ANNEX 1 - MANDATORY CONDITIONS:
The following conditions in Annex 1 are mandatory under the provisions of the Licensing Act 2003:
1. Alcohol shall not be sold or supplied:
(a) At any time when there is no designated premises supervisor in respect of the
premises licence, or
(b) At any time when the designated premises supervisor does not hold a personal licence or his/her personal licence is suspended
2. Every sale or supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.
3. The admission of children to the exhibition of any film shall be restricted in accordance with the film classification awarded by the British Board of Film Classification (BBFC), or any successor person or persons designated as the authority under section 4 of the Video Recordings Act 1984.
4. Where one or more individuals are being used at the licensed premises to carry out a security activity, each such individual must be licensed by the Security Industry Authority.
5. The responsible person shall take all reasonable steps to ensure that staff on relevant premises do not carry out, arrange or participate in any irresponsible promotions in relation to the premises.
In this paragraph, an irresponsible promotion means any one or more of the following activities, or substantially similar activities, carried on for the purpose of encouraging the sale or supply of alcohol for consumption on the premises in a manner which carries a significant risk of leading or contributing to crime and disorder, prejudice to public safety, public nuisance, or harm to children -
(a) games or other activities which require or encourage, or are designed to require or
encourage, individuals to -
(i) drink a quantity of alcohol within a time limit (other than to drink alcohol sold or
supplied on the premises before the cessation of the period in which the responsible
person is authorised to sell or supply alcohol), or
(ii) drink as much alcohol as possible (whether within a time limit or otherwise);
(b) provision of unlimited or unspecified quantities of alcohol free or for a fixed or
discounted fee to the public or to a group defined by a particular characteristic (other than
any promotion or discount available to an individual in respect of alcohol for
consumption at a table meal, as defined in section 159 of the Act);
(c) provision of free or discounted alcohol or any other thing as a prize to encourage or
reward the purchase and consumption of alcohol over a period of 24 hours or less;
(d) provision of free or discounted alcohol in relation to the viewing on the premises of a
sporting event, where that provision is dependent on -
(i) the outcome of a race, competition or other event or process, or
(ii) the likelihood of anything occurring or not occurring;
(e) selling or supplying alcohol in association with promotional posters or flyers on, or in the
vicinity of, the premises which can reasonably be considered to condone, encourage or
glamorise anti-social behaviour or to refer to the effects of drunkenness in any favourable
manner.
6. The responsible person shall ensure that no alcohol is dispensed directly by one person into the mouth of another (other than where that other person is unable to drink without assistance by reason of a disability).
7. The responsible person shall ensure that free tap water is provided on request to customers where it is reasonably available.
8. (a) The premises licence holder or club premises certificate holder shall ensure that an age verification policy applies to the premises in relation to the sale or supply of alcohol.
(b) The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and a holographic mark.
9. The responsible person shall ensure that -
(a) where any of the following alcoholic drinks is sold or supplied for consumption on the
premises (other than alcoholic drinks sold or supplied having been made up in advance
ready for sale or supply in a securely closed container) it is available to customers in the
following measures -
(i) beer or cider: ½ pint;
(ii) gin, rum, vodka or whisky: 25 ml or 35 ml; and
(iii) still wine in a glass: 125 ml; and
(b) customers are made aware of the availability of these measures.
Annex 2 - Conditions consistent with the operating schedule
General
There shall be not more than 10 outdoor music/regualted entertainment events per calndar annum.
Following an assessment of the premises and its surrounding area the following is proposed:
30 minute "drinking up" time will allow appropriate dispersal, use of lavatories etc.
In order to further the licensing objective the licensee reserves the right to move the fire
appliances, AWP machines, cigarette machines and or any other similar objects temporarily
in a fixed location which may impact on the ability of individuals on the premises to use exits
or escape routes without impediment.
The prevention of crime and disorder
Illumination is provided to the exterior areas of the pub.
All interior trading areas are visible to staff from behind the bar servery.
A rota system in place for checking the toilets-toilets checked regularly.
The licensee/staff monitor customer behaviour especially during busy periods.
Burglar alarm system in place, alarmed doors and windows/secure windows.
Toilets access is clearly visible from the bar.
Drug prevention measures are employed, and signs displayed.
Drink drive posters on site.
I will install Video/CCTV equipment inside/outside the premises and ensure that it is
maintained in working order.
I will set Video/CCTV equipment to record from the time that the premises open to the public
until the premises close and all members of the public have left.
I will ensure that any cameras covering the exterior of the premises are left to record for the
duration of the tape and for a period not less than 24 hours. (Where members of the public
congregate outside the premises after they are closed)
I will ensure that monitoring tapes are retained for at least twenty eight days and are
produced to an authorised officer on demand.
I will put up notices advising that CCTV has been installed on the premises so that they are
clearly visible to the public within the licensed premises.
Where glass bottles are used, they will be retained or disposed of on the premises.
I will ensure that the consumption of alcohol is restricted to the areas identified on the plan
attached to the operating schedule.
I will adopt and comply with the British Beer and Pub Associations Guidelines on On-Trade
Promotions.
