ANNEX 1 - MANDATORY CONDITIONS:
The following conditions in Annex 1 are mandatory under the provisions of the Licensing Act 2003:
1. Alcohol shall not be sold or supplied:
(a) At any time when there is no designated premises supervisor in respect of the
premises licence, or
(b) At any time when the designated premises supervisor does not hold a personal licence or his/her personal licence is suspended
2. Every sale or supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.
3. Where a premises licence includes a condition that at specified times one or more individuals must be at the premises to carry out a security activity, the licence must include a condition that each such individual must be licensed by the Security Industry Authority.
4. Where a premises licence authorises the exhibition of films, the admission of children to the exhibition of any film must be restricted in accordance with the film classification.
5. The responsible person shall take all reasonable steps to ensure that staff on relevant premises do not carry out, arrange or participate in any irresponsible promotions in relation to the premises.
In this paragraph, an irresponsible promotion means any one or more of the following activities, or substantially similar activities, carried on for the purpose of encouraging the sale or supply of alcohol for consumption on the premises in a manner which carries a significant risk of leading or contributing to crime and disorder, prejudice to public safety, public nuisance, or harm to children -
(a) games or other activities which require or encourage, or are designed to require or
encourage, individuals to -
(i) drink a quantity of alcohol within a time limit (other than to drink alcohol sold or
supplied on the premises before the cessation of the period in which the responsible
person is authorised to sell or supply alcohol), or
(ii) drink as much alcohol as possible (whether within a time limit or otherwise);
(b) provision of unlimited or unspecified quantities of alcohol free or for a fixed or
discounted fee to the public or to a group defined by a particular characteristic (other than
any promotion or discount available to an individual in respect of alcohol for
consumption at a table meal, as defined in section 159 of the Act);
(c) provision of free or discounted alcohol or any other thing as a prize to encourage or
reward the purchase and consumption of alcohol over a period of 24 hours or less;
(d) provision of free or discounted alcohol in relation to the viewing on the premises of a
sporting event, where that provision is dependent on -
(i) the outcome of a race, competition or other event or process, or
(ii) the likelihood of anything occurring or not occurring;
(e) selling or supplying alcohol in association with promotional posters or flyers on, or in the
vicinity of, the premises which can reasonably be considered to condone, encourage or
glamorise anti-social behaviour or to refer to the effects of drunkenness in any favourable
manner.
6. The responsible person shall ensure that no alcohol is dispensed directly by one person into the mouth of another (other than where that other person is unable to drink without assistance by reason of a disability).
7. The responsible person shall ensure that free tap water is provided on request to customers where it is reasonably available.
8. (a) The premises licence holder or club premises certificate holder shall ensure that an age verification policy applies to the premises in relation to the sale or supply of alcohol.
(b) The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and a holographic mark.
9. The responsible person shall ensure that -
(a) where any of the following alcoholic drinks is sold or supplied for consumption on the
premises (other than alcoholic drinks sold or supplied having been made up in advance
ready for sale or supply in a securely closed container) it is available to customers in the
following measures -
(i) beer or cider: ½ pint;
(ii) gin, rum, vodka or whisky: 25 ml or 35 ml; and
(iii) still wine in a glass: 125 ml; and
(b) customers are made aware of the availability of these measures.
ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE:
The following conditions in Annex 2 are conditions consistent with the operating schedule submitted by the applicant within the application:
1. Staff shall receive suitable training in accordance with the licence holders policies and procedures.
2. The licence holder shall participate in a local PubWatch (or similar) scheme where such a scheme operates within the locality of the licensed premises.
3. Plastic or toughened glasses shall be used during beer festivals taking place in external areas of the premises.
4. Litter bins shall be provided and litter shall be collected and managed.
5. All deliveries shall be within the opening times authorised by the premises licence (wherever this is practicable).
6. External lighting shall be provided to the licensed premises. (Note: It may be prudent for the licence-holder to liaise with the local Environmental Health Office to ensure that any lighting does not cause public nuisance).
