ANNEX 1 - MANDATORY CONDITIONS
The following conditions in Annex 1 are mandatory under the provisions of the Licensing Act 2003:
1. Alcohol shall not be sold or supplied:
(a) At any time when there is no designated premises supervisor in respect of the
premises licence, or
(b) At any time when the designated premises supervisor does not hold a personal licence or his/her personal licence is suspended
2. Every sale or supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.
3. The responsible person shall take all reasonable steps to ensure that staff on relevant premises do not carry out, arrange or participate in any irresponsible promotions in relation to the premises.
In this paragraph, an irresponsible promotion means any one or more of the following activities, or substantially similar activities, carried on for the purpose of encouraging the sale or supply of alcohol for consumption on the premises in a manner which carries a significant risk of leading or contributing to crime and disorder, prejudice to public safety, public nuisance, or harm to children -
(a) games or other activities which require or encourage, or are designed to require or
encourage, individuals to -
(i) drink a quantity of alcohol within a time limit (other than to drink alcohol sold or
supplied on the premises before the cessation of the period in which the responsible
person is authorised to sell or supply alcohol), or
(ii) drink as much alcohol as possible (whether within a time limit or otherwise);
(b) provision of unlimited or unspecified quantities of alcohol free or for a fixed or
discounted fee to the public or to a group defined by a particular characteristic (other than
any promotion or discount available to an individual in respect of alcohol for
consumption at a table meal, as defined in section 159 of the Act);
(c) provision of free or discounted alcohol or any other thing as a prize to encourage or
reward the purchase and consumption of alcohol over a period of 24 hours or less;
(d) provision of free or discounted alcohol in relation to the viewing on the premises of a
sporting event, where that provision is dependent on -
(i) the outcome of a race, competition or other event or process, or
(ii) the likelihood of anything occurring or not occurring;
(e) selling or supplying alcohol in association with promotional posters or flyers on, or in the
vicinity of, the premises which can reasonably be considered to condone, encourage or
glamorise anti-social behaviour or to refer to the effects of drunkenness in any favourable
manner.
4. The responsible person shall ensure that no alcohol is dispensed directly by one person into the mouth of another (other than where that other person is unable to drink without assistance by reason of a disability).
5. The responsible person shall ensure that free tap water is provided on request to customers where it is reasonably available.
6. (a) The premises licence holder or club premises certificate holder shall ensure that an age verification policy applies to the premises in relation to the sale or supply of alcohol.
(b) The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and a holographic mark.
7. The responsible person shall ensure that -
(a) where any of the following alcoholic drinks is sold or supplied for consumption on the
premises (other than alcoholic drinks sold or supplied having been made up in advance
ready for sale or supply in a securely closed container) it is available to customers in the
following measures -
(i) beer or cider: ½ pint;
(ii) gin, rum, vodka or whisky: 25 ml or 35 ml; and
(iii) still wine in a glass: 125 ml; and
(b) customers are made aware of the availability of these measures.
8. The admission of children to the exhibition of any film shall be restricted in accordance with the film classification awarded by the British Board of Film Classification (BBFC), or any successor person or persons designated as the authority under section 4 of the Video Recordings Act 1984.
ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
The following conditions in Annex 2 are conditions consistent with the operating schedule submitted by the applicant within the application:
1. Films showings events for ‘Film Club’ to be limited to 4 (four) Saturdays per calendar annum and films activity shall be authorised until 00:30hrs for such occasions. For the avoidance of doubt this frequency limit shall not restrict any regulated film playback activity as background to other activities at the licensed premises, nor impact upon any exemptions in relation to film activity afforded by Schedule 1 to the Licensing Act 2003.
2. Any recorded music activity held at the licensed premises shall be background, incidental or ancillary only to other activities and be played at low volume. Recorded music shall not be permitted to pre-dominate other activities at the licensed premises.
3. The supply of alcohol shall be as part of a wine bar/bistro/coffee shop type establishment and shall not be the primary or exclusive activity or use at the licensed premises.
4. The consumption of alcohol within the boundary of the licensed premises and grounds shall be limited to the areas identified on the plan attached to the premises licence as Annex 4. For the avoidance of doubt off sales of alcohol supplied from the premises shall not be permitted to be consumed in any non-consumption areas of the premises.
5. Where projected film showings involve the presence of higher risk materials, in particular highly flammable nitrate film, the premises licence holder shall carry out a suitable and sufficient risk assessment and ensure that all films and equipment are securely stored so as to minimise any risk to public safety. It is recommended that the premises licence holder seeks prior guidance from the Fire Safety Officer where such materials are to be stored or used on the licensed premises.
6. A personal licence holder shall be on duty and readily contactable on all occasions whilst the licensed premises are open for the supply of alcohol.
7. The premises licence holder shall operate a Challenge 25 policy to assist with the prevention of underage sales, with all staff to require a valid photo identity proof of age document (i.e. photo card driving licence, passport or PASS approved holographic identity card) for those persons requesting supply of alcohol who appear to be under the age of 25.
8. The premises licence holder, or their nominated representative, shall participate in the local Pub Watch or similar scheme (where such as scheme operates in the locality of the licensed premises) with staff to be fully briefed concerning exclusion of banned individuals and other relevant information relating to the prevention of crime and disorder.
9. The premises licence holder shall ensure that they remain familiar with any prevalent local crime and disorder issues via close liaison with the local Police and accessing relevant sources of local information (for example Safer Neighbourhood Team meetings or website material).
10. Staff of duty shall regularly check the toilet areas of the licensed premises to promote the prevention of crime and disorder objective, and shall also ensure that the behaviour of patrons is monitored so as to ensure that excessive consumption of alcohol is not permitted on the premises.
11. Staff on duty shall ensure that patrons are requested to leave the premises and vicinity quietly and with consideration to the needs of neighbouring properties - both residential and business. A logbook shall be legibly maintained on the licensed premises to record any incidents or complaints of nuisance or anti-social behaviour caused by attendees at the licensed premises. The logbook shall be made available for inspection upon request to an authorised officer of the Licensing Authority or Police.
12. All doors and windows shall be kept closed, save for access or egress, during any events or licensed activities at the premises with an elevated risk of noise breakout - whether by the nature of the event or the attendees present.
13. Children shall not be permitted on the licensed premises at any time whilst it is open for licensable activities unless accompanied by a responsible individual aged 18 or over.
14. There shall be no adult entertainment or services, activities, or other entertainment or matters ancillary to the use of the premises that may give rise to concern in respect of children.
