ANNEX 1 - MANDATORY CONDITIONS
The following conditions in Annex 1 are mandatory under the provisions of the Licensing Act 2003, and apply to all premises licences of this type:
M.1 Alcohol shall not be sold or supplied:
(a) At any time when there is no designated premises supervisor in respect of the
premises licence, or
(b) At any time when the designated premises supervisor does not hold a personal licence or his/her personal licence is suspended
M.2 Every sale or supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.
M.3 Where one or more individuals are being used at the licensed premises to carry out a security activity, each such individual must be licensed by the Security Industry Authority.
M.4 The responsible person shall take all reasonable steps to ensure that staff on relevant premises do not carry out, arrange or participate in any irresponsible promotions in relation to the premises.
In this paragraph, an irresponsible promotion means any one or more of the following activities, or substantially similar activities, carried on for the purpose of encouraging the sale or supply of alcohol for consumption on the premises in a manner which carries a significant risk of leading or contributing to crime and disorder, prejudice to public safety, public nuisance, or harm to children -
(a) games or other activities which require or encourage, or are designed to require or encourage, individuals to -
(i) drink a quantity of alcohol within a time limit (other than to drink alcohol sold or supplied on the premises before the cessation of the period in which the responsible person is authorised to sell or supply alcohol), or
(ii) drink as much alcohol as possible (whether within a time limit or otherwise);
(b) provision of unlimited or unspecified quantities of alcohol free or for a fixed or
discounted fee to the public or to a group defined by a particular characteristic (other than any promotion or discount available to an individual in respect of alcohol for
consumption at a table meal, as defined in section 159 of the Act);
(c) provision of free or discounted alcohol or any other thing as a prize to encourage or reward the purchase and consumption of alcohol over a period of 24 hours or less;
(d) provision of free or discounted alcohol in relation to the viewing on the premises of a sporting event, where that provision is dependent on -
(i) the outcome of a race, competition or other event or process, or
(ii) the likelihood of anything occurring or not occurring;
(e) selling or supplying alcohol in association with promotional posters or flyers on, or in the vicinity of, the premises which can reasonably be considered to condone, encourage or glamorise anti-social behaviour or to refer to the effects of drunkenness in any favourable manner.
M.5 The responsible person shall ensure that no alcohol is dispensed directly by one person into the mouth of another (other than where that other person is unable to drink without assistance by reason of a disability).
M.6 The responsible person shall ensure that free tap water is provided on request to customers where it is reasonably available.
M.7 (a) The premises licence holder or club premises certificate holder shall ensure that an age verification policy applies to the premises in relation to the sale or supply of alcohol.
(b) The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and a holographic mark.
M.8 The responsible person shall ensure that -
(a) where any of the following alcoholic drinks is sold or supplied for consumption on the premises (other than alcoholic drinks sold or supplied having been made up in advance ready for sale or supply in a securely closed container) it is available to customers in the following measures -
(i) beer or cider: ½ pint;
(ii) gin, rum, vodka or whisky: 25 ml or 35 ml; and
(iii) still wine in a glass: 125 ml; and
(b) customers are made aware of the availability of these measures.
Annex 2 - Conditions consistent with the operating schedule
General
Variation will allow my customers to go out into an enclosed Patio Smoking area which will
be supervises by my door staff and covered by CCTV. This will mean nobody needs to be
outside the front of my Premises except when arriving or departing.
Prevention of crime and disorder
We provide door staff when the nightclub is open.
We have CCTV both inside and outside the premises.
We have town link police radio on when the club is open.
We are a member of pub watch.
Having my customers in my own enclosed Patio area will reduce disorder.
I will use or employ door supervisors at all times when a licensable activity is being carried
out and I consider them necessary to:
Prevent the admission and ensure the departure from the premises of drunk and disorderly
persons, without causing further disorder;
Keep out excluded individuals (subject to court or pub watch bans)
Search and exclude persons suspected of carrying illegal drugs or offensive weapons; or
Maintain an orderly queue outside the venue.
I will ensure that any Door Supervisors used are registered by the Security Industry
Authority. (N.b. This is a mandatory condition where Door Supervisors are employed or
used on a licensed premises)
I will make sure that a female supervisor will be available if searches are to be conducted on
female customers.(subject to availability)
I will make sure that where there are 5 or more door supervisors, at least one of these will be
female.
I will provide a means of two way communication to report incidents between
the premises and the local police or CCTV monitoring centre.
I will install Video/CCTV equipment inside/outside the premises and ensure that it is
maintained in working order.
I will set Video/CCTV equipment to record from the time that the premises open to the public
until the premises close and all members of the public have left.
I will ensure that any cameras covering the exterior of the premises are left to record for the
duration of the tape and for a period not less than 1 hour (please specify). (Where members
of the public congregate outside the premises after they are closed)
I will ensure that monitoring tapes are retained for at least twenty eight days and are
produced to an authorised officer on demand.
I will put up notices advising that CCTV has been installed on the premises so that they are
clearly visible to the public within the licensed premises.
Where glass bottles are used, they will be retained or disposed of on the premises.
