed there for the purposes of the business carried on by the holder of the licence, or the consumption of liquor so supplied, if the liquor is supplied at the expense of their employer or of the person carrying on or in charge of the business on the premises.
3. The sale by retail of alcohol shall be restricted to the areas identified on the plan attached as Annex 4. The licence-holder should apply for a Temporary Event Notice (TEN) where any sale by retail is to take place in areas not identified on the plan (for example for beer festivals held in external areas of the licensed premises).
4. The licence-holder shall participate in the local Pubwatch scheme (or similar) where this is available in the locality of the licensed premises.
5. All exits shall be clearly marked and escape routes shall be kept free from obstructions.
6. The licence-holder shall display and maintain notices regarding, and enforce, a proof of age scheme in order to assist with prevention of under-age sales.
7. Emergency lighting shall be installed and maintained on the licensed premises.
8. Any litter in the immediate vicinity of the licensed premises shall be regularly cleared.
9. External areas of the licensed premises shall be illuminated during the hours of darkness. (Note: It may be prudent for the licence-holder to liaise with the local Environmental Health Officer to ensure that any lighting does not cause public nuisance).
10. Children shall not be permitted on the licensed premises after 20:00hrs.
11. There shall be no drinks promotions on the licensed premises that encourage illegal, irresponsible or immoderate consumption of alcohol.
12. On occasions when the licensed premises is open later than midnight, cold snacks and sandwiches shall be available to customers until at least 23:00hrs.
13. Signage shall be displayed and maintained in public areas of the licensed premises in order to advise patrons and staff:
- that where glass bottles are used, they will be retained or disposed of on the premises;
- that customers should not leave the premises whilst carrying open bottles or glasses containing alcoholic beverages;
- of any relevant age restrictions on admission to the premises, and also the purchase and consumption of alcoholic drinks
Signage and public information notices, relevant to the promotion of the four licensing objectives, shall also be displayed in public areas of the licensed premises at the request of an authorised officer of the Local Authority or Suffolk Constabulary.
14. Customers shall not be admitted, or re-admitted, to the licensed premises after 23:00hrs or one hour prior to the closure of the premises to the public (whichever is the later).
15. The appended Public Entertainments Licence conditions, terms and restrictions (including any limitations on permitted capacity) will continue to apply to the Premises Licence unless where these conditions are overridden by the authorisations of the Premises Licence (for example concerning hours authorised for licensable activities), or by the provisions of the Licensing Act 2003 or other statutory modifications.
ANNEX 3 - CONDITIONS ATTACHED AFTER A HEARING BY THE LICENSING AUTHORITY:
1. The extension of hours and activities proposed by the variation application shall be revised as shown on the premises licence and summary.
