ANNEX 1 - MANDATORY CONDITIONS
The following conditions in Annex 1 are mandatory under the provisions of the Licensing Act 2003:
General condition: |
(a) The premises licence holder or club premises certificate holder must ensure that an age verification policy is adopted in respect of the premises in relation to the sale or supply of alcohol. (b) The designated premises supervisor in relation to the premises licence must ensure that the supply of alcohol at the premises is carried on in accordance with the age verification policy. The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and either - a holographic mark, or an ultraviolet feature. |
General condition: |
The relevant person (the holder of the premises licence, the designated premises supervisor (if any) in respect of such a licence, the personal licence holder who makes or authorises a supply of alcohol under such a licence, or any member or officer of a club present on the premises in a capacity which enables the member or officer to prevent the supply in question) shall ensure that no alcohol is sold or supplied for consumption on or off the premises for a price which is less than the permitted price. For the purposes of this condition "duty” is to be construed in accordance with the Alcoholic Liquor Duties Act 1979, "permitted price" is the price found by applying the formula - P = D + (D x V) where - P is the permitted price, D is the rate of duty chargeable in relation to the alcohol as if the duty were charged on the date of the sale or supply of the alcohol, and (iii) V is the rate of value added tax chargeable in relation to the alcohol as if the value added tax were charged on the date of the sale or supply of the alcohol; [“value added tax” means value added tax charged in accordance with the Value Added Tax Act 1994] |
General condition: |
(1) No supply of alcohol may be made under the premises licence: (a) at a time when there is no designated premises supervisor in respect of the premises licence; or (b) at a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended. (2) Every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence. |
Annex 2 - Conditions consistent with the operating schedule
A CCTV system will operate both externally and internally and will cover all high risk areas including all till points and the Beers, Wines, and Spirits department.
The CCTV recording unit will be positioned in a secure part of the premises. Access to the system will be allowed immediately to authorised officers of responsible authorities on request.
A competent trained person in the use of and operation of the CCTV will be in attendance at the premises at all times that licensable activities take place. This person will be able to fully operate the CCTV system and will be able to download, in a recognised format, any information requested but the responsible authorities.
The CCTV system clock will be set correctly and maintained (taking account of GMT and BST).
All CCTV recordings will be retained for a period of not less than 31 days.
It should be noted that any retention, use or disclosure of personal information captured on CCTV must be carried out in line with data protection principles which shall override any conflicting element of this condition.
The premises licence holder shall ensure that all members of staff are trained in the basic law relating to the sale/supply of alcohol, including sale of age restricted products and avoiding aggression. This training will be refreshed at least every 6 months, and will include a knowledge test. A record of all training will be kept and made available to authorised officers of responsible authorities upon request.
An incident reporting system shall be operated and maintained on the licensed premises to record all instances of crime and disorder related incidents and which shall be made available to the Police and an authorised officer of the Licensing Authority upon request.
The premise licence holder shall operate an electronic point of sale system which will automatically prompt the till operator to verify the age of a customer whenever alcohol is sold. All alcohol sales will be electronically recorded. These records will include both authorised and refused sales and will be kept on an electronic point of sale system. Hard copies of the refusal records will be produced for inspection by any responsible authority upon request.
All exit doors and fire doors shall be maintained so as easily opened, in the event of an emergency evacuation situation, and do not require the use of a key, card, code or similar device. Doors at such exits shall be regularly checked to ensure that they function satisfactorily and a record of the check is kept.
The premises licence holder shall ensure that suitable and satisfactory public and staff safety risk assessments are undertaken with outcomes to be legibly recorded in a log-book maintained for that purpose.
The premises licence holder shall engage with responsible authorities regarding any prevalent crime and disorder, public safety, public nuisance, and fire safety issues and shall implement any reasonable steps that are recommended by the authorities.
The premise licence holder shall operate a “Challenge 25” Proof of Age Policy. If a customer appears to be under 25 years of age and cannot proof that they are eligible to purchase the age restricted item with an acceptable form of identification, the will be refused service.
“Challenge 25” signage shall be displayed at the premises. The signage will be displayed in all areas where alcohol and all other age restricted goods are located for sale. Signage shall also be displayed the tills.
The only forms of identification accepted will be a valid passport, valid photo ID driving Licence, UK armed forces military ID or valid proof of age scheme card with the PASS approved hologram.