No customers will be admitted, or permitted to leave when carrying open or sealed bottles or
glasses
I will ensure that the consumption of alcohol is restricted to the areas identified on the plan
attached to the operating schedule.
I will ensure that the maximum occupancy of the licensed premises is restricted at any one
time
I will provide Door Supervisors to ensure that the capacity limit is enforced.
I will ensure that any person selling or supplying alcoholic drink under the authority of a
personal licence holder asks for a photo ID proof of age where they have reason to suspect
that the individual may be under 21 years of age.
I will implement a policy agreed by the Police and local authority (for more information on
this you can refer to the “Safer Clubbing Guide”)
I will ensure that a secure deposit box is kept on the premises for the retention of confiscated
items and ensure that the Police are advised of any items which require safe disposal.
I shall ensure that public information notices about crime and disorder issues are displayed
at the requested of the Council or the Suffolk Constabulary.
(e.g. Customer Code of Conduct)
I will display any restrictions on the admittance of individuals according to age (e.g. Children)
on or immediately outside the premises.
I will display any conditions of entry to the premises in the vicinity of any entrance to the
premises.
I shall participate in the local pub watch/night safe scheme operating in the Borough/District
I will be responsible for the disposal of waste on the frontage of the premises and make
provision for the emptying of litter bins in the vicinity of the premises
I will ensure that lighting is provided outside the premises (and in my private car park) during
the hours of darkness when any licensable activity takes place on the premises.
Public safety
We provide
Fire alarm system
Fire extinguishers
Emergency lighting
adequate fire exits
sound system cut off when fire alarm sounds
Not having anybody outside my premises to the front will reduce the risk of public safety to
the road.
I will make sure that escape routes and exits, including external exits, are maintained to
ensure that they are not obstructed, in good order with non-slippery and even surfaces, free
of trip hazards and clearly identified.
I will make sure that where chairs and tables are provided, internal gangways are kept
unobstructed.
I will make sure that all exit doors are easily openable and do not require the use of a key,
card, code or similar means
I will make sure that doors at such exits are regularly checked to ensure that they function
satisfactorily and a record of the check is kept.
I will make sure that any removable security fastenings are removed whenever the premises
are open to the public or occupied by staff.
I will make sure that all fire doors are maintained effectively self-closing and not held open
other than by approved devices (for example, electromagnetic releases operated by smoke
detectors).
I will make sure that the edges of the treads of steps and stairways are maintained so as to
be conspicuous.
Safety checks are carried out before the admission of the public or club members and
guests; and details of such checks are kept in a Log-book.
I will make sure that Hangings, curtains and temporary decorations are maintained in a
flame-retardant condition
I will make sure that any upholstered seating meets on a continuous basis the pass criteria
for smouldering ignition source 0, flaming ignition source 1 and crib ignition source 5 when
tested in accordance with section 5 of Bs 5852:1990.
I will make sure that Hangings, curtains and temporary decorations are arranged so as not to
obstruct exits, fire safety signs or fire-fighting equipment.
I will make sure that notices detailing the action to be taken in the event of fire or other
emergencies, including how the fire brigade should be summoned, are prominently
displayed and protected from damage and deterioration.
The fire brigade will be called at once to any outbreak of fire, however slight, and the details
recorded in a Fire Log-book.
I in the event of an emergency, and that patrons are made aware of these arrangements; will
make sure that when disabled people are present, adequate arrangements exist to enable
their safe evacuation
I will make sure that adequate and appropriate supply of first aid equipment and materials is
available on the premises
I will make sure that at least 1trained first aider(s) will be on duty when the public are present
In the absence of adequate daylight, I will make sure that the lighting in any area accessible
to the public is fully operational;
I will not alter Emergency lighting without prior notification to the Licensing Authority
I will make sure that Emergency lighting batteries are fully charged before admission of the
public;
In the event of failure of normal lighting, where the emergency lighting battery has a capacity
of one hour, I will make sure that evacuation of the premises is possible within 20 minutes;
Where the emergency lighting battery has a capacity of three hours, I will make sure that
evacuation of the premises is possible within one hour;
I will make sure that Fire safety signs are adequately illuminated;
I will make sure that the following systems are maintained and inspected by suitably qualified
professional persons in accordance with any British Standards and at intervals
recommended in national guidance, and will keep the records of such inspections available
for inspection by authorised officers on request:

Fire Warning System
Gas boiler, calorifier or appliance
Portable fire fighting equipment
Temporary Electrical Installation
I will make sure that I have valid public liability insurance in force and that a copy of the
schedule is available for inspection by an authorised officer on request.
I will make sure that an appropriately qualified medical practitioner is present throughout a
sports entertainment involving boxing, wrestling, judo, karate or other sports entertainment of
a similar nature;
Where a ring is used, I will make sure that it is constructed and installed by a competent
person. Any material used to form the skirt will be fire-retardant;
I will not alter the premises in such a way as to make it impossible to comply with an existing
licence condition, without first seeking a variation of the premises licence.
(N.B This will enable you to propose the amendment of any conditions that you would not
be able to comply with upon completion of works)
I will make free drinking water available at all times the premises is open to the public;
I will make sure that staff on the premises monitor and record the number of patrons within
the premises.
