ANNEX 1 - MANDATORY CONDITIONS
The following conditions in Annex 1 are mandatory under the provisions of the Licensing Act 2003:
1.1 Alcohol shall not be sold or supplied:
(a) At any time when there is no designated premises supervisor in respect of the
premises licence, or
(b) At any time when the designated premises supervisor does not hold a personal licence or his/her personal licence is suspended
1.2 Every sale or supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.
1.3 (a) The premises licence holder shall ensure that an age verification policy applies to the premises in relation to the sale or supply of alcohol.
(b) The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and a holographic mark.
ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
The following conditions in Annex 2 are conditions consistent with the operating schedule submitted by the applicant within the application:
2.1 The licensed premises shall trade as a petrol forecourt/convenience store operation of which alcohol sales shall form only part of the business. Alcohol sales shall not be the primary or exclusive activity at the licensed premises.
2.2 CCTV shall be provided in the form of a digital recordable system covering the licensed area of the premises. Recordings shall be retained for a minimum period of 31 (thirty-one) days with copies made available to the Police upon request. It should be noted that any retention, use or disclosure of personal information captured on CCTV must be carried out in line with data protection principles.
2.3 Suitable and sufficient staff training shall be given, satisfactorily completed and recorded. Training shall include up to date and relevant licensing law and issues relating to the sale of alcohol.
2.4 The premises licence holder shall adopt a ‘Challenge 25’ proof of age scheme. The premises licence holder shall operate a requirement for the production of a passport, photo driving licence or PASS hologram identity card where the individual requesting the supply of alcohol appears to be under the age of 25.
2.5 The premises licence holder shall compile and maintain a refusals book containing records of instances/persons who have been refused sale of alcohol.
2.6 Cash tills used for the sale of alcohol shall have the benefit of electronic ‘prompts’ for operators in respect of age restricted sales.
2.7 The licensed premises shall be installed with a panic alarm device in the counter area.
2.8 The entrance and forecourt to the licensed premises shall be suitably and sufficiently illuminated during the hours of darkness, whilst the premises are open for licensed activities.
2.9 There shall be no adult entertainment or services, activities, other entertainment or matters ancillary to the use of the premises that may give rise to concern in respect of children.
2.10 Sales of alcohol shall not include any super strength lagers, beers or cider where the strength exceeds 6.5% ABV (alcohol by volume). For the avoidance of doubt this restriction shall not apply to the sale of specialist branded alcoholic beverages.
ANNEX 3 - CONDITIONS ATTACHED AFTER A HEARING BY THE LICENSING AUTHORITY
