ANNEX 1 - MANDATORY CONDITIONS
The following conditions in Annex 1 are mandatory under the provisions of the Licensing Act 2003:
1.1 Alcohol shall not be sold or supplied:
(a) At any time when there is no designated premises supervisor in respect of the
premises licence, or
(b) At any time when the designated premises supervisor does not hold a personal licence or his/her personal licence is suspended
1.2 Every sale or supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.
1.3 Where one or more individuals are being used at the licensed premises to carry out a security activity, each such individual must be licensed by the Security Industry Authority (unless where the individual is exempt from obtaining an SIA registration under the Private Security Industry Act 2001).
1.4 The responsible person shall take all reasonable steps to ensure that staff on relevant premises do not carry out, arrange or participate in any irresponsible promotions in relation to the premises.
In this condition, an irresponsible promotion means any one or more of the following activities, or substantially similar activities, carried on for the purpose of encouraging the sale or supply of alcohol for consumption on the premises in a manner which carries a significant risk of leading or contributing to crime and disorder, prejudice to public safety, public nuisance, or harm to children -
(a) games or other activities which require or encourage, or are designed to require or
encourage, individuals to -
(i) drink a quantity of alcohol within a time limit (other than to drink alcohol sold or
supplied on the premises before the cessation of the period in which the responsible
person is authorised to sell or supply alcohol), or
(ii) drink as much alcohol as possible (whether within a time limit or otherwise);
(b) provision of unlimited or unspecified quantities of alcohol free or for a fixed or
discounted fee to the public or to a group defined by a particular characteristic (other than
any promotion or discount available to an individual in respect of alcohol for
consumption at a table meal, as defined in section 159 of the Act);
(c) provision of free or discounted alcohol or any other thing as a prize to encourage or
reward the purchase and consumption of alcohol over a period of 24 hours or less;
(d) provision of free or discounted alcohol in relation to the viewing on the premises of a
sporting event, where that provision is dependent on -
(i) the outcome of a race, competition or other event or process, or
(ii) the likelihood of anything occurring or not occurring;
(e) selling or supplying alcohol in association with promotional posters or flyers on, or in the
vicinity of, the premises which can reasonably be considered to condone, encourage or
glamorise anti-social behaviour or to refer to the effects of drunkenness in any favourable
manner.
1.5 The responsible person shall ensure that no alcohol is dispensed directly by one person into the mouth of another (other than where that other person is unable to drink without assistance by reason of a disability).
1.6 The responsible person shall ensure that free tap water is provided on request to customers where it is reasonably available.
1.7 (a) The premises licence holder or club premises certificate holder shall ensure that an age verification policy applies to the premises in relation to the sale or supply of alcohol.
(b) The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and a holographic mark.
1.8 The responsible person shall ensure that -
(a) where any of the following alcoholic drinks is sold or supplied for consumption on the
premises (other than alcoholic drinks sold or supplied having been made up in advance
ready for sale or supply in a securely closed container) it is available to customers in the
following measures -
(i) beer or cider: ½ pint;
(ii) gin, rum, vodka or whisky: 25 ml or 35 ml; and
(iii) still wine in a glass: 125 ml; and
(b) customers are made aware of the availability of these measures.
ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
The following conditions in Annex 2 are conditions consistent with the operating schedule submitted by the applicant within the application:
2.1 The maximum number of persons permitted onto the licensed site for the event performances at any one time (including including staff, volunteers and performers) shall not exceed 700 (seven hundred).
2.2 The premises licence holder shall create and implement an Event Management Plan (EMP) to promote the licensing objectives. A final version of the EMP and up to date site plans shall be sent by the premises licence holder to the Licensing Authority and all Responsible Authorities no later than 14 (fourteen) days prior to the day of the event. Any proposed revisions to the EMP shall be agreed in writing with the relevant Responsible Authority before the master EMP is updated - which shall be as soon as reasonably practicable following the revision being agreed. The premises licence, event management plan and risk assessments shall be kept with all other event documentation in the event control for the duration of the festival and this location shall be clearly identified on the site plan.
2.3 Supply of alcohol shall be available for consumption in the immediate vicinity of the performance only and not in the wider area of the site.
2.4 Any amplified music shall be as a background part of the performance of a play only and integral to the performance. Amplified music shall not be permissible so as to pre-dominate other activities taking place and suitable limits on noise shall be set in accordance with the premises licence holder’s public nuisance risk assessment.
2.5 All stewards shall be fully briefed on the emergency plan and public safety measures in place for the event prior to the commencement of any licensable activity.
2.6 The premises licence holder shall ensure that suitable and sufficient public safety checks and risk assessments of the site are completed, and determined satisfactory, prior to any admission of the public to the licensed premises.
2.7 The premises licence holder shall ensure that access routes for emergency vehicles coming onto the site are maintained and kept clear from any obstruction.
2.8 The premises licence holder shall ensure that adequate arrangements exist for the safe evacuation of any disabled persons on the licensed site, in the event of an emergency situation. Persons on the site for the performance shall be made aware of evacuation procedures by the premises licence holder.
2.9 The premises licence holder shall ensure that an adequate and appropriate supply of first aid equipment and materials are available on the premises during any licensable activities.
2.10 A minimum of one trained first aider shall be on site for the duration of any licensable activities. Where more than one trained first aider is present on the site then their respective duties shall be clearly defined in advance of any public activities taking place.
2.11 All exits routes from the performance site shall be clearly signed, with exits kept unobstructed.
2.12 The premises licence holder shall ensure that traffic is adequately managed, signed and directed so as to ensure the safe access and egress of vehicles at the site.
2.13 The premises licence holder shall ensure that local residents are kept clearly communicated concerning arrangements for the event so as to minimise any risk of public nuisance complaints.
2.14 The premises licence holder shall ensure that all staff and volunteers who may have a child protection role (for example reuniting lost children with their accompanying adult) shall be subject to prior criminal records checking, where this is permissible under the Disclosure and Barring Service (DBS) scheme.
2.15 Children shall be accompanied by a responsible adult at all times, for the duration of the event, whilst they are on the licensed site.
2.16 There shall be no adult entertainment or services, activities, other entertainment or matters ancillary to the use of the premises that may give rise to concern in respect of children.