7. Customer arrival and departure shall be managed by staff on duty at the licensed premises.
8. There shall be no children under the age of 16 permitted in the bar area of the licensed premises after 21:00hrs
9. Signage shall be displayed and maintained on the licensed premises concerning any age restrictions on admission, purchase and consumption of alcohol. Also signage relevant to promotion of the licensing objectives shall be displayed and maintained on the licensed premises at the request of the Local Authority or Suffolk Constabulary.
10. There shall be no admission, or re-admission, to the licensed premises after 23:00hrs or one hour prior to the closure of the premises to the public (whichever is the later). Securing of doors and egress of patrons shall be managed by any staff on duty.
11. In the event that the Licensing Authority receives complaints about noise from live music, which an Environmental Health Officer of that authority considers to be valid, then the premises licence holder shall install an electronic noise limiter of a type to be agreed with the Environmental Health Officer.
The main control unit of the noise limiter (or a remote indicator and remote sound pickup microphone) shall be located at a location within the room where the live music is performed at a location to be agreed with the Environmental Health Officer. The noise limiter shall be wired to the Mains electricity supply to the amplifier(s) that is/are to be used in the licensed activity with the object and intent that the amplifier(s) shall be disabled in the event that the relevant noise levels are exceeded.
The trigger level for the noise limiter shall be set at a level to be agreed in writing with the Environmental Health Officer*. The noise limiter shall be retained thereafter and used at all times during a licensed live music activity. Once the limit has been set, the noise limiter shall be secured with a tamper-proof seal with a unique identification reference number. The premises licence holder shall maintain a log book to record the date and time of all occasions when the tamper-proof seal is broken, by whom, the reason, and the unique reference number of the replacement seal(s). The log book records shall be retained on the licensed premises for a minimum of two years and shall be made available for inspection immediately upon the request of an authorised officer of the Licensing Authority.
* the trigger level shall be set at a level such that noise emitted from the premises during the playing of live music does not exceed the following criteria: the 5-minute LAeq (EN) shall not exceed the LA90 (WEN) and the L10 (EN) shall not exceed the L90 (WEN) in any 1/3 octave band between 40 and 160Hz; where: EN = Entertainment noise level; WEN = Representative background noise level without the entertainment noise; both measured 1m from the façade of the nearest noise sensitive premises.
12. A log book of events involving licensable music activities shall be maintained, and shall record the dates and times of all such events. The log book records shall be retained on the licensed premises and held for a minimum of two years and be made available for inspection immediately upon the request of an authorised officer of the Licensing Authority.
13. A risk register shall be maintained and kept at the licensed premises.
14. A refusals register shall be maintained and kept at the licensed premises.
15. Prominent notices on site for customers to leave quietly and with respect to local neighbours.
16. Lobbies to the front and rear entrance doors to the bar and to the restaurant shall be retained so that access and egress from these parts of the building is through two doors with an intervening lobby space. All doors to these lobbies shall be fitted and maintained with self-closing devices. maintained, and doors fitted with self-closing device
17. All external doors and windows to be kept closed (save for access/egress) during any playing of music with appropriate air conditioning installed if necessary.
18. The volume control or sound configuration of recorded music or any amplification equipment shall be under direct control of designated premises supervisor (DPS) or their nominated representative with provision made for the sound to be turned down at the direct request of an authorised officer of the Local Authority or Police.
19. In the Private Dining/Meeting Room of the licensed premises the playing of recorded music and the performance of live music shall be restricted to solely background/incidental type music.
ANNEX 3 - CONDITIONS ATTACHED AFTER A HEARING BY THE LICENSING AUTHORITY:
1. There shall be no OFF-sales of alcohol from the licensed premises after 23:00hrs on a Monday to Saturday or after 22:30hrs on a Sunday.
2. No alcohol shall be permitted to be taken off the licensed premises unless it is in a sealed container.
3. The agreed cessation of any live music activity by 23:00hrs on a Wednesday shall be extended to include the activities of ‘entertainment of a similar description to live music, recorded music or performance of dance’ and ‘provision of facilities for making music’ - and as now shown on premises licence BPL0042 and summary of it. For the avoidance of doubt there shall be no karaoke type activity after 23:00hrs on a Wednesday.
