ANNEX 1 - MANDATORY CONDITIONS
The following conditions in Annex 1 are mandatory under the provisions of the Licensing Act 2003:
1.1 Alcohol shall not be sold or supplied:
(a) At any time when there is no designated premises supervisor in respect of the premises licence, or
(b) At any time when the designated premises supervisor does not hold a personal licence or his/her personal licence is suspended.
1.2 Every sale or supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.
1.3 (a) The premises licence holder or club premises certificate holder shall ensure that an age verification policy applies to the premises in relation to the sale or supply of alcohol.
(b) The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and a holographic mark.
ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
The following conditions in Annex 2 are conditions consistent with the operating schedule submitted by the licence holder within the application:
2.1 The premises licence holder shall install and maintain a CCTV system on the licensed premises that shall operate at all times whilst licensable activities are taking place.
2.2 The CCTV system shall:
(a) incorporate a camera covering each of the entrance doors and the main alcohol display area;
(b) be capable of providing identification standard image quality;
(c) subject to compliance with Data Protection legislation, have cameras precisely positioned as may be agreed from time to time between the premises licence holder and the Police;
(d) incorporate a recording facility with any recording to be retained and stored in a suitable and secure manner for a minimum period of 30 (thirty) days. Recordings shall be made available to the Police for inspection upon request, subject to compliance with Data Protection legislation;
(e) be able to export recorded images to removable media (for example CD or DVD) and have its own software enabled to allow playback and review; and
(f) display, on any recording, the correct time and date of the recording.
2.3 A member of staff trained in the use of the CCTV system shall be available at the licensed premises at all times whilst the premises are open to the public.
2.4 The premises licence holder shall at all times maintain adequate levels of staff and security on the licensed premises to ensure promotion of the licensing objectives, with such levels of staff and security to be disclosed to the Licensing Authority and/or Police upon request.
2.5 Signage shall be displayed and maintained at the exit of the licensed premises requesting that customers who are leaving the premises late at night do so quietly and with consideration so as to not disturb nearby residents.
2.6 The premises licence holder shall ensure that an age verification policy will apply to the licensed premises whereby all cashiers shall be trained to ask any customer attempting to purchase alcohol, who appears to be under the age of 25 years (or older if the premises licence holder so elects) to produce, before being sold alcohol, identification being a passport or photocard driving licence bearing a holographic mark or other form of identification bearing the customer’s photograph, date of birth and the Proof of Age Standards Scheme (or similarly accredited scheme) hologram.
ANNEX 3 - CONDITIONS ATTACHED AFTER A HEARING BY THE LICENSING AUTHORITY
