ANNEX 1 - MANDATORY CONDITIONS:
The following conditions in Annex 1 are mandatory under the provisions of the Licensing Act 2003:
1. Every supply of alcohol under the premises licence must be made or authorised by the Leavenheath Village Hall Management Committee.
2. Where one or more individuals are being used at the licensed premises to carry out a security activity, each such individual must be licensed by the Security Industry Authority (unless where the individual is exempt from obtaining an SIA registration under the Private Security Industry Act 2001).
3. The admission of children to the exhibition of any film shall be restricted in accordance with the film classification awarded by the British Board of Film Classification (BBFC), or any successor person or persons designated as the authority under section 4 of the Video Recordings Act 1984.
4. The responsible person shall take all reasonable steps to ensure that staff on relevant premises do not carry out, arrange or participate in any irresponsible promotions in relation to the premises.
In this paragraph, an irresponsible promotion means any one or more of the following activities, or substantially similar activities, carried on for the purpose of encouraging the sale or supply of alcohol for consumption on the premises in a manner which carries a significant risk of leading or contributing to crime and disorder, prejudice to public safety, public nuisance, or harm to children -
(a) games or other activities which require or encourage, or are designed to require or
encourage, individuals to -
(i) drink a quantity of alcohol within a time limit (other than to drink alcohol sold or
supplied on the premises before the cessation of the period in which the responsible
person is authorised to sell or supply alcohol), or
(ii) drink as much alcohol as possible (whether within a time limit or otherwise);
(b) provision of unlimited or unspecified quantities of alcohol free or for a fixed or
discounted fee to the public or to a group defined by a particular characteristic (other than
any promotion or discount available to an individual in respect of alcohol for
consumption at a table meal, as defined in section 159 of the Act);
(c) provision of free or discounted alcohol or any other thing as a prize to encourage or
reward the purchase and consumption of alcohol over a period of 24 hours or less;
(d) provision of free or discounted alcohol in relation to the viewing on the premises of a
sporting event, where that provision is dependent on -
(i) the outcome of a race, competition or other event or process, or
(ii) the likelihood of anything occurring or not occurring;
(e) selling or supplying alcohol in association with promotional posters or flyers on, or in the
vicinity of, the premises which can reasonably be considered to condone, encourage or
glamorise anti-social behaviour or to refer to the effects of drunkenness in any favourable
manner.
6. The responsible person shall ensure that no alcohol is dispensed directly by one person into the mouth of another (other than where that other person is unable to drink without assistance by reason of a disability).
7. The responsible person shall ensure that free tap water is provided on request to customers where it is reasonably available.
8. (a) The premises licence holder or club premises certificate holder shall ensure that an age verification policy applies to the premises in relation to the sale or supply of alcohol.
(b) The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and a holographic mark.
9. The responsible person shall ensure that -
(a) where any of the following alcoholic drinks is sold or supplied for consumption on the
premises (other than alcoholic drinks sold or supplied having been made up in advance
ready for sale or supply in a securely closed container) it is available to customers in the
following measures -
(i) beer or cider: ½ pint;
(ii) gin, rum, vodka or whisky: 25 ml or 35 ml; and
(iii) still wine in a glass: 125 ml; and
(b) customers are made aware of the availability of these measures.
ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE:
The following conditions in Annex 2 are conditions consistent with the operating schedule submitted by the applicant within the application:
1. The premises licence shall be used only for activities and functions organised and operated by or on behalf of Leavenheath Village Hall Management Committee, unless a function has been reviewed and specifically approved by the Leavenheath Village Hall Management Committee. External hirers of the licensed premises shall normally be directed to use the separate Temporary Event Notice system.
2. During all events involving licensable activities under the authority of premises licence BPL0212, a member of the Leavenheath Village Hall Management Committee shall be present at, or else contactable during or immediately after, the event/licensed activity.
3. All hirers of the licensed premises shall be given conditions of hire by the Leavenheath Village Hall Management Committee and these conditions shall reflect relevant licensing terms and conditions. In addition, these hiring conditions shall be verbally confirmed to the hirer by the booking secretary (or other responsible individual nominated for that purpose).
4. The Leavenheath Village Hall Management Committee shall have in place a suitable and sufficient vetting process for reviewing, authorising and rejecting a hiring request.
5. Alcohol shall only be available for consumption in indoor areas of the licensed premises with no alcohol permitted to be taken outside of the building.
6. All alcohol shall be removed from the licensed premises immediately after the cessation of licensed activities/event or hiring.
7. The procedure to follow in the event of an emergency, identifying the evacuation assembly point, shall be prominently displayed and maintained on the licensed premises.
8. All hirers of the licensed premises shall be verbally advised by the booking secretary, or other responsible individual nominated for that purpose, of (a) the need to leave the premises and immediate vicinity quietly and with respect for local residents, and (b) that no drinking vessels are to be taken off the premises. Suitable signage shall be displayed and maintained on the licensed premises reflecting both of these requirements.
9. All doors and windows at the licensed premises shall be kept closed, save for access or egress, and noise levels shall be kept to an acceptable level.
10. All hirers of the licensed premises shall be aged 18 years or over.
11. Adult supervision shall be required at all times whilst the premises are being used for licensed activities by persons under the age of 18 years.
12. No children shall be permitted on the licensed premises during any age restricted films or any other age restricted events/licensed activities.
13. There shall be no adult entertainment or services, activities, other entertainment or matters ancillary to the use of the premises that may give rise to concern in respect of children.
14. There shall be suitable and sufficient signage displayed and maintained on the licensed premises concerning the prohibition of alcohol sales to under-18s, and advising on drugs and dispersal policies.
15. The licence holders shall maintain an accident, incident and refusals book and make this available upon request to an authorised officer of the Police or Local Authority.
ANNEX 3 - CONDITIONS ATTACHED AFTER A HEARING BY THE LICENSING AUTHORITY:
1: A member of the Leavenheath Village Hall Management Committee, or in the event that this is not possible another responsible person as nominated in writing by the Leavenheath Village Hall Management Committee for that purpose, shall be on duty at the licensed premises on all occasions whilst the licensed premises are being used for the sale or supply of alcohol. For the avoidance of doubt, this condition shall also apply to occasions where the licensed premises are being used for an external hiring involving the sale and supply of alcohol.
2: Self-closing devices shall be fitted to all external doors at the licensed premises, in order to minimise the potential for public nuisance caused by noise breakout.
3: Waste bottles and glass shall not be disposed of into the bottle bank, or similar outdoor waste receptacle, after 22:00hrs on any occasion. The Leavenheath Village Hall Management Committee shall ensure that all hirers of the licensed premises are clearly advised/notified of this requirement.
4: The authorised hours for the sale and supply of alcohol shall be reduced from those proposed within premises licence application 006527 to those now shown of premises licence BPL0212 and summary of it.
