ANNEX 1 - MANDATORY CONDITIONS
The following conditions in Annex 1 are mandatory under the provisions of the Licensing Act 2003:
1. Alcohol shall not be sold or supplied:
(a) At any time when there is no designated premises supervisor in respect of the
premises licence, or
(b) At any time when the designated premises supervisor does not hold a personal licence or his/her personal licence is suspended
2. Every sale or supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.
ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
The following conditions in Annex 2 are those consistent with the operating schedule submitted by the applicant:
1. CCTV shall be provided in the form of a recordable system, capable of providing pictures of evidential quality in all lighting conditions and particularly facial recognition. Cameras shall cover all ingress and egress to the premises, fire exits, outside areas and all areas where the sale/supply of alcohol occurs. Equipment shall be maintained in good working order and be correctly time and date stamped, with recordings retained for a minimum period of 31 days.
2. The premises licence holder shall ensure that at all times the DPS or appointed member of staff is capable of providing access to allow a Police Officer or authorised officer of the Local Authority to view the CCTV footage. Within 48 hours of any request, the premises licence holder shall make available to the Police any CCTV footage in a viewable format on disc or storage device.
3. Recording equipment and discs shall be kept in a secure environment under the control of the DPS or other responsible named individual.
4. The premises licence holder shall monitor the CCTV equipment and in the event of any failing of the equipment shall notify the Police Licensing Officer immediately it has come to the attention of the premises licence holder.
5. Relevant signage shall be displayed and maintained throughout the premises indicating that CCTV is in operation.
6. All sales of alcohol shall be made by staff members who have undertaken, and signed for as confirmation of this fact, Martin McColl Limited training in the sale of alcohol and due diligence procedures applying in the Company stores. All training shall be confirmed in writing and signed by the employee, with training records made available upon reasonable request to an authorised officer of the Police or other responsible authority.
7. The premises licence holder shall implement the ‘Challenge 25’ scheme or similar, ensuring that prominent signage is displayed and maintained throughout the premises and all staff are trained in its operation.
8. A timed and dated record of all sales refusals shall be maintained on the premises and be produced upon reasonable request to an authorised officer of the Police or other responsible authority.
9. A record shall be maintained by the premises licence holder of all incidents of crime and disorder reported to or by members of staff, which shall be reported to and retained by the Company helpdesk. A copy of the record of the incident log shall be made available to the Police upon reasonable request. The record shall include detail, include date and time, of all occasions when emergency services attended the licensed premises in respect of an incident.
10. Any signage relating to conditions of the premises licence shall not be displayed in less than sized 32 font and shall be displayed prominently at the points of access and egress.
11. A member of the store management team shall be on the premises at all times whilst the premises are open and shall have received training in relation to ensuring public safety.
2.1 The Premises Licence Holder shall be permitted to undertake the delivery of goods including alcohol by a third-party delivery company. There shall be no deliveries or collections of alcohol to or from the premises between 23:00 and 06:00 on the following day. The premises shall operate in accordance with the Challenge 25 scheme. The scheme operates on the basis that, whilst alcohol may be sold to persons aged 18 years and over, at the point of delivery any person who appears under 25 years of age will be asked for a valid form of identification. This challenge will be made by the person making the delivery. The only acceptable forms of valid ID are a: proof of age car bearing the PASS hologram logo; passport; or UK photo driving licence Military ID Alcohol will not be delivered to any person who is challenged and fails to provide an acceptable form of ID. The staff at the premises shall ensure delivery drivers enter and leave the premises in a quiet and respectful manner. Delivery drivers will been encouraged to not play loud music or rev cars if waiting for deliveries. All delivery sales of alcohol must be paid for at the time of ordering. Payment shall be made by debit or credit card, or electronic payment such as Apple Pay, Android Pay, etc.
ANNEX 3 - CONDITIONS ATTACHED AFTER A HEARING BY THE LICENSING AUTHORITY