(NB: this condition would not be relevant where there is no maximum capacity
The prevention of public nuisance
All walls and roofs have been sound proofed
All windows and doors are kept shut when open
All extractor fans are baffled
No glass or bottles allowed to leave the premises
All clientele asked to leave quietly
There should not be any large numbers of people to the front of my premises, and will allow
a steady flow of people entering and leaving.
I will make sure that doors and windows are kept closed (except for ingress and egress) to
reduce noise nuisance from the premises;
I will display prominent, clear and legible notices at all exits requesting patrons to respect the
needs of local residents and to leave the premises and the area quietly;
I will make sure that the placing of bottles into receptacles outside the premises takes place
at times that will minimise disturbance to nearby properties;
I will ensure that any ventilation system has suitable sound attenuation.
Ensure that receptacles for waste are emptied regularly to minimise nuisance smells.
I will provide adequate and suitable (lidded) receptacles to receive and store refuse from the
premises/site.
I will make sure that receptacles for refuse storage are maintained in a clean condition.
I will make sure litter is regularly cleared form the vicinity of the premises.
The protection of children from harm
We request an over 18's policy therefore ID is required with anyone looking underage.
So no children allowed unless we have a private function
No children are allowed in the premises as we have an over 18's policy
I will not permit children under the age of 18 to access the premises
Note: the above condition may be appropriate where the premises are used for gambling or
any activity or entertainment (whether regulated entertainment or not) of a clearly adult or
sexual nature. Applicants wishing to allow access for children to premises where these
associations may be relevant should address in their operating plan their reasons and
explain the steps that they intend to take to protect children from harm
I will exclude children under the age of 18 will be excluded from the premises
Note: If this condition is appropriate, the operating schedule does not need to detail steps
that will be taken to promote the protection of children from harm. Otherwise, where entry is to be permitted, the operating schedule should outline steps to protect children from harm
while on the premises.
Annex 3 - Conditions attached after a hearing by the licensing authority
The applicant is to provide non-alcoholic hot drinks at the premises at all times the premises
are open to the public and those drinks are to be available for purchase at a price which is
less than the cheapest alcoholic drink. The applicant is granted a late might refreshment
licence for this purpose.
No admission to be allowed to the premises an hour before it ceases to serve alcohol.
Security Industry Registered door staff are employed at all times.
The CCTV system in the premises is maintained at all times with suitable lighting to
enhance the performance of it and aid identification in the event of any offences. In addition,
that all tapes or discs are retained for a minimum of 28 days and that they are available to
the police or other investigative body on demand.
All staff are provided with training or recognise and deal with people who appear to be
drunk, including a clear policy not to serve anyone who appears to be drunk.
1. That polycarbonate drinking vessels be used at all times.
2. That no drinks to be served in glass bottles.
3. That at all times a register be maintained on the premises, in which all refusals of
admission together with full details of the reason(s) for refusal be entered. This
register to be kept at the main entrance and to be freely available to both the Police
and authorised officers of the Licensing Authority.
4. That by use of either Town Link Radio or the 999 service all instances of ejection of
persons from the premises must be notified to the Police at the time of happening or
as soon as possible thereafter.
5. That all security staff are able to be easily identifiable at all times by use of high
visibility clothing/uniform.
6. That the Premises Licence holder will ensure that within six months of any
appointment of a new member of bar staff, that the said new member of staff receives
training to BIIAB Responsible Alcohol Retailing standards or equivalent. A record of
the training mentioned above must be kept at the premises, which must be made
available immediately to an authorised officer of the Police or Local Authority.
7. That the Premises Licence holder will, without any exceptions exclude any person with
a Court Exclusion Order or any person banned via the Local Pub Watch scheme for
the entire duration of their ban. All staff will be alert to the banned and excluded
persons and report any attempt that such persons make to gain access to the
premises.
8. That there will be a CCTV system installed and properly maintained at the premises at
all times.
9. That the CCTV system in the premises will be capable at all times of recording images
that are of evidential quality.
10. That all methods of data capture (in connection with the said CCTV system) whether
tapes or discs will be retained for a minimum of 28 days and will be made available to
the Police or any other Responsible Authority within 36hrs of a request.
11. That there will be sufficiently trained staff available at all times the premises are open
to operate and retrieve footage from the said CCTV system.
12. That the CCTV cameras will be sited in locations that ensure full coverage of the area
the public have access in a manner as agreed between the Premises Licence holder
and the Police.
13. That cameras covering the exterior of the premises will be left to record for a period of
not less than one hour after the premises have closed.
14. That the CCTV system will record in a suitable frame quality which will ensure no timelagged
loss of evidence and will record for the entire duration of time the public have
access to the premises.
15. That notices will be prominently displayed throughout the premises, advising that a
CCTV system has been installed.
16. That a written Dispersal Policy be agreed between the Premises Licence Holder and
the Police, which is to be lodged with the Licensing Authority within 28 days of receipt
of this Decision Notice. This Dispersal Policy must include volume, timing of music
and lighting.
The Licensing Panel also recommended that signage be displayed throughout the Premises
regarding theft and lost property.