I will be responsible for the disposal of waste on the frontage of the premises and make
provision for the emptying of litter bins in the vicinity of the premises.
Public Safety
Health and Safety policy in place and adhered to.
A quarterly risk assessment carried out.
All fire fighting equipment is serviced annually.
A fire alarm test is carried out weekly.
All portable electrical appliances are tested annually.
There are current electric and gas certificates in place.
Mechanical extraction is provided in each bar.
A pest control is in place.
The pub promotes a licensed taxi service to facilitate its customers making onward journeys.
I will make sure that escape routes and exits, including external exits, are maintained to
ensure that they are not obstructed, in good order with non-slippery and even surfaces, free
of trip hazards and clearly identified.
I will make sure that where chairs and tables are provided, internal gangways are kept
unobstructed.
I will make sure that all exit doors are easily openable and do not require the use of a key,
card, code or similar means.
I will make sure that doors at such exits are regularly checked to ensure that they function
satisfactorily and a record of the check is kept.
I will make sure that the edges of the treads of steps and stairways are maintained so as to
be conspicuous.
I will make sure that when disabled people are present, adequate arrangements exist to
enable their safe evacuation in the event of an emergency, and that patrons are made aware
of these arrangements;
I will make sure that adequate and appropriate supply of first aid equipment and materials is
available on the premises.
In the absence of adequate daylight, I will make sure that the lighting in any area accessible
to the public is fully operational;
I will make sure that I have valid public liability insurance in force and that a copy of the
schedule is available for inspection by an authorised officer on request
I will not alter the premises in such a way as to make it impossible to comply with an existing
licence condition, without first seeking a variation of the premises licence.
(N.B this will enable you to propose the amendment of any conditions that you would not be
able to comply with upon completion of works)
The prevention of public nuisance
There are no opening windows in the bar area.
When required, staff organise taxis to transport customers home and customers are seen off
the premises and encouraged to disperse at closing.
Being a detached property there are no adjoining neighbours and residential
accommodation in the immediate area is minimal.
The fact that this public house is a detached property assists in minimising noise transfer to
neighbours.
We are gradually phasing out of standard glasses and replacing with toughened glasses.
Cellar cooling condenser is position in an area so not to cause nuisance to neighbours/is
sound proofed.
Please respect our neighbours and leave quietly sign.
I will display prominent, clear and legible notices at all exits requesting patrons to respect the
needs of local residents and to leave the premises and the area quietly;
I will make sure that the placing of bottles into receptacles outside the premises takes place
at times that will minimise disturbance to nearby properties;
I will make sure that any request by an authorised officer of the Council in relation to
reducing noise levels is complied with.
I will nominate a person to be responsible for monitoring noise levels and instruct that person
to implement changes in noise levels in accordance with any request by an authorised
officer of the Council immediately and ensure that volume is maintained at the reduced level.
(Note: this may be more relevant at an outdoor event)
I will ensure that no amplified sound (including public announcements) in connection with the
event continues beyond the permitted hours of the entertainment.
(Note: this may be more relevant at an outdoor event)
I will ensure that offensive smells from the licensed premises are not permitted so as to
cause a nuisance to nearby properties and the premises are properly vented.
Ensure that receptacles for waste are emptied regularly to minimise nuisance smells.
I will ensure that flashing or particularly bright lights on or outside the licensed premises do
not cause a nuisance to nearby properties, whilst balancing the need for lighting in the
interests of prevention of crime and disorder.
I will provide adequate and suitable (lidded) receptacles to receive and store refuse from the
premises/site
I will make sure that receptacles for refuse storage are maintained in a clean condition.
I will make sure litter is regularly cleared from the vicinity of the premises
The protection of children from harm
Unaccompanied children are not permitted on the premises and all children are not
permitted on the premises after 21:00.
Children are not permitted in the bar, save access to the garden and use of toilets.
AWP is positioned in sight of the bar counter.
The AWP and Cigarette machine are adjacent to one another and in close proximity to the
bar counter and therefore easily observed.
Pub has children's menu and suitable soft drinks to promote family atmosphere.
I will require that children under the age of 12 are accompanied by adults after 11pm in the
evening.
Note: The above condition may be appropriate for any premises NOT serving alcohol for
consumption on the premises, but where the public are allowed on the premises after 11pm
in the evening. Applicants wishing to allow access to premises to unaccompanied children
under the age of 12 after 11pm should address in their operating plan their reasons and
explain the steps that they intend to take to protect children from harm.
Children are not permitted up to the bar counter.
Annex 3 - Conditions attached after a hearing by the licensing authority
1) All windows and doors are kept closed during events which involve the use of music,
2) Any external lighting must be angled downwards to maximise the light in the area
where people need to see, and to minimise the risk of light pollution to nearby
residents.

hours for such amplified music shall be between 12 noon and 23:00 hours only.
Conditions, terms and restrictions to be removed
Remove embedded restrictions - under Licensing Act 1964
Under performances of Live Music remove - Live music-amplified or/and unamplified to be
played by no more than two entertainers.
Under Playing of recorded music remove - Amplified recorded music ancillary to Sale of
Alcohol.
